The meeting was called to order by Vice-Chairman G. Sande, with Members pntolik,
Lutgens and .Asmus in attendance. (Chairman Campbell came later in the evening. )

Engineers Schneider and Berg--and a large audience including Mayor-elect Lexsc~n and
Natural Resources' members Ostlund and N. Jensen.
77. 157 Motion was made and seconded to apl>rove the minutes of December 1st,
.Motion carried.
The public hearing of variance request of Neil and Candace Okeson pertaining to
Lot 18, Block. 1, Marion Heights, was begun. The problems here are two: possible
location of septic system in regards, especially, to neighborr s well, grad size of lot.
( This particular .lot has a ' as-traveled' road across part of it. }
,pccording to R. Knutson, a hardship may have been created when someone who owned several
lots, did sell a small one. The platting of these lots was done in 1910. City ordinances
which pertain, were passed in 19?2.
Darrell Schneider was concerned whether the lot can stand on-site sewer disposal--and,
it will be difficult to locate a well, else. It was thought the proposed drainfield
would have to be much closer inside the lot line than what is shown on the plan--and
i s difficult to see how a drainfield that laxge would set on the property The thought
was rai sed that the ,state might have to be contacted for authority to locate the drain-
. field where it is proposed. Mrs. Elsie Jensen stated that she did own Lot l~ and Lot
19e
The position of the applicants was given; (1) it was their desire to start construction
in early spring, and (2} they will have to leave the present place they are living. 'T'hey
asked the questions about "who will assure responc sibilities for further studies? "are
there things that we should be doing? "where can we get further infonnation? R. Knut-
son said he would forward the information he has to them.
Sande voiced the thought that there ware two parts to making a decision, based on sewer
situation and lot size. M. Johnson stated ?'the traveled road is part of this lot, so
there is a determination to be made of the lot lines". The owner of the property, and
applicaX~t at this hearing, spoke ~'it was sold- to me as a buildable lot". It was brought
to his attention that the septic system. had to be located. at least fifty feet away .from
the location of wells. The type of ~y stem was al so ~ di scu sled. The applicant asked if
a "rnaund" system could be used. D. Schneider replied, "if it can be stabilized--so there
shouldn~t be an erosion problem. It requires a special permit in order to try any of
these special systems. It will take some design worx.
R. Knutson asked. if the date of sale of this. property was known. It was determined that
the date was .August 29 , 1977
N. Jensen spoke saying that if the septic system drainage would go through, there is a
large number of trees, both on their land and the applicantr s land, which would be affected.
Lot 19, next to the applicant's, is vacant, it was determined. ~1

January ,nth, or the 19th, when some clarifications have been made, Lutgens.

Street was. the next item on the agenda. Mike stated that he needs additional office space.

had been a nonconforming use question some months ago? McGarvey answered that that was
not on this particular piece.,.
77.X59 Motion was made and seconded to approve the building plan for Addition to build-
. ing at Mikes s auto Sa1.~, .pntolik-Lutgens. Voting "aye~~ were Lutgens, Asnus,
S~aande, and ,Aritolik. Motion .carried. (Campbell abstained from voting because
he had not heard all the di seussion of the matter. )
M. Gannon was told by administrator McGarvey that this would be an agenda item at the
Council meeting next Monday eve. , December lyth.
James Fritz was present, applying for. approval to move a 2-car garage, 20~x30~, from
.Cedar ;~v. bridge site. in Bloomington, to his 3-acre home on Kenwood Trail, Hwy ,50, just
south of 176th Street. He presented pictures. ,~ande asked if there was a letter from
the ~zilding Inspector, stating his recommendation?
77.160 Motion was made and seconded to recommend approval of moving the arage to
Jim Fritz residence on Kenwood Trail, subject to receiving a letter from the
Building Inspector saying he approves it--;gsnus and Lutgens. Voting ~~aye~~ were
~Asmus, Campbell, Sande, and pntolik. Motion carried.
Mr. Fritz was asked to attend the Council meeting on Monday, December lyth.
A site plan of lst Lakeville ;Mate Bank for adding one- more lane to their drive-in struc-
• ture was presented by Mr. McGarvey.
7.7. 161 Motion was made and seconded to recommend a~r_owa~l of building permit for lst
Lakeville State Bank to add another drive-i-n-Tare---Lutgens and ,~snus. Voting
"aye" were Campbell, .Spend®, ,;gntolik, and Asmus and Lutgens. Motion carried.
Mr. McGax'vey stated that proper notices had been mailed to individuals concerned and
publication notice had been given to hold the next public hearing, preliminary plat plan
of Ibdd park.
Dodd Park is a 60 acre pieta of land, triangular-shaped, between Dodd B1.vd and Flagstaff
qv. , near Valley park. p representative of ~mstock & Davis, surveyors of the project,
went through the entire recommendation report, dated December 12, 1977, of David Licht/
Phil Hansey to Pat McGarvey, item by item. He stated that they had been working on this
development since the last of Qctober, with Planner and Staff. There remained t~_,possibly
three, items to be worked out, .which he declared it would not take long to do. In all other
suggestions, they were in agreement. They have been to Natural Resources Committee and
Park & Rec Committee meetings for their suggestions and recommendations.
Engineers had questions concerning Lot 1, Block 1--sanitary sewer is very deep and the lot
is shallow. Oomstock..Davis representative said ~iwould 2 to 1 slope handle? They would be
agreeable to limiting the access to this lot and keeping the house on front~~.
Mr. McGarvey said the question of park' land donation had not been fully decided by the
Committee, but they were lea~ntng towards acceptance of what was propo sed. This i s
• ap~,roximataly 10 acres, including approximately lZ acres for easements. It is located
across from park located in Valley Park, and would so abut it..

is agreed. Drainage problems have been taxen care of, matter of storm sewers and calcula-

done in a day-'. He also s~atad notarization would be on th~inal plat.
,~snus was still concerned about "where does the water go after it is in the ditch?'~ The
map was shown and explained. It was planned that the cul-de-sacs would be graveled.
D. Ostlund spoke saying there was a setting of 935 on the flood plain map, and they were
show~.ng 934 in some instances. It was explained that part of this flood plain was set
at 935, this being the most easterly, but in the middle it was 9342 setting, and at the
far west, only y34. It was further explained that there is both a flood way and a flood
plain--houses cannot be built in a flood way, but this is a flood plaa.n.

77.165 Motion by ,Asmus-Antolik to make recommendation to Council 'ghat they extend
gravel permits e ~~~__ir~~at~___i~~_o~n date by 90 d s, and that the ordinance No. 104
be amended so tha~~persons extrac ng he gravel sutxnit a plan of how they
wil.t.emtour the land, to assure its acceptability when they cease their operation.

Mention was made that an agenda item for January 5th jwou b~ the reviewing of Ordinance
No. 104.
Mr. McGarvey spoke of an interest of CSC, providing they get funding, for property on
Hwy at lbtith Street, for a home for battered women. ,~rould this come at~out, it is
suggested by the planner that it be handled with a conditional. use permit. The zoning
here i s 84~.
77.166 Motion to adjourn was made by ~ntolik and,~pande. Motion carried.
X11 Campbell spoke a few words in farewell to this Commission. ge considered it a
worthwhile and educational experience, and gave thanks to other members for their assis-
tance. G. ,~ande also spoke. This is his last meeting, also, as he wail be a Council
member after the 1st of the year.
