June 14, 2012 Item No. JUNE 18, 2012 CITY COUNCIL MEETING NATIONAL POLYMERS CONDITIONAL USE PERMIT Proposed Action Staff recommends adoption of the following motion: Move to approve a conditional use permit for National Polymers and adopt the findings of fact as presented. Adoption of this motion will result in the construction of six storage silos exceeding 45 feet in height on property located at 7920 — 215 Street. Overview National Polymers KW Holdings, LLC, (d /b /a National Polymers) has submitted an application for a conditional use permit to allow the construction of six storage silos on property located at 7920 — 215 Street. The proposed silos would be at a height of 68 feet. The property is zoned I -2, General Industrial District which allows a building height of 45 feet unless a conditional use permit is approved to exceed that height. National Polymers is a plastics manufacturer that has operated at this location in Airlake Industrial Park since 1973. The Planning Commission held a public hearing at their June 7, 2012 meeting and recommended unanimous approval. There was no public comment at the public hearing. Staff also recommends approval of the conditional use permit. Primary Issues to Consider What, if any, impact is there to properties in the area? The requested silo height of 68 feet is consistent with the height of other similar storage silo structures approved in the area of Airlake Industrial Park. Due to the routine nature of storage silo height requests, the Planning Commission recommended that consideration be given to allowing them by administrative permit. This will be discussed in more detail at a future Planning Commission work session. Permit. Subject to the terms and conditions set forth herein, the City of Lakeville approves a Conditional Use Permit for KW Holdings (dba National Polymers to allow a building height for the construction of six storage silos greater than 45 feet in height in the I -2, General Industrial District. 2. Property. The permit is for the following described property located at 7920 — 215 Street in the City of Lakeville, Dakota County, Minnesota: Lots 10 and 11, Block 2, AIRLAKE INDUTRIAL PARK 1 ADDITION, according to the recorded plat thereof, Dakota County, Minnesota. 3. Conditions. The permit is issued subject to the following conditions: a) The silos shall be constructed in the location shown on the approved site plan. b) The silos shall not exceed 68 feet in height. c) Authorization from the FAA and MAC for the proposed silos is required prior to a building permit being issued for the silos. d) The crane used to install the silos shall not exceed the height authorized by the FAA and MAC. 1 e) The silos shall be painted white or a color that is compatible with the principal building. f) Building permits are required prior to commencing construction of footings or the installation of the silos. g) The site plan modifications and buildings additions shall not commence prior to the issuance of a building permit. 4. Termination of Permit. The City may revoke the permit following a public hearing for violation of the terms of the permit. 5. Lapse. If within one year from the issuance of this permit the conditional use has not been completed or the use commenced, this permit shall lapse. 6. Criminal Penalty. Violation of the terms of this conditional use permit is a criminal misdemeanor. The Planning Commission conducted a public hearing on the proposed conditional use permit preceded by published and mailed notice. The applicant was present and the Planning Commission heard testimony from all interested persons wishing to speak. The City Council hereby adopts the following: FINDINGS OF FACT 1. The property is currently zoned I -2, General Industrial District. 2. The property is located in Planning District No. 8 of the 2008 Comprehensive Plan, which guides the property for industrial land use. 3. The legal description of the property is: Lots 10 and 11, Block 2, Airlake Industrial Park 1 Addition 4. Section 11 -4 -3E of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria and satisfied. The criteria and our findings regarding them are: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. The existing industrial use and the six proposed storage silos are consistent with the 1-2, General Industrial District and Industrial designated land use for the property. 1 b. The proposed use is or will be compatible with present and future land uses of the area. The six proposed storage silos will be compatible with existing and future land uses in the area. c. The proposed use conforms with all performance standards contained in the Zoning Ordinance. Provided compliance with the stipulations of the conditional use permit, the six proposed storage silos will conform with the performance standards contained in the Zoning Ordinance. d. The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. The subject property lies within the existing MUSA. The property is served with city sanitary sewer and city water. The existing industrial development and the silos will not overburden the City's service capacity. e. Traffic generation by the proposed use is within capabilities of streets serving the property. ITEM 3. APPROVAL OF MEETING MINUTE The May 24, 2012 Planning Commission meeting minutes were approved as presented. ITEM 4. ANNOUNCEMENTS: Commissioner'Grenz wanted to clarify the reason for his nay vote under Agenda Item 6 of the May 24, 2012` Planning, Commission meeting minutes. Commissioner Grenz felt the - Iplanning report was_ well'' written, but his conscious would not let him vote for the park dedication amendment. There were t announcements at tonight's meeting. ITEM 5. NATIONAL POLYMERS Chair Lillehei opened the public hearing to consider the application of APPRO Development on behalf of KW Holdings, LLC (dba National Polymers) for a Conditional Use Permit to allow building (storage silo) height greater than 45 feet in the I -2, General Industrial District, located at 7920 215th Street. The Recording Secretary attested that the legal notice had been duly published in accordance with State Statutes and City Code. Jim Connelly, Project Manager for APPRO Development, presented an overview of the request. Mr. Connelly indicated that the conditional use permit is for the height of the proposed silos. He stated that the silos are very similar in construction and height with other silos that have recently been approved by the City for businesses in the Airlake Industrial Park. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey stated that the application is for a conditional use permit (CUP) to allow the construction of six silos, each with a height of 68 feet. He indicated that a CUPAsu required for buildings that are taller than 45 feet in height in the I -2 District. He stated that authorizati froin..the FAA and MAC is required prior to a building permit being issued for the silos. Mr. Dempsey indicated that an office addition On the north side of the' existing building and a warehouse addition on the south side' of the existing building are also being proposed but they will be reviewed administratively as part of the building permit site plan review. It was determined that the possibility.lof allowing storage silos in excess of building height requirements by administrative permit in the industrial districts should be added to the list of Phase 3 Zoning Ordinance amendment discussion items for the Planning Commission's next work session. • Commissioner Grenz confirmed that the proposed building additions will meet the parking requirements of the Zoning Ordinance. 12.39 Motion was made and seconded to recommend to City Council approval of the National Polymers conditional use permit to allow building (storage silo) height greater than 45 feet in the 1 -2, General Industrial District, located at 7920 215th Street, subject to the following 7 stipulations: 1. The proposed silos would be at a height of 68 feet. National Polymers is a plastics manufacturer that has operated at this location since 1973. Currently, the plastic resin pellets arrive by rail car and are then transferred into the manufacturing area of the building as needed. The proposed storage silos will allow the resin pellets to be loaded directly into the silos for storage on site. The existing building totals 70,429 square feet and includes warehouse, manufacturing and office areas. A 1,306 office addition is proposed on the north side of the building and a 31,388 square foot warehouse addition is proposed on the south side of the existing building. These additions will bring the total building area to 103,123 square feet. The warehouse and office additions and corresponding parking lot expansion will be reviewed and approved administratively as part of the building permit site plan review. The proposed additions do not include any requests for zoning approval that would require Planning Commission consideration or City Council approval other than the conditional use permit for the height of the storage silos. The subject property is 2.52 acres in area platted as Lots 10 and 11, Block 2, Airlake Industrial Park 1 Addition in 1970 and consists of a 70,429 square foot manufacturing, warehouse and office building constructed in 1973 as well as a paved parking lot. A rail spur is located on the west side of the building. Building Height Criteria. Section 11 -17 -7E of the Zoning Ordinance allows buildings to exceed the height limitations established within the individual zoning districts through a conditional use permit provided that: 1. The site is capable of accommodating the increased intensity of use. The property is capable of accommodating the proposed six, 68 foot tall storage silos. 2. The increased intensity of use does not cause an increase in traffic volumes beyond the capacity of the surrounding streets. The six storage silos will be filled directly from rail cars on the west side of the building. There will be no trucks making deliveries of the polymer resin pellets The six proposed storage silos will not increase traffic volumes beyond what can be accommodated by the surrounding streets. 3. Public utilities and services are adequate. Public utilities are in place to accommodate the six proposed storage silos. 2 4. For each additional story over three (3) stories or for each additional ten feet (10') above thirty five feet (35'), front and side yard setback requirements shall be increased by five feet (5'). The minimum building setback requirements in the 1-2, General Industrial District are as follows: Front — 40 feet Sides —10 feet Rear — 30 feet The minimum rear (west side) yard setback for the silos is 26.5 feet. The proposed silos will be set back 27 feet from the west side property line meeting the additional setback requirement. The six silos will be 12 feet in width. The silos will be painted white as shown on Exhibit F. 5. The increased height is not in conflict with airport zoning regulations as provided in chapter 36 of this title. The applicant has submitted the information for the silo and temporary construction crane to the Federal Aviation Administration for their review and approval of the proposed heights of the structures. Staff has submitted the public hearing notice and plan information to the Metropolitan Airports Commission for their review. Authorization from the FAA and MAC will be required prior a building permit being issued for the silos. 6. The performance standards and criteria of chapter 4 of this title are considered and satisfied. The eave height of the silos is 63 feet this coupled with the perimeter guardrail and piping the makes the silo no more than 68' -0" in height. The silos are setback from the west property Iine 27 feet slightly more than the required setback of 26' -6 ". These silos are being proposed along with a building expansion to the south (warehouse area) and a small expansion to the north side of the existing building (office area).
