JUNE 4, 2012
Mayor Bellows called the meeting to order at 7:00 p.m. The pledge of
allegiance to the flag was given.

Citizens' Comments
Lawrence Schweich, 8719 -190th Street W., voiced a concern regarding the
safety of the 190th Street and Holyoke Avenue intersection. He asked the
Council to consider constructing a bypass lane on northbound Holyoke Avenue
at 190th Street with the Crescent Ridge Third Addition final plat.
Mr. Mielke stated that he recently met with Mr. Schweich and explained to him
that because the area of concern is on a curve, the City must be certain that a
bypass lane is constructed in accordance with traffic codes_ and standards. The
Interim City Engineer is reviewing the matter and will make a recommendation
to the City Council.
Presentation /Introductions
Luke Litteken, District Director with CenterPoint Energy, presented a community
partnership grant in the amount of $1,575 to the Lakeville Fire Department. The
grant will be used to purchase Channellock rescue tools, one for each
firefighter.
Mr. Petree presented the May Public Works Department monthly report.

Consent Agenda
Mr. Mielke requested, on behalf of the developer, to remove Item 7k from the
consent agenda, to be considered after Item 8. The City Council moved Item
7k to the end of the regular agenda. The City Council added Item 9 to the
consent agenda.
12.38 Motion was made by Swecker, seconded by Rieb to approve the consent
agenda items as follows:
a. Claims for payment.
b. Minutes of the May 21, 2012 City Council meeting.
c. Minutes of the May 21, 2012 Council work session.
d. Resolution No. 12 -56 authorizing the temporary closing of city streets for
Pan -O -Prog events.
e. Set a Council work session to be held at 5:00 p.m. on June 18, 2012, to
discuss the Capital Improvement Plan.
f. Agreement with CanAm Tactical K9 LLC for the purchase of a dog.
g. Extension of on -sale liquor license for Babe's Sportsbar & Grill to allow
the sale of alcoholic beverages and live entertainment in the fenced -
in parking lot on July 5 -7, 2012.
h. Temporary on -sale liquor license for VFW Post 210 to host Pan -O -Prog
events on July 5 -7, 2012.
i. Resolution No. 12 -57 receiving bids and awarding contract for
transportation safety improvements, Improvement Project 12 -11.

Item 7 - Spice Thai LLC Wine and On -Sale Beer License
Mayor Bellows opened the public hearing on the application of Spice Thai LLC
for a wine and on -sale 3.2% malt liquor license at 7704 -160th Street W. The city
clerk attested to legal notice publication. Chief Vonhof presented the police
report and recommended approval of the licenses as requested.
The applicant, Chad Sukhtipyaroge, provided a brief overview of his restaurant,
Spice Caf6, providing authentic Thai cuisine. There were no questions or
comments from the audience.
12.39 Motion was made by Rieb, seconded by Swecker to close the public

12.40 Motion was made by Swecker, seconded by LaBeau to grant a wine and
on -sale 3.2% malt liquor license to Spice Thai LLC, effective July 1, 2012.

Item 8 - Title 10 Concerning Park Dedication Fees
Mr. Michaud explained that the City conducted a review of its park dedication
requirements after Shamrock Development disputed the park dedication fee in
lieu of land for Crescent Ridge 2nd Addition. The Parks, Recreation & Natural
Resources Committee recommended against the proposed ordinance
amendment and resulting reduction of the park dedication fee, while the
Planning Commission supported staff's recommendation to amend the
ordinance.
Dan Licht, with The Planning Company, explained that the current cash fees in
lieu of land dedication were established in 2007 following adoption of the 2006
Parks, Trails and Open Space System Plan. The 2030 Comprehensive Plan
approved by the Metropolitan Council estimates 14,817 additional households in
Lakeville by the year 2030. While the timeframe established for the full build -out
of Lakeville is likely on the optimistic side given the economic downturn, the
approved plan does provide the basis for the City's land use and system plans.
He further stated that the City's Parks, Trails and Open Space System Plan was
last updated in 2006. That study recommends the acquisition of up to 481 acres
of additional active park land by the year 2030. Based upon these assumptions,
the proposed land dedication requirements are proposed to increase from 10%
to 12% for single family developments and from 5% to 6% for commercial and
industrial developments.
Mr. Licht reviewed the various options that were considered to determine the
method for establishing property value. Based on a consistent 38% reduction in
property values since 2008, staff recommends a reduction in the park
dedication fees in lieu of land for single family and multiple family development
by a corresponding amount.
Based on that calculation, the proposed ordinance amendment provides for a
park dedication fee of $3,532 per single family lot; $2,403 for medium density
(townhouse) dwelling units and $1,824 for high density (multiple family) dwelling
units.

Council Member LaBeau questioned the current population projections and the
likelihood that Lakeville will reach full build -out by the year 2030. Mr. Licht
explained that the population projections that are adopted as part of the City's
Comprehensive Plan are provided by the Metropolitan Council. Their
demographers take into account growth patterns that occur over a 30 year
period. It is the most reliable, accurate information available to the City at this
time. These projections, however, are likely to be reviewed and updated in the
near future.
Mr. Mielke pointed out that the City is working off the 2006 Parks & Open Space
System Plan. That document is currently being reviewed. In addition, the land
value factor in the park dedication ordinance should be reviewed on an annual
basis. As a result, the park dedication fees will likely change over time, based on
demand and land values as they fluctuate.
Mr. Mielke stated that staff is recommending the effective date of this ordinance
should be retroactive to all final plats subject to payment of park dedication
fees from the point at which Crescent Ridge Second Addition was approved,
which was October 17, 2011.
Judy Hayes, 17326 Idlewood Way, urged the City Council to not only consider
the needs of developers, but also consider the importance of parks and trails to
this community.
Michael Smith, 9566 - 176th Court, and Jason Mahlman, 20584 Hartford Way,
spoke on behalf of the Lakeville Outdoor Sports Association. They stated
Lakeville's parks and fields are over - utilized and under duress at this time. They
are concerned that reducing fees to developers will shift costs to those who
utilize the outdoor sports facilities.
Jim Stanton, Shamrock Development, stated park dedication fees are not to be
used for operations or maintenance of the parks.
Todd Bornhauser, Lakeville Area Chamber of Commerce, asked when park
dedication fees for commercial /industrial property will be addressed.
Bob Erickson, 18224 Justice Way, stated the City needs to re- invigorate the
home building industry; and the park dedication fee is one piece of the
financial puzzle that dictates the cost of developing a residential lot.

Robert Swan asked the Council to not approve a reduction in the park
dedication fees.
In response to a question by Council Member Little, Mr. Mielke explained that
review and adoption of the update to the 2006 Parks & Open Space System
Plan is independent of the ordinance establishing park dedication fees.
Depending on the results of the Plan update, the demand portion of the fee
structure may need to be adjusted.
Mr. Mielke also responded to Mr. Bornhauser's question regarding
commercial /industrial property'values. The staff is currently in the process of
reviewing commercial /industrial rates and anticipates having a prepared report
for the Council's June work session.
Council Member Swecker expressed some reservations with back - dating the
ordinance. Mr. Mielke explained that an Escrow Agreement was approved with
the Crescent Ridge 2nd Addition final plat on October 17, 2011, related to the
park dedication fee. By back - dating the ordinance, any plats that came
forward after that date, which required park dedication, would utilize the new
fee.
Council Member Little voiced concern with changing the park dedication fees
now, when they will likely be changed again in the near future when the Parks &
Open Space System Plan is updated. He felt that while the equation is fair, the
needs assessment should have occurred first.
Council Member Rieb stated she feels it is important to determine what residents
want and need with respect to the City's parks & trails system; and it is also
important to review the park dedication fees annually.
12.41 Motion was made by Rieb, seconded by LaBeau, to adopt Ordinance
No. 890 amending Title 10 of the Lakeville City Code concerning park
dedication, effective October 17, 2011.

Item 10 - Labor Agreement with Minnesota Teamsters, Local No. 320

Human Resources Manager Cindi Joosten presented the proposed labor
agreement with the City's maintenance employees, effective January 1, 2012
through December 31, 2013.
12.42 Motion was made by Swecker, seconded by LaBeau to approve the
Labor Agreement between the City of Lakeville and Minnesota Teamsters
Public & Law Enforcement Employees Union, Local No. 320.
Roll call was taken on the motion. Ayes, unanimous.
Item 6k - Crescent Ridge Third Addition
12.43 Motion was made by Swecker, seconded by Rieb to approve Resolution
No. 12 -58 approving the final plat of Crescent Ridge Third Addition.
