May 30, 2012 Item No. ENTER INTO WRITTEN AGREEMENT TO PURCHASE K -9 PATROL DOG WITH CANAM TACTICAL Proposed Action Staff recommends adoption of the following motion: To enter into a written agreement with CanAm Tactical in the amount of $10,000 for the purchase of a trained patrol dog and training of handler. Overview K -9 Shadow has continued health issues. A fully trained one - year -old patrol dog from a reputable dog trainer was found. The higher cost of a fully trained dog will be offset by reduced training time for the handler. The K -9 officer and partner will resume patrol duties within 3 to 5 weeks instead of 16 to 20 for standard K -9 training. This purchase was planned for 2013. Due to escrow funds being used, purchase will be made in 2012 without negative impacts on existing operating budget. IN CONSIDERATION OF THE MUTUAL COVENANTS AND AGREEMENTS HEREIN, IT IS MUTUALLY AGREED BY SELLER AND BUYER AS FOLLOWS: I. SALE AND PURCHASE OF DOG. On or about September 1, 2012 the Seller will have available for purchase at least four (4) one year old Belgian Malinois dogs. The Buyer will have the third choice from among the available dogs. if a customer with a higher selection priority fails to make a selection or purchase a dog, the Buyer's priority will be moved up. The dogs will be available for inspection at a mutually agreeable location. After inspecting the dogs, Buyer may purchase one of the available dogs in accordance with the terms and conditions of this Agreement or decline to purchase. 2. PAYMENT. If the Buyer purchases a dog, the Buyer will pay Seller $7,500 for the dog and $2,500 for the K9 Handler courses described in the attached Exhibit "A." Payment for the dog and payment for the K9 Handler courses shall be made within thirty (30) days after the courses have been completed. If the Buyer elects not to purchase a dog, the Buyer shall pay the Seller $1,000 unless the Seller did not have available for purchase at least four (4) one year old Belgian Malinois dogs. 3. K9 HANDLER COURSES. Seller will provide a one week police dog training course in Winnipeg, MP Canada and a three week police dog training course in Brooklyn Park 16394205 R NKAS722l2012 Minnesota. Descriptions of the training courses are described in the attached Exhibit ` A" tivdrich is incorporated herein. If a dog is replaced, the Seiler will provide another training course free of charge unless the handler is new. 4. GENETIC HEALTH GUARANTEE. Seller guarantees its dogs to be free of any genetic problems that would impair the working ability of the dog. The dog shall be in good health at the time of delivery. The Buyer will have seven (7) days, from the date of delivery to have the dog examined by a veterinarian of Buyer's choice. If the dog has any health problems Seller will replace the dog with a dog acceptable to Buyer, or at Buyer's option refund to Buyer the purchase price of the dog. If the dog develops any genetic medical problems within twelve (12) months after the Buyer has purchased the dog, the dog will be replaced at no charge with a dog acceptable to Buyer and fitee attendance at another school unless there is a different handler, or at the Buyer's option the purchase price of the dog will be refunded to Buyer. Seller reserves the right to have its veterinarian examine the dog and review all medical records from Buyer's veterinarian before any dog will be replaced. There will be no replacement of a dog that has a condition caused by neglect or improper health maintenance from the Buyer. There will be no replacement of any dog without first returning the original dog. All shipping/transport costs will be at the expense of the Buyer. Injuries sustained after the delivery date including teeth or mouth related problems are not covered under the guarantee. Specifically, damage to teeth while in Buyer's possession during the guaranteed period is not covered and is Buyer's responsibility. The Genetic Health Guarantee is still valid, however, for broken or damaged teeth if proper veterinarian care was provided. No returns on a dog will be accepted with broken or damaged teeth and must receive proper veterinarian care to have broken or damaged teeth, fixed prior to any dog being returned for a genetic or performance problem. Any 163942vo5 RNK:r6512212012 broken bones voids all warranties/guarantee on the dog as well and no returns will be accepted under any circumstances. 5. KIPS AND ELBOW DYSPLASIA. The dog's hips and elbows are guaranteed to be sound at twenty-four (24) months of age. The Buyer has one month, if the Buyer elects to do so; from the twenty -four (24) month birthday to get X -rays of hips and elbows at Buyer's expense. If it is determined the dog has hip or elbow dysplasia at that time, Seller reserves the right to have Seller's veterinarian review the X-rays. If it is determined the dog does have hip or elbow dysplasia, Seller will replace the dog with a -dog acceptable to Buyer and free attendance at another school' unless there is a different handler or at Buyer's option refund to Buyer the purchase price of the dog. 6. PERFORMANCE GUARANTEE. If the dog fails to satisfactorily complete the K9 training courses, Seller will replace the dog with a dog acceptable to Buyer at no cost to Buyer and allow the Buyer's handler to retake the K9 training courses or at Buyer's option refund to Buyer the purchase price of the dog and the cost of the K9 handling courses. Buyer will not be charged for the handler's course if it is the same handler that previously went through the course. There will be a fee for the course if it is a new handler that has not been through Seller's course. Proper emergency first aid for injuries sustained by K9 will be discussed. Proper ways to enhance the bonding between handler /K9 will be discussed. With the goal of building a trusting relationship between the handler /K9. Obedience: proper obedience will be discussed and performed on a daily basis with obedience being the foundation for all training with a K9. Obedience will be broken down into obedience that is important for the certifications and also for obedience that is applicable to situations that will be encountered out on the street. K9's will be trained on agility equipment that is used in the USPCA certifications and also that will challenge the K9's and prepare them for scenarios they will face in real life situations. K9's will be trained to locate and retrieve articles of evidence through the "force fetch" method. Tracking: Discussion will be on how a K9's nose works and locates human scent for tracking and evidence recovery. It will also be discussed how the outside influences can limit how successful this scent work will be. Tracking: This is going to be the primary focus of the training. The K9/handler will run several tracks each day. These tracks will be up to a mile long. They will involve real life scenarios that the K9 team may have to deal with when they are out on patrol. These tracks will be done on multiple different types of surfaces including, grass, asphalt and dirt. They will be conducted in rural areas and also in the inner city. Handlers will also discuss the use of a perimeter to assist in locating suspects during a track of area search. The K9's will be exposed to being deployed directly from the squad. This will include the use of the bail out to assist the handler in a handler protection situation and also deploying the K9 on high risk stops. Training will also be conducted primarily for the handler in the use of cover officers during high risk tracks and building searches. The primary focus of this will be officer safety and using them to enhance the search. Building searches will be conducted both on lead and off lead. The K9's will be taught to distance themselves from the handler during these building and open area searches that are conducted off lead. In a limited basis training will be conducted on the specific tasks to certify at a USPCA PDI Certification. These tasks include obedience, agility equipment, evidence recovery, suspect search and apprehension with and without gunfire. Discussion and training will take place on the specific case law that relates to the deployment of K9's. All of this training including the real life scenarios will take place during the day and evening hours.
