HomeMy WebLinkAboutItem 07May 29, 2012 e Item No. PUBLIC HEARING ON THE APPLICATION OF SPICE THAI LLC FOR A WINE AND ON -SALE 3.2% MALT LIQUOR LICENSE Proposed Action Staff recommends adoption of the following motion: Motion to grant a wine and on -sale 3.2% malt liquor license to Spice Thai LLC. Overview In accordance with section 3 -1 -6 -2 of the Lakeville City Code, the City Council will conduct a public hearing on the application of Spice Thai LLC for a wine and on -sale 3.2% malt liquor license at Spice Cafe. The restaurant is located in the Lakeville Crossing Shopping Center at 7704 — 160 Street West (formerly Ronin Caf6). Mayor Bellows will open the public hearing and ask the City Clerk to attest that notice of the hearing was duly published in the City's legal newspaper. Sergeant John Kornmann will present the Police Department's report on the liquor license application. The applicant, Chad Sukhtipyaroge, will be present to answer any questions the Council may have. Mayor Bellows will then open the hearing to questions and comments from members of the audience. After all public comments are heard, the City Council should move to close the public hearing. The Police Department has reviewed the application and completed background investigations on the applicant. The Police Department has no concerns related to the issuance of the licenses, effective July 1, 2012. Approval is recommended. John Kornmann Applicant: Sukhtipyaroge, Chad Apichat License Applied For: 3.2 Malt Liquor, Wine On -Sale Date: May 29, 2012 Background Investigation Process The responsible person listed on the wine and 3.2 beer license application was either an officer or a manager of the business and required to complete a part II application, which includes personal information and character references. On May 29, 2012, I was assigned to the liquor license background check of Chad Apichat Sukhtipyaroge. The following automated databases were checked to conduct this background; DVS, MNCIS, in -house records, criminal history files, and Crimnet. I contacted personal references listed. City Attornev Advice Not consulted as a result of this investigation. Conclusion The applicant has operated a restaurant with the same business plan in the City of Savage since 2003. During that time, zero complaints were received regarding this business. The applicant has no traffic or criminal history. The Lakeville Police Department has no reservations as to the approval of this wine and 3.2 beer license application.
