Also in attendance were Attorney R: Knutson, Planner S. Ryan, and Building Inspector D, Goodermont. 77.109 Lutgens-Antolik motioned and seconded approval of .the minutes of the meeting' held September 1st. Vating "aye" were Campbell, Antolik, Spande, and Lutgens. Motion carried.` Mr. Jerry Pelach showed plans and explained his request for a variance to build on property on the North side of Lake Marion. D. Goodermont had written a memo as to elevations here and solution of possible drainage problem that is attached to these minutes. proval 77.110.Lutgens-Antolik`motioned to recommend~pf request of 3erry Pelach for a below- grade: variance on Lot 6, and west 20 .feet of Lot 7, Antlers Park Addition. Voting "aye" were Antolk, Spande, Lutgens, and Campbell. Motion carried. Mr. and Mrs. Richard Raine, who reside at 16530 Judicial Road, were present, asking for audience with the Planning Commission. They had been the recipients of a letter informing them that the mobile home they had installed at their home this past week was in violation of Lakeville City Ordinance No. 85. The Raine's family Y~ad ex- perienced afire in their home four weeks ago,. which has made their residence unin- habitable. They have been living in a motel until the present time. Their children are r.ew back in school. According to Mr. Raine, he does not plan to live`permanentl in the mobile home, he had a $58,000 home before the fire, and has only .rented thef$~~~~le for three months, with another possible month if he should need it, to repair his .dwelling. This is a five-acre location, and the Raine's have pets. The Commission was sympathetic with the Raine's in their predicament. The matter was left to the attorney to look into it further `to see what might be done to .help them. It was recommended that when the City attorney has found a solution , that Mr. Raine be notified and return to the Planning Commission. This is to be an agenda item,for next meeting, October 6th. Complaints, should they be made, are to be referred to the Building Inspector and the Planning Commission. Mr. Don Hall and Mr. Dick Weiser, makers of pre-cast steps, wished to:be heard on their desire to purchase property west of 35W and south of Hwy 70--a 5° -acre strip of land now belonging to Chris Gnerer. They stated that water would be no problem--what they use evaporates... Sewage would not be a problem, either, they have"very few emplcayees and nothing else in their manufacturing process. They stated that they had furnished the City with written and printed materials concerning their business last September lat. Mr. Weiser operates a business such as this in LaCrescent, Both Mr. Weiser and Mr. Hall stressed the necessity of their business being located on the highway, in view of their product from the highway, in order for them to have their business. Transport- tion of their product is expensive-models weight is different, but ordinary stoop weighs a ton.. They have a purchase agreement with Mr. Gnerer, contingent upon their being able to obtain a building permit., Chairman advised Mr. Hall and Mr. Wieser to check with Mr. McGarvey once again. The two gentlemen were advised of the present moriatorium on building. They also were told of a_possible 90-day extension of this moriatorium that is being considered. -Midwest Tanners are advising the 90-day extension because of all the changes at Metra level, that are being considered. Mr. Campbell explained that "it is not our intention to keep good business out of Lakeville, but by the: same token, we must uphold the city's ordinances, etc." 77.111 Spande-Lutgens motioned to recommend to Council an extension of Resolution No. 76.49 for 90-day period. Voting "aye" were Spande, Lutgens, Campbell, and Antolik. Motion carried. R. Knutson stated that the .animal ordinance will be in court in two weeks. A disussion of what is a domestic animal vs non-domestic animal once again ensued. This matter still appears to be far from an easy definition. 77.112 Spande-Lutgens motioned to table any further action on Ordinance No. 42 dealing with animals, until after results of the hearing with Mr.'Graeves (beax) are finalized. Voting."aye" were Lutgens, Campbell, Antolik, and Spande. Motion carried. • Reviewal of Shoreland Qrdinance commenced, with Planner S, Ryan leading the discussion. K. Lutgens wished to know if this ordinance had any effect on present systems. The answer was that any septic system not up to standards would have to be upgraded. Mr. Ryan went on to say that there are some policy issues; some are State coded, some can be controlled by present ordinance, and something will be coming to us from IaNR. (l) PLANNING COMMISSION 15 SEPTEMBER 1977 (2) PLANNING COMb~N 15 SEPTEMBER 1977.. Changes suggested by the Natural Resources ..Committee have been included in this present .report, "Comprehensive Plan Natural/~hvironmental Resources", from David Licht/ Steve Ryan, :dated September 12, 1977. According to S. Ryan , the subdivision. ordinance is in staff reviewal, presently. ere are problems-with scope of the ordinance. Nothing on Storm Drainage Phase I presently. J. Antolik will not be able to attend the next Council meeting, September 19th.. G. Spande will go in his place. 77.113 Antolik-Campbell motioned to accept the resignation of John Jojade. He states in a letter to Council and Commission that he is moving. M Klotz is`directed to write him a letter of appreciation for the many years he has served and his atten- tion to Planning .Commission matters.
