HomeMy WebLinkAboutItem 06.eAugust 16, 2012 Proposed Action Staff recommends adoption of the following motion: Move to approve a resolution terminating Interim Use Permit (IUP) No. 03 -14. Passage of this motion will result in IUP No. 03 -14 being released from the property title as requested by the property owner. Overview Tradition Development is requesting the City release Interim Use Permit No. 03 -14 in order to clear the title on property they own within the Spirit of Brandtjen Farm planned unit development (PUD). The IUP was approved by the City Council in 2003 to allow the mining of sand and gravel on 39 acres of land within Spirit of Brandtjen Farm (SBF). The mining of the sand and gravel materials and site restoration concluded in 2006 and created a large storm water pond that is also an amenity for the SBF PUD. While the IUP has technically expired, it remains on the property title. In order to remove the IUP from the title as requested by the property owner, the City Council needs to approve the attached resolution prepared by the City Attorney's office. Staff recommends approval of the resolution.
