Overview CrossFit Templar, LLC has submitted an application for a conditional use permit for a commercial recreation facility in the 1-1, Light Industrial District at 21034 Heron Way, Suite 107. CrossFit Templar, LLC is an athletic company which is open to the public for general fitness, endurance, conditioning and specialized training. Suite 107 is approximately 3,000 square feet. 1,000 square feet will be dedicated to office, reception and break room uses. The remaining 2,000 square feet will be dedicated to equipment storage, exercise apparatus and twelve training stations as indicated on the attached floor plan. Classes are proposed to be held between 5:30 to 7:30 am and from 4:00 to 6:00 pm on Mondays, Wednesdays and Fridays and from 7:00 to 9:00 am on Saturdays. The facility will be closed on Tuesdays, Thursdays and Sundays. Suite 107 was previously granted a CUP in May 2005 for Party Bound, a commercial recreational party facility for children ages 3 to 10 years of age, which is no longer in operation. At their May 3, 2012 meeting the Planning Commission unanimously recommended approval of the CrossFit Templar, LLC conditional use permit subject to the 4 stipulations outlined in the April 26, 2012 planning report. Primary Issues to Consider Does and the proposed use meet all the requirements for issuing a conditional use permit? • The commercial recreational use has been reviewed according to Chapter 11- 86 -7.D and Chapter 11 -4 -7 of the Zoning Ordinance. The proposed CrossFit commercial recreational use meets the requirements for issuing a conditional use permit as outlined in the attached findings of fact. Permit. Subject to the terms and conditions set forth herein, the City of Lakeville approves: A conditional use permit to allow CrossFit Templar, LLC an indoor commercial recreation use in a multi- tenant building in the I -1, Limited Industrial District located at 21034 Heron Way. 2. Conditions: The permit is issued subject to the following conditions: A. The hours of operation must be limited to off -peak times when the parking demand of adjacent tenants is minimal. B. A building permit must be issued by the Inspections Department prior to any remodeling of the proposed tenant space. D. A sign permit must be granted by the City prior to the installation of any signage. 1 4. Termination of Permit. The City may revoke the permit following a public hearing for violation of the terms of the permit. 5. Lapse. If within one year from the issuance of this permit the conditional use permit has not been completed or the use commenced, this permit shall lapse. 6. Criminal Penalty. Violation of the terms of this conditional use permit is a criminal misdemeanor. Notary Public 2 City of Lakeville CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA CROSSFIT TEMPLAR, LLC CONDITIONAL USE PERMIT FINDINGS OF FACT On May 3, 2012, the Lakeville Planning Commission met at its regularly scheduled meeting to consider the application of CrossFit Templar, LLC for a conditional use permit to allow an indoor commercial recreation use in the 1 -1, Limited Industrial District. The Planning Commission conducted a public hearing on the proposed conditional use permit preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. The City Council hereby adopts the following: FINDINGS OF FACT 1. The property is zoned 1 -1, Limited Industrial District. 2. The property is located in District 8 and is guided for industrial development in the 2008 Comprehensive Land Use Plan Update. 3. The legal description of the property is: Lots 2 and 3, Block 1, Airlake Development Fourth Addition. 4. Chapter 11 -4 -3E of the Zoning Ordinance directs the Planning Commission to consider five (5) possible effects of the proposed use. The five (5) effects and our findings regarding them are: a) The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. The proposed commercial recreation use is consistent with the City Comprehensive Plan. b) The proposed use is or will be compatible with present and future land uses in the area. The proposed commercial recreation use will be compatible with the surrounding industrial uses provided it complies with the approved conditional use permit. 1 c) The proposed use conforms with all performance standards contained within the Zoning Ordinance. The proposed commercial recreation use will conform with the performance standards of the Zoning Ordinance provided it complies with the approved conditional use permit. d) The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. Mr. Flaherty explained that everyone is welcome, but his primary clients currently are adults 30 -40 years old. City of Lakeville Planning Department PROJECT ANALYSIS: Chapter 11- 86 -7.D of the Zoning Ordinance requires commercial recreational facilities to meet the following applicable provisions: 1. The architectural appearance and function plan of the building and the site shall be designed with a high standard of architectural and aesthetic compatibility with surrounding properties. Building materials, orientation, colors, height, roof design, lighting, signage and site landscaping shall be designed to complement the surrounding industrial properties and demonstrate potential industrial reuse. All sides of the principal and accessory structures are to have essentially the same or a coordinated, harmonious exterior finish treatment. • The existing building is compatible with surrounding properties as indicated on the attached building elevation plan. 2. A commercial recreational use shall not be located within a shared tenancy building containing a use classified as an "H" occupancy as defined by Minnesota state building code, as may be amended. • The existing building does not have a use classified as an "H" occupancy. No "H" occupancy businesses can move into the building as long as CrossFit Templar is located within the same building. 3. In multiple occupancy buildings, a material safety data sheet (MSDS) shall be required identifying all materials stored or used in the operation of the tenant businesses. Any change in building tenants shall require that the MSDS be updated and provided to all other tenants in the multitenant building. • Because the building is not classified as an "H" occupancy, this stipulation does not apply. 4. A commercial recreational use in a shared tenancy building shall have its own exterior entrance and exit. • Each tenant in the multiple occupancy building has its own exterior entrance and exit. 5. The site must be accessed via a collector street. Vehicular access points shall create a minimum of conflict with through traffic movement, shall comply with Chapter 19 of this title and shall be subject to the approval of the city engineer. • Heron Way accesses Lakeville Boulevard, which is a major collector. Vehicular access points were approved by the City Engineer as part of the site plan review for this multiple tenant industrial building. 2 Chapter 11 -4 -7 of the Zoning Ordinance also requires conditional uses to meet the following applicable provision: Access and Parking: The site design for access and parking shall minimize internal as well as external traffic conflicts and shall be in compliance with Chapter 19 of the Zoning Ordinance. • No changes are proposed for access to the site. Vehicle circulation and access will function as previously designed. • The hours of operation for the CrossFit facility are proposed to be from 5:30 to 7:30 am and from 4:00 to 6:00 pm on Mondays, Wednesdays and Fridays and Saturdays from 7:00 to 9:00 am. Hours of operation are generally off -peak times when the parking demand of adjacent tenants is minimal. • The zoning ordinance requires one space per exercise station and one space per employee. The applicant is proposing 10 workout stations and two employees for a total of 12 parking spaces required. The Party Bound facility that previously occupied this space as a conditional use also required 12 parking spaces. RECOMMENDATION: The proposed conditional use permit meets the provisions of the Zoning Ordinance as outlined above and as indicated in the attached findings of fact. Staff recommends approval of the conditional use permit for a commercial recreational facility in the 1 -1, Light Industrial District contingent on the following stipulations: 1. The hours of operation must be limited to off -peak times when the parking demand of adjacent tenants is minimal. 2. I would like to take this opportunity to tell you who we are, what we do and describe our proposed inten- tions in more detail. CrossFit Templar, LLC (formerly CrossFit NorthStar, LLC) was founded in September 2009. CrossFit Templar (CFT) is an affiliate of CrossFit HQ based in Santa Cruz, CA. At CFT our primary focus is to train athletes in general physical preparedness utilizing constantly varied functional movements executed at a high intensity. Currently, we have a 3,000 sq. ft. training facility in neighboring Apple Valley. CFT has experienced steady growth since first opening its doors in November 2009. We have approximately 100 athletes of various backgrounds and physical abilities training at our Apple Valley facility. Since January 2012 we have experienced a 33% growth which is a testament to the growing popularity of the CrossFit method- ology. We have enjoyed great success in Apple Valley and would like to expand our business to Lakeville. We have a large number of athletes who come from Lakeville, Farmington and the New Market/Elko area. An additional Lakeville facility would be convenient for many current athletes and give us an opportunity to grow our business. Site Plan: Suite 107 is approximately 3,000 sq. ft. 1,000 sq. ft. are dedicated to office space and 2,000 sq. ft. are dedicated to warehouse space. CFT intends to use the 1,000 sq. ft. office space as a reception/break area and private office. The warehouse is approximately 2,000 sq. ft. of which 500 sq. ft. will be dedicated to equip- ment storage and exercise apparatus. The remaining 1,500 sq. ft. will be dedicated to an exercise area (see site plan). Occupancy: The 1,500 sq. ft. exercise area will be divided up into ten individual exercise stations which will ac- commodate ten athletes at one time. Each individual exercise station will be approximately 12' x 12'. Our cur- rent location in Apple Valley is of similar dimensions to suite 107. We have found that the 12' x 12' is a suitable amount of space for our athletes to execute olympic weightlifting and gymnastic exercises safely (see individual fitness station schematic). Class Schedule: CFT's class schedule will be M, W and F, 0530 -0630, 0630 -0730, 1600 -1700, 1700 -1800. We will have two classes on Saturday at 0700 -0800 and 0800 -0900. Tuesdays, Thursdays and Sundays the facility will be closed for maintenance. Parking: Our facility in Apple Valley is very similar to the Lakeville site in regard to parking space. A majority of the classes are during off-peak hours so parking is never an issue and has very little impact on the adjacent businesses.
