RESOLUTION REQUESTING A VARIANCE
FROM STANDARD FOR STATE AID OPERATION FOR
PROJECT NO. S.A.P. 188 - 594 -001
Proposed Action
Staff recommends adoption of the following motion: Move to approve a resolution
requesting a variance from the Minnesota Department of Transportation State Aid
Operations Rules Chapter 8820.9922 to allow for a 20 mph design speed at the
intersection of 168 Street and Gannon Way, over the 168 Street Bridge, in lieu of 30
mph design speed limits, as a part of City Improvement Project 12 -02.
Overview
On January 17, 2012, the City Council passed Resolution No. 12 -06, requesting
prioritized funding from Mn /DOT for the 168 Street bridge replacement in conjunction
with the 2012 Street Reconstruction Project. On February 7, 2012, the City received
notice from Mn /DOT that the funding request for the cost of the bridge replacement had
been approved.
The existing roadway curve radius at the 168 Street Bridge does not meet current
State Aid design guidelines for a 30 mph road. The new bridge and the adjacent
roadway approaches will be designed to 20 mph design standards. Signage will be
installed along both 168 Street and Gannon Avenue leading into the bridge indicating
as such.
The Office of State Aid requires a variance be sought for any approach roadways
constructed to less than a 30 mph design speed. The variance request must be
approved prior to receiving final Mn /DOT approval for the bridge replacement plans.
Primary Issues to Consider
• Why can't the streets and bridge be designed as 30 mph roadways? The impacts
would include residential building structure removal, right -of -way acquisition and
hydraulic redesign of the North Creek drainage channel.

WHEREAS, the City of Lakeville has authorized WSB & Associates, Inc. to
prepare plans and specifications for the 168 Street Bridge Replacement Project,
State Bridge No. 19565; and
WHEREAS, Minnesota Rules for State Aid Operation 8820.9922 requires for
bridge rehabilitation projects with approach roadways on suburban undivided
roadways that are not on the State Aid system to have a minimum design speed
of 30 mph; and
WHEREAS, the reasons for this variance request are that the 168 Street and
Gannon Avenue will be designed to a 20 mph design speed at the 168 Street
Bridge in order to satisfy State Aid design guidelines and to accommodate the
existing terrain, curve radius, and existing approaches at the intersection of 168
Street and Gannon Avenue.
NOW, THEREFORE BE IT RESOLVED, that the City Council does hereby
request a variance from the Minnesota Department of Transportation State Aid
Operations Rules Chapter 8820.9922, Minimum Design Standards: New Bridge,
Bridge Replacement, or Bridge Rehabilitation Projects and Approach Roadways
on Rural or Suburban Undivided Roadways that are not on the State Aid System
to allow for a 20 mph design speed at the intersection of 168 Street and
Gannon Way, over the 168 Street Bridge, in lieu of 30 mph design speed limits;
BE IT FURTHER RESOLVED, that the City of Lakeville City Council hereby
indemnifies, saves and hold harmless the State of Minnesota and its agents and
employees of and from claims, demands, actions, or causes of action arising out
of or by reason of the 168 Street Bridge Replacement Project, State Bridge No.
19565, in accordance with Minnesota Rules 8820.9922 and further agrees to
defend at their sole cost and expense any action or proceeding commenced for
the purpose of asserting any claim arising as a result of the granting this
variance.

Dear Mr. Kowski:
The City of Lakeville is requesting a variance in conjunction with its 168 Street Bridge
Replacement Project, Bridge No. 19565. The City has applied for and been awarded State
Bridge Bond Grant funds to complete the 168 Street Bridge Replacement Project, and final
bridge plans are currently under review at the State Aid Bridge Office.
The 168 Street Bridge is proposed to be replaced in conjunction with the City of Lakeville's
2012 Street Reconstruction Project, in which 168 Street and Gannon Avenue, the two approach
roadways leading into the 168 Street Bridge, are proposed to be reconstructed as a part of the
City's Pavement Management Plan. The area surrounding the bridge replacement project area is
zoned for single family residential use, and a City Park, Fairfield Park, is located southeast of
and adjacent to bridge crossing. These local streets are used primarily by those property owners
with driveway access onto the aforementioned streets, and the ADT is estimated at 200 vehicles
per day. There are no trails or sidewalks located along either 168 Street or Gannon Avenue.
Local residential streets within this area of the City of Lakeville are posted at 30 -mph.
Neither 168 Street nor Gannon Avenue are on the City's current State Aid System, and the City
is funding the its 2012 Street Reconstruction Project using local funds, only. A copy of the title
sheet, typical street sections (refer to the typical section for ” Local Residential Streets Without
Watermain Replacement" for information regarding the typical sections of 168 Street and
Gannon Avenue), and Plan Sheet No. 73, which illustrates the location of the existing approach
roadways and bridge, have been included in this State Aid Variance Request submittal package.
The 168 Street Bridge is located over an existing drainage channel referred to as "North Creek"
by the City of Lakeville, and is identified as a DNR Public Water (see attached, "Water
Resources & NRCS Soil Survey" map that was included as a part of the SWPPP prepared with

the City of Lakeville's 2012 Street Improvement Project). The areas surrounding the North
Creek drainage channel are established and include mature vegetation (see attached site photos).
As a City, Lakeville's priority for any public improvement project is to construct it in a manner
so as to protect against impacts to Waters of the State, tree loss and adverse property impacts.
We realize that the functionality and safety of the road will necessitate impacts to existing
conditions, but we seek to minimize these impacts as much as possible. The existing curve
radius at the intersection of 168 Street and Gannon Avenue is 96.16 -feet. Modifying the curve
radius /proposed super elevation rate to meet State Aid requirement for a 30 -mph design speed
will necessitate the removal of existing residential building structures, require significant right -
of -way acquisitions that would result in the creation of multiple non - conforming lots, require
extensive tree and vegetation removal and will require the hydraulic redesign of an existing DNR
watercourse.
It is proposed that the Lakeville City Council will resolve at their July 2, 2012 meeting (a copy
of the draft resolution is attached), a Request for Variance to State Aid Operation Rule
8820.9922, which states that for new bridge, bridge replacement, or bridge rehabilitation projects
and approach roadways on rural or suburban undivided roadways that are not on the State Aid
System, the minimum design speed shall be 30 mph. Replacing the 168 Street Bridge and
reconstructing the roadway approaches with a 96.16 -foot curve radius satisfies the design
requirements for a 20 -mph roadway. The City is proposing to install signage in accordance with
the MMUTCD on both roadway approaches to indicate as such.
It is our opinion that the variance represents a reasonable request, as it helps us not only to
minimize the footprint of the new bridge and approach roadways and the associated impacts to
the surrounding properties and Waters of the State, but it will also provide safety and
functionality benefits compared to the non - variance alternatives.
