HomeMy WebLinkAboutItem 09May 30, 2012 Item No. JUNE 4, 2012 CITY COUNCIL MEETING ZONING ORDINANCE AMENDMENT CONCERNING TOWNHOUSE STANDARDS Proposed Action Staff recommends adoption of the following motion: Move to approve an amendment to the Zoning Ordinance concerning design and construction standards in the RST -2, RM -1 and RM -2 districts. Passage of this motion will allow the use of cement fiberboard composite siding material in place of brick, stone or stucco on the exterior facades of a townhouse building that are not considered the front. Overview On April 19, 2012 the Planning Commission held a work session to consider additional possible amendments to the Zoning Ordinance to address comments and concerns raised as part of last year's development forum process. Amendments to the Zoning Ordinance to address development forum comments were approved by the City Council on January 3 and February 21, 2012. One of the developer requested ordinance changes reviewed by the Planning Commission at their April 19 work session involves the allowance of cement fiberboard type materials in place of brick, stucco or stone on the exterior walls of a townhouse building not considered the front. The Planning Commission agreed that cement fiberboard type products meet the durability intent of the townhouse exterior materials standards and will provide builders with more flexibility in the design and construction of townhouses in Lakeville. The Planning Commission held a public hearing on the Zoning Ordinance amendment at their May 24, 2012 meeting and unanimously recommended approval. There was no public comment. Planning Department staff recommends approval of the Zoning Ordinance amendment. Primary Issues to Consider • What effect will the ordinance amendment have on townhouse developments in Lakeville? The Zoning Ordinance amendment will allow the use of cement fiberboard type products on any side of a townhouse building not considered the front. He wanted to thank the Commissioners for all their support over the years. Mr. Licht stated that since the 2010 update of the Zoning and Subdivision Ordinances were adopted by the City Council, City staff has identified sections of the Zoning Ordinance that need to be revised to clarify the intent of the regulations. In addition, the City has received input from other stakeholders including developers, brokers and property: `owners as part of the development forum process. In the subsequent months, City staff has identified sections of the Zoning Ordinance that need to be revised to clarify the intent of the regulations. The City has received input from other stakeholders including developers, brokers and property owners requesting clarification of specific sections of the Zoning Ordinance or Subdivision Ordinance. The City also held a Development Forum, conducted a Development Survey and held meetings with developers and businesses that garnered additional feedback as to possible modifications of the City's development regulations to streamline the review process and make these regulations more user friendly. The Planning Commission reviewed a list of possible amendments to the Zoning Ordinance and Subdivision Ordinance at their 17 November 2011 work session. The Planning Commission most recently held a work session on 19 April 2012 to consider information on Part 3 of the proposed modifications of the Zoning Ordinance and Subdivision Ordinance, which address primarily policy issues related to development standards the City requires of various subdivisions and land use types. One area discussed at this work session was exterior material requirements for detached and attached townhouse uses in the RST -2, RM -1 and RM -2 Zoning District. Within this subject, specific discussion focused on the requirement for a minimum 25 percent brick, stone or stucco on each exterior facade. In an effort to address these concerns as quickly as possible due to their effect on on -going projects, City staff has taken the comments of the Planning Commission and input from the developers present at the work shop an drafted a proposed amendment of the Zoning Ordinance. ANALYSIS Detached and attached townhouse uses are subject to the following exterior building material requirements within the RST -2, RM -1 and RM -2 Districts: 4. Exterior Dwelling exterior dwelling Building Finish, Detached Townhome And Two - Family Dwelling Units: The of detached townhome and two - family units shall include a variation in building materials which are to be distributed throughout the building facades and coordinated into the architectural design of the structure to create an architecturally balanced appearance. In addition, detached townhome and two - family dwelling structures shall comply with the following requirements: a. A minimum of twenty five percent (25 %) of the area of each building facade of a structure shall have an exterior finish of brick, stucco and /or natural or artificial stone. b. Except for brick, stucco, and /or natural or artificial stone, no single building facade shall have more than seventy five percent (75 %) of one type of exterior finish. c. Except for brick, stucco, and /or natural or artificial stone, no townhome dwelling structure shall have more than sixty percent (60 %) of all building facades of one type of exterior finish. d. For the purpose of this section: (1) The area of the building facade shall not include area devoted to windows, entrance doors, garage doors, or roof areas. 2 (2) Variations in texture or style (i.e., lap siding versus shake shingle siding) shall be considered as different materials meeting the requirements of this section. (3) Integral colored split face concrete block or cement shall qualify for meeting stucco and /or natural or (rock face) fiberboard the brick, artificial stone exterior material requirements for any facade of a building not facing a private drive or public right of way. If these materials are used to meet the brick, stucco and /or natural or artificial stone exterior material requirement for the other facades, the material shall extend the full width of the foundation adjacent at ground level. The requirement for use of brick, stone or stucco on each wall of the structure was adopted for two reasons. The first was to provide a durable, weather resistant material at the base of the structure that would resist damage from landscape maintenance. The second reason for the requirement is to promote the use of high quality materials and a variety of materials on each facade of a building for aesthetic reasons. As part of the initial development forum and subsequent meetings with City staff, residential developers and builders as for consideration to allow use of cement fiberboard type materials in place of brick, stone or stucco on those exterior walls of a townhouse building that are not the front. The consensus of the Planning Commission at the work session on 19 April 2012 was that the use of cement fiberboard type materials would be appropriate in terms of durability provided that the anti - monotony intent of the current standards can be maintained. City staff drafted the attached Zoning Ordinance amendment based on the discussion at the 19 April 2012 work session to: • Allow the use of the cement fiberboard material on an exterior facade that faces a public street or private driveway or interior facade in place of brick, stone or stucco other than on the "front" of the building. • Require that the cement fiberboard, when used in place of brick, stone or stucco, be used for at least 60 percent of the area of that wall. The remaining 40 percent of the exterior facade may utilize different exterior material types or textures to address monotonous appearance issues. 3 CONCLUSION The Planning Commission will consider the proposed Zoning Ordinance amendment expanding the opportunity to use of cement fiberboard materials on the exterior of detached and attached townhouse buildings at a public hearing on 24 May 2012. City staff and our office recommend approval of the proposed amendment in the form attached hereto. 4 ORDINANCE NO.
