Adoption of this motion will allow the re -plat of single family lots in the Spirit of Brandtjen Farm planned unit development (SBF PUD). Overview Tradition Development (a /k /a SBF Development Corp.) representatives are requesting approval of the Spirit of Brandtjen Farm 9 Addition final plat of 12 single family lots. SBF 9 Addition is a re -plat of 13 single family lots in SBF 7 Addition. The re -plat will accommodate a new home builder in Spirit that is requiring slightly larger house pads. In conjunction with the re -plat, the boundary drainage and utility easements within the existing lots are being vacated and new drainage and utility easements are being established along the new platted lot lines. The Planning Commission held a public hearing on the easement vacation application at their February 16, 2012 meeting and unanimously recommended approval. Planning and Engineering staff recommend approval of the SBF 9 Addition final plat and easement vacation. Primary Issues to Consider • Why is there no Planning Commission recommendation for the SBF 9 Addition final plat? The Subdivision Ordinance amendment approved by the City Council on January 3, 2012 no longer requires final plat review by the Planning Commission. Planning Commission Meeting February 16, 2012 Page 2 Chair Davis opened the public hearing to consider the application of SBF Development Corp. for the vacation of public drainage and utility easements in conjunction with the re- platting of 13 lots in Spirit of Brandtjen Farm 7th Addition. The Recording Secretary attested that the legal notice had been duly published in accordance with State Statutes and City Code. Jacob Fick from SBF Development Corp. presented an overview of his request. Mr. Fick stated that 13 lots in SBF 7th Addition are being re- platted to accommodate a new builder, who is requiring larger house pads. Planning Director Daryl Morey presented the planning report.. Mr. Morey stated that in conjunction with the SBF 9th Addition final plat, SBF = Development Corporation has submitted an application to vacate the .existing drainage and utility easements along the boundaries of the 13 lots being re- platted. He indicated that new drainage and utility easements will be established along the boundaries of the 12 lots being final platted in SBF 9th Addition, which is one lot less than was originally final platted with SBF 7* Addition. Mr. Morey reminded the Planning, Commission that due to the Subdivision Ordinance amendment approved by the City Council on January 3, 2012, final plats • no longer require review by the Planning Commission. In conjunction with the final plat, Tradition Development is requesting the vacation of the boundary drainage and utility easements within the 13 lots being re- platted. The Spirit of Brandtjen Farm 9 Addition final plat is located in the southeast corner of the 550 acre Spirit of Brandtjen Farm (SBF) Planned Unit Development (PUD) approved in 2005. The SBF 7th Addition final plat of 34 single family lots was approved by the City Council on August 1, 2011. The 12 single family lots in the SBF 9 Addition re -plat are consistent with the lot design approved with the SBF 7 Addition preliminary plat. The street serving the 12 single family lots (Diamonte Way) has already been constructed and is not being modified by the proposed re -plat. Lots. There is no minimum lot area required by the SBF PUD District. Rather, lots are regulated based on minimum width requirements, setbacks and design standards established by the SBF PUD Booklet dated June 20, 2005. The lots in SBF 9 Addition are proposed with a minimum 60 foot width and are subject to the cottage lot standards as set forth in Section 7 of the SBF PUD Booklet. Setbacks. All of the proposed single family lots are subject to the setback requirements established for cottage lots: Streets. The 12 single family lots in SBF 9 Addition front Diamonte Way, a 28 foot wide urban street with on- street parking and a five foot concrete sidewalk on the outside edge of the loop that encloses a private, homeowners association maintained green space. A 52 foot right -of -way was previously dedicated for Diamonte Way consistent with the design standards for SC.3 (Streetscape 3) on page 6.2 of the SBF PUD Booklet. 2 SBF 9 Addition Final Plat March 5, 2012 City Council Meeting SBF 9 Addition also abuts 170 Street, a major collector. A 55 foot north half right -of -way exists for 170 Street. No additional right -of -way dedication is required. The buffer yard berming and landscaping for the lots abutting 170 Street were installed with a previous SBF development phase. SBF 9 Addition also abuts future Diamond Path, a major collector. An 80 foot west half right -of -way was dedicated for future Diamond Path with the SBF 7 Addition final plat. No additional right -of -way dedication is required. Diamond Path will be constructed at a future date when the need for the street is warranted. Grading, Drainage, Erosion Control and Utilities. Engineering Department staff have reviewed the SBF 9 Addition final plat and easement vacation and recommend approval in their attached memo dated February 29, 2012. Easement Vacation. The SBF 9 Addition final plat includes the vacation of the existing boundary drainage and utility easements within the 13 single family lots being re- platted. New public drainage and utility easements are shown for each of the 12 single family lots included with the SBF 9 Addition final plat. The Planning Commission held a public hearing on the easement vacation request at their February 16, 2012 meeting and unanimously recommended approval. There was no public comment. On January 3, 2012 the City Council approved an amendment to the Subdivision Ordinance such that the Planning Commission will no longer review final plats unless they are inconsistent with the approved preliminary plat. As such, the Planning Commission recommendation pertains only to the easement vacation, not the final plat. RECOMMENDATION Planning Department staff recommends approval of the Spirit of Brandtjen Farm 9 Addition final plat and easement vacation subject to the following stipulations: 1. The recommendations listed in the February 29, 2012 engineering report. 2. The proposed residential subdivision is a re -plat of Lots 7 -19, Block 2, Spirit of Brandtjen Farm 7th Addition. The final plat results in one fewer lot as the Developer revised the site layout to accommodate single family homes with wider building pad areas. The plat is zoned PUD, Planned Unit Development District. The residential subdivision is located north of and adjacent to 170 Street, west of and adjacent to the future extension of Diamond Path (CSAH -33) and east of the farmstead preservation area. SITE CONDITIONS Spirit of Brandtjen Farm 9th Addition was mass graded with the Spirit of Brandtjen Farm 7 Addition improvements. Public utilities and streets were constructed with Spirit of Brandtjen Farm 7 improvements. EASEMENTS AND EASEMENT VACATIONS Drainage and utility easements in favor of the City of Lakeville were previously established around the perimeter of the individual lots, as depicted on the Spirit of SPIRIT OF BRANDTJEN FARM 9 7 " ADDITION FEBRUARY 29, 2012 PAGE 2 OF 5 Brandtjen Farm 7 Addition plat. The easements will be vacated and re- platted along the new lot lines with the Spirit of Brandtjen Farm 9 Addition plat. STREET AND SITE LAYOUT 170 Street Spirit of Brandtjen Farm 9 Addition is north of and adjacent to 170 Street, a major collector roadway as identified in the City's Transportation Plan. The Developer previously dedicated 55 feet of right -of -way, consistent with the 1 /2 right -of -way requirement for a major collector, with the Spirit of Brandtjen Farm plat. 170 Street is constructed as a two -lane undivided roadway. The north half of the road is an urban section with concrete curb and gutter while the south half is a rural section. Designated left and right -turn lanes exist at the Draft Horse Boulevard intersection. The ultimate roadway section for 170 Street will likely consist of a 52- foot wide undivided urban roadway with shoulders and striped as a three -lane section, with one through -lane in each direction and a center continuous left -turn lane with exclusive turn lanes at the intersections. Diamond Path Spirit of Brandtjen Farm 9 Addition is west of and adjacent to Diamond Path, a future major collector roadway as identified in the City's Transportation Plan. The current Dakota County Road Plat Review Needs Map identifies Diamond Path as a future four -lane undivided County State Aid Highway with a 1 /2 right -of -way requirement of 60 feet. The Developer has dedicated 80 feet of right -of -way, as shown on the Spirit of Brandtjen Farm 7th Addition plat, to satisfy the 1 /2 right -of -way requirement for Diamond Path. The County's current Capital Improvement Program does not include the construction of Diamond Path. Diamond Path will be constructed in the future when the need for the street is warranted. Diamonte Way Diamonte Way was constructed with Spirit of Brandtjen Farm 7th Addition and is designed as a 28 -foot wide urban street with a 5 -foot wide concrete sidewalk along the outside edge of the loop. The southern end of Diamonte Way transitions into a loop with a 5 -foot wide concrete sidewalk along one side. The Developer previously dedicated 52 feet of right -of -way, as shown on the Spirit of Brandtjen Farm 7th Addition plat, to satisfy the right -of -way requirement for Diamonte Way. The street and landscape boulevard design is consistent with the approved Spirit of Brandtjen Farm Planned Unit Development Plan. SPIRIT OF BRANDT]EN FARM 9 T " ADDITION FEBRUARY 29, 2012 PAGE 3 OF 5 PARKS AND TRAILS There is no new trail or sidewalk requirement with Spirit of Brandtjen Farm 9th Addition. A 5 -foot wide concrete sidewalk along the outside edge of the loop of Diamonte Way was constructed with Spirit of Brandtjen Farm 7 Addition improvements. The Park Dedication Fee was paid with Spirit of Brandtjen Farm 7 Addition; therefore no Park Dedication shall be collected with Spirit of Brandtjen Farm 9th Addition. UTILITIES SANITARY SEWER & WATERMAIN Development of Spirit of Brandtjen Farm 9 Addition will not require new sanitary sewer or watermain construction. Sanitary sewer, watermain, and sanitary sewer and water services installed with Spirit of Brandtjen Farm 7 Addition improvements will serve the lots within Spirit of Brandtjen Farm 9 Addition. As a result of the revised site layout, one sanitary sewer and water service pair must be abandoned. The abandoned service pair must be removed entirely to the utility main and plugged per the manufacturer's recommendations. No certificates of occupancy will be issued for the following lots until the abandonment has been completed: • Lots 5 & 6, Block 1 The Sanitary Sewer Availability Charge was paid with Spirit of Brandtjen Farm 7th Addition; therefore no Sanitary Sewer Availability Charge shall be collected with Spirit of Brandtjen Farm 9 Addition. DRAINAGE AND GRADING Spirit of Brandtjen Farm 9 Addition was mass graded with Spirit of Brandtjen Farm 7 Addition. The final grading plan shall identify all fill lots in which the building footings will be placed on fill material. The grading specifications shall also indicate that all embankments meet FHA /HUD 79G specifications. The Developer shall certify to the City that all Tots with footings placed on fill material are appropriately constructed. Building permits for Spirit of Brandtjen Farm 9 Addition shall not be issued until a certified grading plan has been submitted and approved. SPIRIT OF BRANDT3EN FARM 9"' ADDITION FEBRUARY 29, 2012 PAGE 4 OF 5 RESIDENTIAL BUFFER YARD REQUIREMENTS A buffer yard berm and landscaping screen was provided adjacent to 170 Street with previous Spirit of Brandtjen Farm improvements. A certified as -built grading plan of the buffer yard berm must be submitted and approved by City staff. A buffer yard berm and landscaping screen with a combined height of 10 feet will be provided adjacent to Diamond Path, as shown on the landscape plan. A certified as- built grading plan of the buffer yard berm must be submitted and approved by City staff prior to the installation of any buffer yard plantings. STORM SEWER Development of Spirit of Brandtjen Farm 9 Addition will not require new storm sewer construction. Storm sewer was installed with Spirit of Brandtjen Farm 7th Addition. Any draintile construction, including perimeter draintile required for building footings, which is deemed necessary during construction, shall be the Developer's responsibility to install and finance. The Trunk Storm Sewer Area Charge was paid with Spirit of Brandtjen Farm 7th Addition; therefore no Trunk Storm Sewer Area Charge shall be collected with Spirit of Brandtjen Farm 9 Addition. WETLANDS There are no existing wetlands within the Spirit of Brandtjen Farm 9 Addition site. TREE PRESERVATION There are no significant trees within the Spirit of Brandtjen Farm 9 Addition site. EROSION CONTROL As stated previously, Spirit of Brandtjen Farm 9th Addition was mass graded with Spirit of Brandtjen Farm 7 Addition improvements. The Developer shall maintain erosion control measures in accordance with the Spirit of Brandtjen Farm 7th Addition Development Contract and comply with the approved grading and erosion control plan. Homebuilders shall install and maintain erosion control measures as required with the individual building permits. SPIRIT OF BRANDT3EN FARM 9T" ADDITION FEBRUARY 29, 2012 PAGE 5 OF 5 SECURITIES The Developer provided a Letter of Credit as security for the Developer - installed improvements relating to Spirit of Brandtjen Farm 7th Addition. The Developer also posted a security to ensure that all property corners are installed. No additional security is required with Spirit of Brandtjen Farm 9th Addition as the Developer is not increasing the number of lots and the public improvements were previously constructed with Spirit of Brandtjen Farm 7 Addition. The Developer must submit a letter from the lending institution providing the letter of credit for Spirit of Brandtjen Farm 7 Addition stating that the letter of credit shall cover work done with the Spirit of Brandtjen Farm 9 Addition including the service pair abandonment. CASH FEES There are no additional cash requirements with the development of Spirit of Brandtjen Farm 9 Addition. The proposed plat is a re -plat to accommodate wider single family lots that were previously approved with Spirit of Brandtjen Farm 7th Addition. RECOMMENDATION Engineering recommends approval of the easement vacation, final plat, grading plan and utility plan for Spirit of Brandtjen Farm 9 Addition, subject to the comments within this report and the following: • Prior to release of the final plat mylars, the Developer must submit a letter from the lending institution providing the letter of credit for Spirit of Brandtjen Farm 7 Addition stating that the letter of credit shall cover work done with the Spirit of Brandtjen Farm 9 Addition.
