SPIRIT OF BRANDTJEN FARM 8TH ADDITION EASEMENT VACATION
Proposed Action
Staff recommends adoption of the following motion: Move to approve a resolution vacating an
existing drainage and utility easement within Outlot A, Spirit of Brandtjen Farm 6 Addition.
Overview
On October 17, 2011 the City Council approved the Spirit of Brandtjen Farm (SBF) 8 Addition
final plat. There is an existing public drainage and utility easement within the parent parcel -
Outlot A, SBF 6 Addition. This easement is proposed to be vacated consistent with City policy.
A new public drainage and utility easement to replace the easement to be vacated is included
on the SBF 8 Addition final plat.
The Planning Commission held a public hearing on the easement vacation at their November
17, 2011 meeting. There was no public comment. The Planning Commission unanimously
recommended approval. Planning and Engineering Department staff also recommend
approval.

RESOLUTION NO.
RESOLUTION VACATING PUBLIC DRAINAGE AND UTILITY EASEMENTS
WHEREAS, the Planning Commission has conducted a public hearing, preceded
by two (2) weeks published notice, to consider the following described easement
vacation, and
WHEREAS, the City Council has determined that it is in the public interest to
approve the easement vacation.
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council:
1. The public drainage and utility easements located within Outlot A, Spirit of
Brandtjen Farm r Addition are hereby vacated subject to the recording of
the Spirit of Brandtjen Farm 8 Addition final plat.
2. The City Clerk is directed to file a certified copy of this resolution with the
Dakota County Recorder.

Chair Davis opened the public hearing to consider the application of SBF
Development Corp. for the vacation of a public drainage and utility easement,
located east of Eagleview Drive and north of 167th Street. The Recording Secretary
attested that the legal notice had been duly published in accordance with State
Statutes and City Code.
Planning Director Daryl Morey presented the planning report. Mr. Morey stated
that on October 17, 2011 the City Council approved the Spirit of Brandtjen Farm
(SBF) 8th Addition final plat. He indicated that there is an existing public drainage
and utility easement within the parent parcel of Outlot A, SBF 6th Addition. Mr.
Morey indicated that this easement is proposed to be vacated consistent with City
policy and a new public drainage and utility easement to replace the easement to be
vacated is included on the SBF 8th Addition final plat.
