HomeMy WebLinkAbout09-06-79 ` ~ • • s CITY OF LAKEVILLE PLANNING COMMISSION September 6, 1979 The meeting was called to order at 7:30 p.m, by the chairman, John Asmus. Roll call was taken. Present.: Commissionmembers Geisness, Asmus, Johnson, Enright and Harvey. Absent:. Hazel and Antolik. Motion was made by Harvey, seconded by Johnson to approve the minutes of the August 2, 1979 Planning .Commission meeting with one correction. Roll call was taken on the motion. Ayes, Geisness, Asmus, Johnson, Enright and Harvey. At this time the chairman reopened the public hearing on the preliminary plat known as Lake Villa Golf Estates. Mr. Byron Watschke was called upon to present the plat as the developer. At this time Commissonmember John Antolik arrived and took his chair. Mr. Watschke explained that the plat as presented includes 195 single family lots on 125 acres of land.. Mr. Watschke presented .maps showing the contour, drainage considerations,;ponding and road lot alignments. • At this time Mr. Asmus opened the meeting for questions or comments from the -citizens present. Dorothy Onlund asked Mr. Watschke about his property which is zoned B-4 commercial. Mr. Watschke answered that approximately 94 acres is zoned commercial and he foresees it being developed at some time for light commercial or office type uses. Mr. Mulenhardt asked about the future use of his farmland north of this property by plannings perspective. Mr. Licht explained that his property is presently zoned residential single family and is planned to be developed in that manner. Mr. Larry Bakken asked about pedestrian planning in the proposed plat. Mr. Watschke explained that the pedestrian could be accommodated either adjacent to the concrete curb and gutter by marking the edge of the road, or between the right of way line and the concrete curb and gutter and possibly by easements along side lot lines. Robert Peterson asked about utility service from this plat to the property he owns to the north. Mr. Watschke explained that his plat would include stubbing a sewer and water utility line to the north boundary either within a street or within an easement for future extension to other properties if the. City so desires. Mr. Steve Johnson asked about utilities, parks, access and a number of other things. Mr. Johnson questioned whether or not the property on the south side or west end of Orchard Lake could receive utility service from extensions of the system from the plat. The City Engineer., LeRoy Nyhus and City Administrator answered that it may be possible to connect city utilities along the south shore of Orchard Lake to utilities within this plat, however, further design analysis would be necessary to give a more specific answer as to the design requirements. -1- ~ • • CITY OF LAKEVILLE PLANNING COMMISSION • September 6, 1979 ~.._:_After considerable more discussion concerning the preliminary plat, Motion was made by Enright, seconded by Geisness to continue the public hearing on the preliminary plat to October 4, 197.9 Planning Commission meeting. Roll call was taken on the motion. Ayes, Antolik, Geisness, Asmus, Johnson, Enright and .Harvey. ` Chairman Asmus opened the public hearing on the application of -Byron Watschke to rezone the Lake Villa Golf Estates property from R-1B single family to R-1C single family and an outlot from R-1B single family to R-3B multi- family.residential at 9:40 p.m. The City Clerk attested to the legal notice of the hearing. Mr. Watschke explained that the request for the change in residential zoning is to accommodate legally single family lots which are either less than 100 feet in width or less than 20,000 square feet as presently required by R-1B zoning. He further explained that the request for R-3B zoning is for an 8-acre tract of land on the western side of his property adjacent to the Honeywell Golf Course. The request for R-3B, rather than R-3A is to allow construction in the future of up to seven dwelling units per structure. ..However, he stated he would be willing to sign an agreement which would limit a number of units that would be permitted under an R-3A zoning density. • Davi;~ Licht commented that the placement of the multiple zoning on the west side contrary to good planning as it should be a buffer .between .the present B-4 commercial zoning on the east and the single family property. However, in .light of the fact that there is a golf course involved at this date, and the plan is to develop multiple housing which would be marketed in_an effort to attract retired people who would like condominium type ownership and use of a golf coursj~has points in its favor. Mr. Licht also pointed out that an outlot cannot be developed until i.t is either replatted under PUD ordinance or traditional subdivision. The City Administrator pointed out that the golf course is for sale at this time and the present owners have been attempting to sell it for continued use as a golf course. Mr. Onlund, a citizen present, stated that the golf course is indeed for sale to anyone for any use. He stated that he was a member of Honeywell. Motion was made by Harvey, seconded by Antolik to continue the public hearing on the rezoning of Lake Villa Golf Estates to October. 4, 1979. Roll call was taken on the motion. Ayes, Geisness, Asmus, Johnson, Enright, Harvey and Antolik. Chairman Asmus opened the public hearing on the application of Lake Villa Golf • Estates to vacate platted road right-of-ways within their property at 10:12 p.m. The City Clerk attested to the legality of the hearing. -2- • . E t CITY OF LAKEVILLE PLANNING COMMISSION • September 6, 1979 Mr. and Mrs. Bakken were present and stated they did not favor the vacation of the street .which is adjoining their property and Mr. Watschke's. Mr. Watschke stated that he had withdrawn his application as far as the vacation of the common street right-of-way of 30 feet with the Bakken property, Mr. Robert Peterson stated that he and Mr. Russell Streefland d® n®t favor planning in the Lake Villa Golf Estates which would extend the street from that plot directly into their property. They would prefer to see the street cul-de-saced in the Lake Villa plat. Mr. Licht recommended that the three property owners to the north/northwest of Mr. Watschke's property jointly meet with Mr. Watschke in attempt to resolve their future planning goals and needs. He stated that this would be preferable to having the City have to do all the planning for them. Motion was made by Geisness, seconded by Johnson to continue the public hearing on the vacation of streets within the Lake Villa Golf Estates property to October 4, 1979. Roll call was taken on the motion. Ayes, Asmus, Johnson, Enright, xarvey, Antolik and Geisness. Time:. 1Os30 p.m. • At this time Chairman Asmus opened the public hearing on the application of Richard Ames to vacate the street and property he owns.. The City Clerk attested to the legality of the hearing. Mr. Don Allen of Probe Engineering was present representing Mr. Ames and presented a to plan drawing of the proposed new road which would either be platted or deeded to the City. The road would consist of a cul-de-sac off from County Road 44. The staff, Commission and applicant discussed the length of the cul-de-sac and type of-road that would need to be constructed. They also discussed the legalities of handling the number of lots which would be declared buildable and controlling the number. Mr. Licht advised the Planning Commission that a variance would need to be requested because the proposed new road is over 500 feet in length for a cul-de-sac and that the applicant may wish to replat the property within the present three platted lots. The Planning Commission stated that their consensus was that a variance for additional length of a cul-de-sac would be acceptable due to .the terrain in the area and the need to get the road to the buildable sites within the two or three lots. Motion was made by Geisness, seconded by Johnson to continue the public hearing to October 4, 1979 if the applicant makes application before September • 14th to the City Clerk. Roll call was taken on the motion. Ayes, Antolik, Geisness, Asmus, Johnson, Enright and Harvey. -3- t• ~ • CITY OF LAKEVILLE PLANNING COMMISSION September 6, 197 9 The continued public hearing on Dr. O'Brian's request for a conditional use permit and variance to build anew home on County Road 44 was reopened. Mr. Licht explained that Dr. O'Brian had been present earlier in the evening but had to leave and requested the .Planning Commission table the matter until he could complete amore accurate and descriptive site plan for the development of a home site. Motion was made by Harvey, seconded by Antolik to continue the public hearing of Dr. O'Brian until the applicant has submitted the necessary documentation. Roll call was taken on the. motion. Ayes, Antolik, Geisness, Asmus, Johnson, Enright and Harvey. At this time Mr. LeRoy Nyhus introduced Frank Kriz of C.E.D, and asvised the Planning Commission that Mr. Kriz will be working on Planning Commission matters with him. The Planning Commission and staff discussed the upcoming public hearing concerning .the Metropolitan Airport Commission proposal to acquire the Airlake Industrial Park Airport from Hitchcock Industries. The City Administrator advised the Planning Commission that the public hearing was set at Lakeville Senior High School for October 4, 1979, by MAC. Motion was made by Antolik, seconded by Harvey to adjourn the Planning Commision meeting. Roll call was taken on the motion. Ayes, Antolik, Geisness, Asmus, Johnson, Enright and Harvey.
