HomeMy WebLinkAboutItem 06.mMarch 28, 2012 Item No. APRIL 2, 2012 CITY COUNCIL MEETING KINGSLEY SHORES SENIOR LIVING FINAL PLAT EXTENSION Proposed Action Staff recommends adoption of the following motion: Move to approve a 100 day extension for recording the Kingsley Shores Senior Living final plat. Adoption of this motion will provide the development team with an additional 100 days to finalize the necessary details to allow the Kingsley Shores senior housing project to move forward. Overview Charthouse Senior Living representatives are requesting another 100 day extension for recording the Kingsley Shores Senior Living final plat. The City Council approved the Kingsley Shores Senior Living preliminary and final plat and related planning actions at their March 7, 2011 meeting. Chapter 10 -2 -3E of the City Code (the Subdivision Ordinance) requires that a final plat be recorded within 100 days of City Council approval. The City Council has approved 100 day extensions to record the Kingsley Shores Senior Living final plat at their June 6, September 19, and December 19, 2011 meetings. The final plat of Kingsley Shores Senior Living will expire on April 10, 2012 unless the City Council grants another extension. Kingsley Shores Senior Living is a 101 unit continuing care senior housing development to be located east of the Charthouse Restaurant on the north side of Klamath Trail, west of Kenwood Trail (CSAH 5). Planning Department staff recommends that the City Council grant another 100 day extension for recording the Kingsley Shores Senior Living final plat, to July 19, 2012. Primary Issues to Consider What are the implications if this final plat extension request is not granted? The Kingsley Shores Senior Living preliminary and final plat would become null and void requiring approval of a new preliminary and final plat. We are requesting the extension because we needed to find another operator for the facility, as our previously contracted operator withdrew from the project a week before our set closing date in December 2011. We have now engaged Silvercrest Properties to manage the property. We are hopeful to reach a closing on the project in mid -late April. If you have any other questions or need more information, please let me know. The last extension approved by the City Council extended the deadline for recording the final plat to April 10, 2012. There is a City Council meeting scheduled for April 2 In order to be on that agenda, I would need to receive another extension request from you by March 26 Please state the reason for the need for the extension. We will process another 100 day extension consistent with past practice and City Code.
