PUBLIC HEARING ON THE APPLICATION OF BALDY'S BBQ CORP.
FOR AN ON -SALE WINE LICENSE
Proposed Action
The Police Department recommends the following motion: Move to grant an on -sale
wine license for Baldy's BBQ Corp.
Overview
In accordance with Title 3 -1 -6 -2 of the Lakeville City Code, the City Council will conduct
a public hearing on the application of Baldy's BBQ Corp. for an on -sale wine license.
Baldy's BBQ currently has an on -sale 3.2% malt liquor license.
On October 19, 2009, the City Council adopted Findings of Fact and Decision denying a
wine and 3.2% malt liquor license due to past disclosed and undisclosed criminal
history on the applicants. That document stated that the applicant can reapply for the
licenses on or after January 1, 2012; and all competent evidence of rehabilitation
presented will be considered upon reapplication. On July 19, 2010, the Police
Department recommended approval of, and the City Council granted, an on -sale 3.2%
malt liquor license to Baldy's BBQ.
The City Council will conduct a public hearing on the reapplication of Baldy's BBQ Corp.
for an on -sale wine license. Sergeant John Kornmann will present the Police report on
the license application. The applicant, Brian Wheeler, will be present.
Primary Issues to Consider
• Has the applicant demonstrated sufficient evidence of rehabilitation?
• In accordance with State Statute and City Code, the holder of an on -sale wine
license may sell strong beer, provided gross receipts are at least 60%
attributable to the sale of food.
