HomeMy WebLinkAboutItem 08June 28, 2012 Item No. Proposed Action CARBONE'S OUTDOOR PATIO LIQUOR LICENSE AMENDMENT JULY 2, 2012 CITY COUNCIL MEETING Staff recommends adoption of the following motion: Move to amend the current liquor license for Carbone's Bar and Grill to allow an outdoor patio. Passage of this motion will allow Carbone's to construct a patio on the east side of their tenant space in the Lakeville Crossing commercial development located at 7670 — 160 Street. Overview Representatives of Carbone's Bar and Grill are requesting approval to construct a 1,200 square foot (52 seat) outdoor patio on the east side of the multi- tenant retail building located in the southwesterly area of the Lakeville Crossing development. The patio entrance will be located just east of the entrance to Carbone's Bar and Grill and would eliminate seven existing parking spaces. A concrete pad for motorcycle parking will be added adjacent to the patio in place of two of the spaces. There is sufficient parking within the Lakeville Crossing PUD to accommodate Carbone's outdoor patio and meet Zoning Ordinance requirements. The patio will be enclosed by a solid wall on the south side facing the adjacent residential neighborhood and a four foot high metal fence and landscaping on the other sides. A roof will cover a portion of the patio area. Because Carbone's is located within 150 feet of a residential zoning district, the patio will have to close at 10:00 p.m. Chapter 3- 1 -8 -14 of the City Code requires that liquor, food, or music shall not be served, dispensed, possessed, displayed, or furnished after 10:00 p.m. on a patio located within 150 feet of a residential district. Primary Issues to Consider • Does the application submitted for Carbone's Bar and Grill meet the requirements of the City Code for outdoor patios? Staff has determined that it does. What is the distance of the proposed patio from all property lines? South- 100 feet, East- 530 feet to Glen Oaks, West- 320 feet, North- 320 feet to 160 Street 2. What is the current size and seating capacity of the licensed building? 8814 Sq. Ft. Bar has 35 seats, high tops and booths around bar have 98 seats, and dining area has 113 seats. 3. What is the proposed patio size and seating capacity? Include table, chair and aisle arrangements of the entire licensed area on site plan, Est. 1200 Sq. Ft with 52 seats. 4. What is the current parking capacity and additional number of parking stalls required? The PUD contains 581 stalls. 7 will be removed by the patio. No additional stalls are required. 5. What is the additional number of City and Metropolitan Council S.A.0 units as determined by the Metropolitan Council Environmental Services (651- 602 - 1378)? Request has been made to Met Council. Calculation should be: 1,200 SF /15 SF per seat/10 seats per unit x 25% = 2 units. Determination needs to be made on existing restaurant seating and whether total restaurant is recalculated or just the patio area. 6. What is the type and height of the fence and/or landscape barrier to be used around the patio? 48 inch high metal fencing, Stone Columns, with 3 -5 foot wide landscape barrier with trees and planting inside the 6 inch high concrete curbing. 7. What type of emergency exit gate hardware will be used and where will they be located on the patio? A push bar panic hardware will be included with the 3 foot wide gate located at the north fence area. 8. What type of vehicle barrier will be used and where will they be located, if required?
