Present: Mayor Mark Bellows Council Member Matt Little Council Member Colleen LaBeau Council Member Laurie Rieb Council Member Kerrin Swecker Also Present: Roger Knutson, City Attorney Steve Mielke, City Administrator Tom Vonhof, Police Chief David Olson, Community & Economic Development Director Chris Petree, Public Works Director Dennis Feller, Finance Director Steve Michaud, Parks & Recreation Director Charlene Friedges, City Clerk Citizens' Comments None Presentations /Introductions Mayor Bellows administered the Oath of Office to Police Officer Anna Limbeck. Wally Potter presented the Lakeville Area Historical Society 2011 Annual Report. Steve Michaud presented the April monthly report of the Parks & Recreation Department. Chief Vonhof presented the March /April Police Department monthly report. Consent Agenda 12.34 Motion was made by LaBeau, seconded by Rieb to approve the consent agenda items as follows: a. Resolution No. 12 -47 approving a Joint Powers Agreement with the State of Minnesota for access to the Minnesota Criminal Justice Data Communications Network. d. Tree work licenses for Custom Cut and Arbor & Home Specialists. e. Resolution No. 12 -48 accepting donations to the Heritage Center. f. Temporary on -sale 3.2% malt liquor license for the Lakeville Lions Beer, Brats & Bingo event. g. Resolution No. 12 -49 accepting donations for the annual watershed clean -up day. h. Resolution No. 12 -50 awarding contract for Improvement Project 12 -02. i. Resolution No. 12 -51 approving the final plat of Bellante Fourth Addition. j. Resolution No. 12 -52 approving the Tullamore 1 St Addition final plat; and Resolution No. 12 -53 vacating easements. k. Findings of fact and a conditional use permit to allow a commercial recreation use for Cross Fit Templar LLC at 21034 Heron Way. I. Findings of fact and a conditional use permit to allow an accessory day care use for Four Square Preschool and Day Care at Crossroads Methodist Church, located at 17671 Glacier Way. m. Findings of fact and a conditional use permit amendment to allow more than one principal building on a commercial lot at Belzer Chevrolet, Dodge, Kia, located at 21 111 Cedar Avenue. Roll call was taken on the motion. Ayes, unanimous. Item 7 On behalf of the Jensen family, Mr. Michaud asked the City Council to consider the induction of Robert "Bob" Jensen as a Lakeville Pioneer at Pioneer Plaza. Mr. Michaud highlighted the accomplishments of Robert Jensen, who was a Lakeville resident for 64 years and held public office at the township, village, CITY OF LAKEVILLE COUNCIL MEETING MINUTES MAY 21, 2012 Page 3 city, county and state levels. He was also a member of many local civic organizations. Mr. Jensen's daughter, Sarah Matasosky, spoke about her father's lifelong commitment to Lakeville. She thanked the City Council for developing a Pioneer Plaza induction tradition. 12.35 Motion by LaBeau, seconded by Swecker to approve Resolution No. 12 -54 authorizing the induction of Robert "Bob" Jensen as a Lakeville pioneer to be honored at Lakeville Pioneer Plaza. Roll call was taken on the motion. Ayes, unanimous. Item 8 Mr. Olson recommended council approval of a resolution setting a public hearing on the adoption of an ordinance creating a housing improvement area to finance exterior improvements in Niakwa Village 2nd Addition. He stated a formal petition has been submitted by the Niakwa Village II Homeowners Association, representing 62% of the owners. The estimated cost is not to exceed $697,000. Improvements would be financed by the Dakota County Community Development Agency and will be repaid by individual owners over no more than a 15 -year period, with interest. The Niakwa Village II Homeowners Association is proposing to contribute $100,000 up front to the project. 12.36 Motion was made by Swecker, seconded by Little to approve Resolution No. 12 -55 calling a public hearing to consider adoption of an ordinance creating a housing improvement area within Niakwa Village 2nd Addition. Roll call was taken on the motion. Ayes, unanimous. Item 9 Mr. Olson presented the request of Lakeville Grill, Inc. for a liquor license amendment to include an outdoor patio at Babe's Sportsbar & Grill, 20685 Holyoke Avenue. He explained that the patio would be located just north of the east entrance to the building and will only be accessible from inside the building. While the addition of a patio will eliminate seven parking stalls, the property will continue to exceed the zoning ordinance requirement for parking in the Central Business District. The Metropolitan Council Environmental Services has determined that additional SAC units will not need to be paid. As required CITY OF LAKEVILLE COUNCIL MEETING MINUTES MAY 21, 2012 Page 4 by City ordinance, due to its proximity to a residential area, no food, liquor or music is allowed on the patio after 10:00 p.m. 12.37 Motion was made by Rieb, seconded by LaBeau to approve a liquor license amendment to Lakeville Grill, Inc. to allow an outdoor patio at Babe's Sportsbar & Grill, located at 20685 Holyoke Avenue. Roll call was taken on the motion. Ayes, unanimous.
