CITY OF LAKEVILLE COUNCIL MEETING
FEBRUARY 7, 2005
Mayor Johnson called the meeting to order at 7:00 p.m. The pledge of
allegiance to the flag was given.
Roll call was taken. Present: Council Members Bellows, Wulff, Rieb and
Mayor Johnson. Absent: Council Member Luick.
Also present: R. Knutson, City Attorney; S. Mielke, City Administrator; K.
Nelson, City Engineer; D. Olson, Community & Economic Development

MINUTES
The minutes of the January 18, 2005 City Council meeting were approved
as presented. Council Member Wulff recommended a correction to her
• .comments regarding multi-family residential park dedication fees in the
January 10th Work Session minutes as follows, "In addition, she stated
that Lakeville wasn't working with firm multi-family land values and felt
staff should research recent sales of multi-family land in order to work
from an established land value.. The rest of the City Council agreed, and
Mr. Michaud stated he would follow up with that research." The January
10, 2005 Work Session minutes were approved as corrected.

ITEM 8
Associate Planner Erin Seeman presented the Woodhill preliminary plat,
variance for cul-de-sac street length, conditional use permit for street
width and a rezoning from RH-1 to RST-2. She explained that the
preliminary plat of Woodhill consists of 62 twin home units, one common
area lot and three outlots on 17.96 acres of land located west of Kenyon
Avenue between 179" Street and Kerrville Trail. City staff is requesting a
rezoning of the property to RST-2, single and two-family residential
district, consistent with the proposed twin home development. A
Comprehensive Plan .Amendment will be processed in conjunction with
the final plat to change the land use designation to be consistent with the
rezoning. The developer is requesting a conditional use permit to allow a
28-foot wide local street within a 50-foot right-of-way, as allowed in
environmentally sensitive areas, and a variance to allow a cul-de-sac
. length in excess of 600 feet. The Planning Commission held a public
hearing on the Woodhill preliminary plat, variance, conditional use permit
and rezoning. There were no public comments at the hearing. The
Planning Commission recommended approval
Mayor Johnson asked if the length of the cul-de-sac would cause any
snowplowing problems. Ms. Seeman stated it would not. She explained
that a through street was not possible .due to the limited access
opportunities adjacent to the subject property.
Council Member Wulff asked whether the building floor plans for the twin
home units have been modified to meet the minimum garage floor area
requirement. Ms. Seeman stated revised plans have been submitted, and
all stipulations of the planning report will be reviewed prior to final plat
consideration.
Mayor Johnson asked about the size of the twin homes. Kevin Clark of
Town & Country Homes stated they would range from approximately
1,700 to 1,800 square feet with basement options.
05.07 Motion was made by Rieb, seconded by Wulff to receive the Planning
Commission's findings of fact and recommendation and approve the
preliminary plat of Woodhill, variance for cul-de-sac street length,

conditional use permit for street width and .Ordinance No. 779 rezoning
property from RH-1 to RST-2.

ITEM 9
Mr. Michaud presented a proposed ordinance amending Title 10, Chapter
4 of the Lakeville City Code concerning park dedication fees. He
explained that in 2003, the City Council established a base land value per
acre for the purpose of establishing per dwelling unit fees for single family
and multi family developments. The base land value was $50,000 per
acre in 2003 and $56,250 per acre in 2004. However, the base land value
has fallen behind due to rapidly increasing land values. The park
dedication ordinance allows the City to require up to 10% of the property
being platted or an equal amount in cash for park purposes. Mr. Michaud
explained that the Parks, Recreation & Natural Resources Committee
reviewed the park dedication fees for single-family and multi-family
residential, commercial and industrial plats. The proposed fees were
determined using fair base land values for single-family and multi-family
. categories. The Parks, Recreation & Natural Resources Committee held
a public hearing and recommended the City Council establish the
following park dedication fees:
? Single-family dwelling units $3,665 per dwelling unit
? Multi-family dwelling units $3,200 per dwelling unit
? Commercial $5,940 per acre
? Industrial $3,520 per acre
With respect to commercial/industrial property, the Committee
recommended a 10% increase in the park dedication fees at this time;
however, the committee indicated a desire to have the Comprehensive
Parks and Open Space System Plan updated. The update will provide an
estimate of park and recreational facility needs through the year 2020.
Further review of the park dedication fees for commercial/industrial
property would follow completion of the Parks and Open Space System
Plan update. The Parks, Recreation & Natural Resources Committee also
recommended reinstitution of the policy requiring a shared cost for the
development of trails adjacent to new plats that abut major collector or
minor arterial roadways identified in the Lakeville Comprehensive
Transportation Plan.

Mayor Johnson asked how the new fees affect preliminary plats already
approved by the City. Mr. Michaud stated the fees in place at the time of
City Council approval of a concept plan or preliminary plat would apply.
05.08 Motion was made by Wulff, seconded by Bellows to adopt Ordinance No.
780 amending Title 10 of the Lakeville City Code concerning park
dedication fees.
Roll call was taken on the motion. Ayes, Wulff, Rieb, Bellows, Johnson.
