RESOLUTION ORDERING THE 2012 STREET RECONSTRUCTION PROJECT
AND AUTHORIZING THE PREPARATION OF PLANS AND SPECIFICATIONS
Proposed Action
Staff recommends adoption of the following motion: Move to approve the attached
resolution ordering the 2012 Street Reconstruction Project and authorizing the
preparation of plans and specifications for 2012 Street Reconstruction Project within
portions of Cedar Highlands 1 Cedar Highlands 2 "d , Cedar Highlands 3 Cedar
Highlands 4 Cedar Highlands 5 Dodd Park, Donnay's College Park, Donnay's
College Park 2 "d , Donnay's Valley Park, Donnay's Valley Park 2 " Donnay's Valley
Park 3 Donnay's Valley Park 4 Donnay's Valley Park 5 Addition, and properties
along Gerdine Path between 170 Street West and Dodd Boulevard. These street
improvements constitute City Improvement Project 12 -02.
Overview
At its December 5, 2011 meeting, the Lakeville City Council received a Feasibility
Report for the 2012 street improvement project and set a public hearing for January 3,
2012. Notice of the public hearing was published and forwarded to the affected
property owners. All responses from property owners prior to the Public Hearing have
been logged and are attached.
Prior to the public hearing, City Staff along with staff from WSB & Associates will
provide a brief presentation of the project, project costs and assessments.
Following the public hearing and if the City Council elects to proceed with the project,
City staff recommends that the City Council approve the attached resolution ordering
the 2012 Street Reconstruction Project and authorizing the preparation of plans and
specifications.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Lakeville,
Minnesota:
1. The 2012 Street Reconstruction Project is hereby ordered as identified in the
Feasibility Report for Project 12 -02, dated December 5, 2011.
2. WSB & Associates, Inc. is hereby authorized to prepare plans and
specifications for the making of such improvements.

NOTICE OF HEARING ON IMPROVEMENT
TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN that the City Council of Lakeville will meet at
7:00 p.m. on Tuesday, January 3, 2012, at the City Council Chambers, 20195
Holyoke Avenue, Lakeville, Minnesota, to consider the 2012 Street
Reconstruction Project within portions of Cedar Highlands 1 Cedar Highlands

The area proposed to be assessed for the improvements is as follows:
The project will include property in that part of Sections 3 & 10 Township
114 Range 20, lying east of Interstate 35 within the City of Lakeville, Dakota
County, Minnesota, and also being in subdivisions: Cedar Highlands 1 Cedar
Highlands 2 Cedar Highlands 3 Cedar Highlands 4 Cedar Highlands 5th,
Dodd Park, Donnay's College Park, Donnay's College Park 2 Donnay's Valley
Park, Donnay's Valley Park 2 Donnay's Valley Park 3 Donnay's Valley Park
• Donnay's Valley Park 5 Addition, and properties along Gerdine Path
between 170 Street West and Dodd Boulevard.
The estimated cost of the improvement is $8,636,000. Such persons as
desire to be heard with reference to the proposed improvement will be heard at
this meeting.

Dear Property Owner:
This letter is to inform you that a Public Hearing will be held on Tuesday, January 3, 2012, ai
7 :00 P.M. in the Lakeville City Hall Council Chambers, 20195 Holyoke Avenue, for City
Improvement Project 12 -02. The proposed roadway improvements will affect your property.
Following public comment, the City Council will consider ordering the improvements.
The estimated cost for the road reconstruction and utility improvements is $8,636,000. Of those
total project costs, $1,236,000 is associated with water main replacement in the project area, and
is proposed to be funded using City Utility Funds. The remaining $7,400,000 associated with
surface and storm sewer improvements will be 60% funded by the City and 40% funded from
assessments to the benefiting properties. A reasonable estimate of the cost of the assessment will
be available at the hearing. The amount proposed to be assessed is as follows:
A Neighborhood Meeting to discuss this project was previously held on September 22, 2011 at
Parkview Elementary School. Please refer to the attached meeting minutes for additional
information on this meeting.

approx. $3,700, and that original assessment range presented to residents was
$3,800- $4,200 /sf unit.

Resident cannot attend neighborhood meeting. Would like meeting minutes sent.
Also concemed he will be assessed "twice" because he lives on a comer lot. He felt
the streets in the area really needed the work, though.

point in time, especially in such a down economy. Resident thinks a street
improvement project in this area could be pushed back a few years, but that any
necessary water main or sanitary sewer repairs could be invested in now, as they are
more necessary.

Resident e- mailed City to inquire why there was no information regarding the public
hearing for 2012 SIP.
Resident was unable to attend meeting, but wanted to emphasize to the Council that
he was "all for" the project, and understands the costs wit be assessed. The streets
definitely need it. However, he feels a majority of the damage to the streets is done
by the three waste haulers that make three trips each a week (for garbage, yard waste
and recycling). This resident would like for the City to consider allowing only one
waste - hauler to operate within the neighborhood.

"About every three years, my sewer drain backs up. Roto Rooter says it's beyond my
property line into the streets where there are trees. Is there City draintile that extends
out into the City sewer main? We may need to have new drain placed since tree roots
may have damaged the existing tile. We also need a new drain at the intersection of
Galena and 168th Court West. Water always collects here."
Rear yard drainage issues - Installed sump and french drain system along property
lines to keep water away from house. Would like draintile stubbed out from existing
catch basin near driveway.

assessment term, possible interest rates and the City's assessment policy. Mr
Petree also confirmed that Ms. Sargenrs name and correct mailing address was

to her.
Monica Hell e- mailed the resident that sidewalk replacement was proposed as a part
of the 2012 Street Reconstruction Project. Ms. Heil indicated that she made note of
this resident's location, and would evaluate the sidewalk adjacent to his property with
final design of the project.
Chris Petree answered all of the residents questions regarding the project timeline
and scope.
Comment
Resident inquired as to whether or nor Gerdine Court was included in the 2012 Street
Reconstruction Project Area
Residents are concerned about vehicle speeds along Galena Avenue, plowing
activities in their neighborhood (trails are sometimes plowed before streets), and North
Creek drainage concems.
Resident requested a copy of the Neighborhood Meeting Minutes and presentation
materials.
( Resident spoke with Mark DuChene - has concerns about drainage in front of his
property he would like investigated with the Street Improvement project.
Resident had questions about proposed improvements, when construction might take
place, staging of construction, and proposed assessment.
Chris Petree spoke to resident. Resident had questions regarding the assessment
term, interest rate, deferrals and early pay-off. Resident also indicated there were
also drainage issues at the Intersection of 167th Street and Franchise Avenue,
specifically in the southwest comer of the intersection.

Resident called Chris Petree with questions about why he was being assessed for
improvement along a street his property does not front on ( Gerdine Path). Mr. Petree
explained that the first 100' of Garcia will be reconstructed and the water main will be
replaced. Mr. Petree explained this segment was included In the 2012 SIP because of
the high concentration of water main breaks in the area.
Resident had questions about the annual increase he could expect to see in his taxes
due to the special assessment.
Resident contacted City Finance Director Feller with inquiries as to whether or not any
other financing options for the proposed assessments were available. Mr. Hoover's
interpretation of the Notice of Public Hearing Letter and Neighborhood Meeting
Minutes was that the assessment was due within 30 -days and must be paid prior to
the start of the project. Mr. Hoover wanted to know why the assessment was not
going to be made payable over several year.
Resident e- mailed Mayor Bellows regarding the Notice of Public Hearing letter that
was mailed out to residents. Ms. Sargent indicated she did not receive a copy of the
notice at her residence, but that neighbors she has spoken to indicated that the Public
Hearing Notice and Neighborhood Meeting Minutes stated that the entire assessment
amount was due in 30 -days. Resident plans to attend the Public Hearing on January
3rd with her neighbors.
- Mr., Ketcher e- mailed the City's Streets Department with an inquiry as to whether or
not sidewalk replacement was included as a part of the 2012 Street Reconstruction
Project. Mr. Katcher reported that a portion of the sidewalk adjacent to his property
holds water and creates an icing problem during the winter and early spring seasons.
Resident contacted Chris Petree with general questions regarding project timeline and
scope. Resident was generally supportive of the project.
