Councilman Bob Nelson was also present. 78.66 Motion was made bar Lutgens..Antolik tc> approve the minutes of the meeting held August 3, 1978. (There had not bean a meeting August 17th.) Rr~l1 call, voting aye: Enright, Antolik, Lutgens, Johnson, and Asmus. The .Commission was informthat items 3 and 4 of tonight's agenda, the continued public hearings of the requests of Bethlehem Evangelical Lutheran Church to (1) rezone property from- B-4 Commercial to R-1C Single-family, .and {2) permission to build a church, school, and parsonage on this property, which is the SE corner of Iberia avenue and Highway ,50, wi11 be held at the October 1978 meeting. This is at the request of the applicant. 78.67 Motion was made to recommend a denial of the request of Daniel Harris, applicant at a public hearing, to place a mob~.le home at 17995 Pilot Knob Road, because the applicant had not supplied proof of ownership nor proof o;f the size of the acreage urn which he wishes to place the mobrLle home. Knutson stated that the proper notices had been given sp that the request of Wren, Inc. was a legal public hearing. The public hearing of Wren, Inc. request to rezone a parcel of land, approximately 2~ acres, on the. west side of Iberia Avenue and south of H9.ghway from F3.4 Commercial is R-3A Multiple I~'amily Residence. was bun. Mr. Pat Wren was present tc> explain any materials or questions the Commissioners wished to ask. Planning commission had been furnished a memo from Midwest Planning Research in which they recommended approval of this request. The memo hors the date. of l4 August 1978. 78.68 A motion was m~deF, to close the public hearing. of Wren, Inc.. for rezoning a parcel of land, described above. Motion was made by Antolik and se~cc>nded by Lutgens. Voting aye were Lutgens, Johnson, Asmus, Enright. and Antol3.k« 78.69 A motion was made to recommend approval of the Wren, Inc. request to rezone a parcel of .land on the west side of Iberia Avenue from B-4 Commercial tc> R-3A Multiple Family Residence, was made by Lutgens and seconded by Enright. .The reasons gi.vem in the M~.dwest Planners meceo dated 14 August, were .the basis .for recommending approval of this application. Certification was given by Attorney Knutson that the request of Duane Fenne of Design Builders for preliminary plat approval of Rolling Acres Addition did con- stitute alegal publichearing. The hearing was opened.. 78.72 Motion was made to continue the public hearing on the request of Duane FeRnne of Design Builders for preliminary plat approval of Rolling Acres Addition, located in the S6~ of Section on the east side of Tpava Avenue and south of ib,5th Street, until September 21, 1978. Motion was by Lutgens and seconded by ~hright. The above motion was made, primarily, because of a memo wr3.tten by J. F~obinette, Public ~brks Director, at the direction of the. Natural Resources Committee, which said NR was not .able to give a recorsaaendation on Rolling Acres Addition at this tita.e. Voting aye were Antolik, Lutgens, Johnson, Asmus, and Enright. The request of Bill Jackson to rezone a parcel of land on 162nd Street from R-lC to B-~ was deemed a public hearing by Attorney Knutson. The legal public hearing tc> consider the request of Bill Jackson was begun. Mr. Jackson spoke, say3.ng that the surrounding area was zoned commercial use and that he had been unaware until a short time age, that his whole parcel was not of . tie same commercial zoning. Planner Ryan na3.d that "the surrounding area, whki.ch inelud®s the auto body shop, while it is in commercial use. it is anon-conforming use, at present. The other businesses are zonexi suitably." He went on to ask, "do we have the roads to serve that many acres' Most commercial has been given to a graduation of uses__some kind of a buff er i s needed Mr. Richard Thompson, stating he owns property and a home on Lot 8 of Jackson Addition, pointed to his property on the map and said he does not feel that we .need any more commercial use here. ?8.?3 Motion was made tr> close the public hearing on the Jackson request to rezone a parcel of land on 162nd Street. Motion was erode by Enright and seconded by Antolik. Voting aye were Lutgens, Johnson, Asmus, Lr~r3.ght, and Antolik. 78.74 Motion was made tc> recommend a .denial of the Jackson request to rezone property located on 162nd Street from R-1C single family to B-4 commercial, because the requested rezoning would not be in accordance with the established policy in Lakeville. Motion was made by Enright and seconded by Lutgens. Voting for a denial were Johnson, Asa?us, $'nright, Antolik, and Lutgens. Mr. Knutson stated that the request of Ne"i Lundquist for a variance at 16600 • Franchise Avenue did constitute a legal. public hearing, Mr. Lundquist said he needed a variance of 3~'feet in order to build the double garage he would like, attached to his house. Motion was made by Lutgens and seconded by Antolik. Voting aye wars ~x'ight, Antoli.k, Lutgens, Johnson, and Asmus. Mr. Lundquist was asked to attend the next Councril meeting on this matter. The Planning Commission was informed by Mr. Knutson that the proper notices of the Orest Spends request for a public hearing to rezone property had not been . given due notice. This public hearing will be bald on September 21, 197$ instead of .this evening. Item fl3 of the 1lgenda, the request of Daniel Morris for a variance to build below street grads and for a conditional use permit was declared a legal public hearing by Mr. Knutson. The hearing was opened. Mr. Morris was not present. Mr. Walt sternberg was present and asked to be heard. aMr. Morris is eonfussds, said Mr. Sternberg. aFie had been before Coundl for 7 weeks and has not been given a permit to do fillings, according to Mr. ,Sternberg. {Mr. Sternberg bad sold the lots in quest3.on to Mr. Morris.)
