HomeMy WebLinkAboutItem 08SCHEDULE A PUBLIC HEARING TO CONSIDER THE CREATION OF A HOUSING IMPROVEMENT AREA May 21, 2012 City Council Meeting Proposed Action Staff recommends adoption of the following motion: Move to adopt the attached resolution scheduling a public hearing for June 18 to consider adoption of an ordinance creating a Housing Improvement Area for Niakwa Village II. Passage of this motion will result in the City Council conducting a public hearing on June 18 to hear from property owners within Niakwa Village II regarding the creation of a Housing Improvement Area (HIA) to finance exterior improvements in this townhome development. Overview Item No. Minnesota Statutes 428A authorizes cities to create HIA(s) to assist in the financing of exterior improvements to privately -owned residential units that are the responsibility of the homeowners association. The City Council discussed the concept of HIA(s) at a City Council Work Session last August and adopted the attached policy on September 6, 2011. The City has received a formal petition requesting the creation of a HIA from the Niakwa Village II Homeowners Association. Petitions were signed by 32 of the 52 owners of units in the association which is 62% of the owners. Minnesota Statutes require a minimum of 25% of the owners sign petitions in order to consider the creation of HIA. The current estimated costs for exterior improvements are estimated not to exceed $697,000. The improvements are proposed to be financed by the Dakota County CDA and will be repaid by individual owners over no more than a 15 year period with interest. The homeowners association is proposing to contribute $100,000 up front to the project. Notices will be sent to all of the property owners in Niakwa Village II at least 10 days prior to the public hearing. Staff recommends approval of the attached resolution scheduling the public hearing. Primary Issues to Consider • What is the cost for the City to approve a proposed HIA? All of the costs associated with creating and implementing a HIA will be borne by the property owners. Olson Community and Economic Development Director c: Deborah Haugh, Dakota County CDA, Carin Rosengren, Keller Property Management Financial Impact: $ None Budgeted: Y/N Source: CITY OF LAKEVILLE RESOLUTION No. RESOLUTION CALLING A PUBLIC HEARING TO CONSIDER ADOPTION OF AN ORDINANCE CREATING A HOUSING IMPROVEMENT AREA WITHIN NIAKWA VILLAGE 2 ADDITION WHEREAS, the City of Lakeville ( "City)" is authorized under Minnesota Statutes, Sections 428A.11 to 428A.21 (the "Housing Improvement Act ") to establish by ordinance a housing improvement area within which housing improvements are made or constructed and the costs of the improvements are paid in whole or in part from fees imposed with in the area; and WHEREAS, Minn. Stat, 428A.12 requires that owners of 50 percent or more of the owners of the housing units that would be subject to fees in the proposed housing improvement area file a petition requesting a public hearing on the proposed action; and WHEREAS, the City has received a signed petitions from 62 percent of the owners in Niakwa Village 2nd Addition requesting a public hearing to consider the creation of a housing improvement area. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakeville: 1. A public hearing shall be held on the 18 day of June, 2012 at the Lakeville Council Chambers, 20195 Holyoke Avenue, at 7:00 p.m. to consider adopting an ordinance to establish a housing improvement area for Niakwa Village 2 Addition in order to facilitate certain improvements to property within Niakwa Village 2 " Addition in accordance with the Housing Improvement Act. 2. The City Clerk is hereby directed to cause a notice of the hearing to be published once in the official newspaper of the City at least seven (7) days prior to the hearing. The City Clerk shall also cause mailed notice to be given to the owner of each housing unit within the proposed area not Tess than ten (10) days prior to the hearing. APPROVED this day of , 2012. Sixty (60) percent of homeowners signed the petition asking for the HIA to go forward. Six (6) percent said they disagreed with having an HIA. Thirty -four (34) percent were contacted and did not reply, neither signing a petition nor voicing disapproval. These percentages represent all 52 units at Niakwa Village 2 where four properties are bank -owned and /or in foreclosure. Thank you for your continued efforts on behalf of this Lakeville association. I look forward to hearing from you on how the association may best proceed, including a presence at a future meeting of the Lakeville City Council.
