Proposed Action
Planning Department staff recommends adoption of the following motion: move to approve a minor
variance for South Twin Cities Church to allow a ten foot setback from Cedar Avenue and 161 Street
and a maximum height of fifteen feet for a free standing sign.
Approval of the variance will allow the setback for the free standing sign to be reduced from fifteen feet to
ten feet along the west property line adjacent to Cedar Avenue and along the north property line adjacent
to 161 Street and provide for a maximum sign height of fifteen feet.
Overview
South Twin Cities Church of Christ located at 7450 161 Street has submitted an application requesting a
minor variance to reduce the required setback from Cedar Avenue and 161 Street right -of -way for a new
free standing sign from fifteen to ten feet and to allow the height of the sign to be increased from ten to
fifteen feet. The Zoning Ordinance includes two variance classifications identified as minor and major.
This request is considered a minor variance due to hardship to the property created as a result of the
Cedar Avenue bus rapid transit improvement project. A minor variance provides an expeditious method
of processing variance requests that do not require a public hearing or review by the Planning
Commission.
Through the review process and working with the applicant it was determined the requested setback and
height variance qualifies as a minor variance due to hardships as a result of government action from the
impacts of the Cedar Avenue improvement project including the acquisition of a temporary construction
easement, installation of a retaining wall and fence that would block the view of a sign shorter than fifteen
feet. In addition, the church's existing monument sign adjacent to Cedar Avenue was removed due to the
Cedar Avenue improvement project.
Planning Department staff recommends the City Council grant the minor variance to allow the setback for
the churches new free standing sign at 7450 161 Street to be reduced from fifteen to ten feet along the
north and west property lines adjacent to 161 Street and Cedar Avenue and to allow the overall height of
the sign to be increased from ten to fifteen feet.

VARIANCE
1. Permit. Subject to the terms and conditions set forth herein, the City of Lakeville
hereby grants a variance to South Twin Cities Church of Christ to reduce the required
setback from Cedar Avenue and 161 Street for a proposed free standing sign from fifteen
feet to ten feet and increase the maximum height for a free standing sign from ten to fifteen
feet on property located at 7450 161 Street.
2. Property. The variance is for the following described property in the City of
Lakeville, Dakota County, Minnesota:

3. Conditions. The variance is issued subject to compliance with the following terms
and conditions:
a. The free standing sign must be setback a minimum of ten feet from the west and
north property lines adjacent to Cedar Avenue and 161 Street and not exceed a
height of fifteen feet.
b. The installation of the free standing sign shall not impact any existing parking
spaces.
