Adoption of this motion will allow site and building modifications to the McDonald's restaurant in the McStop commercial development at 21044 Kenrick Avenue. Overview Representatives of McDonald's have submitted an application and plans for a conditional use permit amendment to allow modifications to the drive - through vehicle queuing area and the building's exterior for their McStop fast food restaurant. The McDonald's at this location was constructed in 1985 with the development of the McStop truck stop. The Planning Commission held a public hearing on the conditional use permit amendment at their September 6, 2012 meeting. The Planning Commission unanimously recommended approval to the City Council subject to eight stipulations. Stipulation 2 of the planning report has been addressed with the submittal of a revised site plan as recommended by the Planning Commission. The cash security for the proposed landscaping will be submitted with the building permit application. The McDonald's conditional use permit amendment plans meet Zoning Ordinance requirements. Staff recommends approval of the McDonald's conditional use permit amendment subject to the stipulations noted in the conditional use permit form. In addition, a new trash enclosure will be constructed, and new landscaping will be installed adjacent to the north side of the parking lot. The south entrance will be clearly striped to direct traffic to the queuing area or parking lot and the building exterior will be extensively remodeled to the branding style currently favored by McDonalds consistent with the recent Icenic Trail McDonalds restaurant remodel. 2 (Reserved for Dakota County Recording Information) CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA CONDITIONAL USE PERMIT AMENDMENT NO. 12- 1. Permit. Subject to the terms and conditions set forth herein, the City of Lakeville approves a Conditional Use Permit Amendment for McDonald's USA, LLC to allow site plan and building modifications to the McDonald's convenience food restaurant located at 21 044 - 21 0 Street. 2. Property. The permit is for the following described property located in the City of Lakeville, Dakota County, Minnesota and legally described as follows: Lot 1, Block 1, McStop 1 Addition 3. Conditions. The permit is issued subject to the following conditions: a) The site and building improvements shall comply with the plans approved by the City Council. b) All signage on the property must meet the requirements of Section 11 -23 of the Zoning Ordinance. A sign permit is required prior to the installation of any signs. c) The exterior trash enclosure must meet the requirements of the Zoning Ordinance and be constructed of materials that match the exterior of the building with a screening gate of sturdy, maintenance free material. 1 d) All exterior lighting shall meet the requirements of the Zoning Ordinance. e) A building permit is required prior to commencing any building improvements. f) The proposed site improvements are subject to the review of the City Engineer. g) Four 2.5 inch caliper overstory deciduous trees shall be installed along the north edge of the parking lot in accordance with the site plan. The trees shall be of a type allowed by the Zoning Ordinance. A $1,000 cash escrow shall be submitted prior to the issuance of a building permit to guarantee installation of the trees. 4. Termination of Permit. The City may revoke the permit following a public hearing for violation of the terms of the permit. 5. Lapse. If within one year of the issuance of this permit construction of the McDonald's restaurant has not commenced, this permit shall lapse. 6. Criminal Penalty. Violation of the terms of this conditional use permit is a criminal misdemeanor. The Planning Commission conducted a public hearing on the proposed conditional use permit amendment preceded by published and mailed notice. The City Council hereby adopts the following: 1. The property is zoned C -3, General Commercial District. 2. The property is located in Planning District No. 11 of the 2008 Comprehensive Plan, which guides the property for commercial land uses. 3. The legal description of the property is: Lot 1, Block 1, McStop 1 Addition 4. Section 11 -4 -3E of the City of Lakeville Zoning Ordinance provides that a conditional use permit may not be issued unless certain criteria and satisfied. The criteria and our findings regarding them are: a. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. The McDonalds commercial use and amended site plan and building exterior are consistent with the designated commercial use of the properly and the C- 3, General Commercial District zoning of the property. b. The proposed use is or will be compatible with present and future land uses of the area. The amended site plan and building exterior is consistent with present and future land uses of the area. 1 c. The proposed use conforms with all performance standards contained in the Zoning Ordinance. Given compliance with the stipulations listed in the planning report, the amended site plan and building exterior amendments will conform to all performance standards contained in the Zoning Ordinance. d. The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. The property is served with City sanitary sewer and water. The proposed amendment to the site plan and building exterior will not overburden the City's service capacity. e. Traffic generation by the proposed use is within capabilities of streets serving the property. The traffic generated by the McDonalds convenience food restaurant will not overburden the streets serving the properly. 5. Mr. Morey in ated that asking for a variance extension is a unique request and that he was not a re of any three year extensions being granted in the past. He stated that extensio equests for preliminary plats are typically one year. Russ Defauw, resident of Performance Office Papers, confirmed that his letter to the City asked for : three year extension. He stated that he is not opposed to a one year extension if the Planning Commission is hesitant to grant a three year extension. Mr. Defau indicated that he cannot make any guarantees on the timeframe for their propos • building addition and he ,requested the three year extension simply because he It it would be more practical than having to return every year asking for a one year _ ension. McDonalds USA, r LLC (continued from the August 16, 2012 Planning Comrxiission meeting) Chair Lillehei opened_ the public hearing to consider the application of McDonalds USA,: LLC for a Conditional Use Permit amendment to allow site plan and building modifications for the McStop McDonald's convenience food restaurant, located at 21044 Kenrick Avenue ; The Recording Secretary attested that the legal notice had been duly published accordance with State Statutes and City Code. McDonalds project consultant Bill Everson presented an overview of their request. Mr. Everson stated that McDonalds is re- branding with major remodels of their older buildings to include a second drive - through menu order lane as well as updates to the building exterior. Associate Planner Frank Dempsey presented the planning report. Mr. Dempsey indicated that McDonalds USA, LLC is requesting a Conditional Use Permit (CUP) amendment to allow site plan and building modifications to the McDonalds Planning Commission Meeting Minutes, September 6, 2012 Page 3 restaurant located at 21044 Kenrick Avenue. He explained that McDonalds is proposing to expand the capacity of the drive - through by adding a second menu order lane, remodel the building exterior, and construct a freezer addition to the south side of the building as well as a new trash enclosure at the southeast corner of the property. Mr. Dempsey showed an aerial view of the site and explained the revised site plan, which proposes 125 parking spaces not including the eight semi -truck and trailer and recreational vehicle parking spaces on the east side of the - property. A total of 97 parking spaces are required by ordinance for the McDonalds 'restaurant. Mr. Dempsey explained how the current location of;`the.trash enclosure, which is next to the building, interferes with the drive - through queuing lanes when the trash is being picked up and showed the proposed new lo along ;n ,ith th exterior material of the proposed trash enclosure. Mr. Dempsey stated that the proposed McDonalds improvements will.. be a positive addition to the site, including the additional landscaping "that will be installed on the north side of the site with this CUP amendment: Mr. Dempsey stated that Planning Department staff ,recommends approval of the CUP amendment, subject to the 8 stipulations listed in the August 30, 2012 planning report. Chair Lillehei opened the hearing to the public for comment. There were no . comments from the audience. Discussion points f were: • There was: a, discussion regarding the large truck/trailer parking area on the east side of the'McDonalds property and that there is one less parking space proposed with the new site plan. Mr. Dempsey explained that the proposed new trash enclosure will eliminate one truck parking space. McDonalds thought they could add the parking space back in by making the island to the north smaller, but staff recommended against that due to concerns about internal traffic circulation safety. Mr. Dempsey indicated that semi -truck parking is not limited to this area. The area southeast of the McDonalds property within the McStop development also allows truck parking. Planning Commission Meeting Minutes, September 6, 2012 Page 4 • The Planning Commission indicated they liked the new queuing design and thought it would be a good improvement to McStop. Mr. Dempsey confirmed that the drive - through queuing lane from the existing menu board and the new second menu board to the service window is in compliance with the Zoning Ordinance requirement of at least 180 feet. He indicated that the distance is 220 feet. • Commissioner Boerschel asked about the location of the specific parking spaces that are designated for customers if their food was not ready when going through the drive - through lane. Mr. Dempsey pointed them out on the site plan. There are a total of three spaces designated for this purpose. The McStop site was developed in 1984 and the McDonald's building was constructed in 1985. The subject site is zoned C -3, General Commercial District. The site was developed under the approvals originally granted by the City Council on 4 June 1984. The applicant was previously scheduled for public hearing on August 16, 2012 but requested that the public hearing be tabled as McDonald's requested additional time to consider a revised site plan. McDonald's proposes to expand the capacity of the drive through lane to accommodate an increasing number of drive - through service customers at this location by expanding the capacity of the drive - through service lanes. The plans include remodeling the building exterior and the construction of a 228 square foot (12' x 19') freezer addition to the south side of the building as well as a new trash enclosure at the southeast corner of the property. Planning Department staff has reviewed the plans for compliance with the Zoning Ordinance. Findings of fact are included with this report. The property is zoned C -3, General Commercial District and is platted as Lot 1, Block 1, McStop 1St Addition. Restaurants with convenience food are allowed by conditional use permit in the C -3 District. The property is 3.1 acres in area. Surrounding Land Uses and Zoning North - 210 Street (CSAH 70) South - Holiday Station (C -3 District) East - Motel 6 (C -3 District) West - Old Kenrick Avenue and 1 -35 (Right -of -Way) Hours of Operation. McDonald's has approval to operate without restriction to the hours of operation at this location under the provisions of the initial PUD Agreement. Building Height and Architectural Standards. The tallest portion of the building at the main entrance will be 17 feet, 11 inches tall from the ground to the top of the parapet. The existing exterior materials of T1 -11 painted plywood siding will be removed and replaced with a two shade integral colored earth tone brown Exterior Insulated Finish System (EFIS). The mansard roof will be replaced with a new roof and wall to match the rest of the proposed building facade and parapet wall. The parapet wall above the roof line will provide screening for the roof -top mechanical equipment. The existing wainscot brick around the base of the building will remain. White ceramic tile will be included around the building entrances on the north and west sides of the building. A silver colored aluminum fascia cap and trellis system, plus yellow architectural accents and canopies over the north main entrance and the west entrance will be installed. The proposed building exterior materials and design are an upgrade from the painted wood siding currently on the building. This work is similar to the upgrade of exterior 2 materials recently completed on the McDonald's on lcenic Trail and Kenwood Trail (CSAH 50). The proposed materials meet the requirements of Sections 11 -17 -9D and 11- 73 -7H2 of the Zoning Ordinance. Exhibits K and L include the colored images of the building exterior. This developer will be submitting a revised exhibit to match the architectural drawings (Exhibit I) by the September 6, 2012 Planning Commission meeting. The attached Exhibits K and L show McDonald's signs on the north and east sides of the building which will be removed with the revised exhibits. Landscaping. Four new Red Maple trees will be installed along the north boundary of the parking lot. These four trees will fill an existing gap in the landscaping along the north boundary adjacent to 210` Street (CSAH 70). Existing green space on the property will not be impacted by the proposed site revisions. Dust Control and Drainage. The entire site other than the building and landscape areas is surfaced with asphalt and concrete curb and gutter as required by Section 11- 73 -7H4 of the Zoning Ordinance. The proposed site improvements are subject to the review of the City Engineer. Noise. The property is located in a commercial zoning district. There are no residentially zoned properties in the vicinity. Noise from the menu board will be controlled by the operator. Noise shall not violate the Zoning Ordinance and shall not cause a nuisance as defined by City Code. Exterior Lighting. The existing parking lot lights will remain. Existing decorative coach lights in the outdoor play /dining area will be removed. The new exterior lights on the building will be down -cast sconces in compliance with the requirements of the Zoning Ordinance. Access. The property is accessed from the north and south via the internal private drive for the McStop development. The south access driveway from the private drive will be modified to clearly direct traffic into and out of the site and to the drive - through queuing lanes. There will be no other changes to drive aisles and accesses as part of the proposed conditional use permit amendment. Drive - Through Queuing Lanes. The site plan indicates that the drive - through queuing lane from the existing menu board and the new second menu board to the service window is 220 feet in compliance with the 180 feet required by the Zoning Ordinance. The new drive - through queuing lanes are designed to move more vehicles through the ordering process than a one lane queue design. Pedestrian Facilities. The existing sidewalks on the property will be reconditioned and improved to meet current handicapped accessibility regulations as part of the proposed conditional use permit amendment. Parking. The revised site plan provides 125 parking spaces, not including the eight semi -truck and trailer and recreational vehicle parking spaces located on the east side of the property. A 3 total of 97 parking spaces are required. Eleven spaces will be removed along the south boundary to accommodate the expanded vehicle queuing lane. The required number of parking spaces is based upon the floor plan submitted with the conditional use permit amendment application and is calculated as follows: Patron Queuing Area: 1 space for each 15 square feet = 225sf/15 = 15 spaces Patron Dining Area: 1 space for each 40 square feet = 2,623sf/40 = 66 spaces Kitchen Area: 1 space for each 80 square feet = 1,279sf/80 = 16 spaces Total number of required parking spaces = 97 Number of parking spaces provided = 125 Vehicle Circulation. The McDonald's site is access from private drives only. No driveways access the public streets. vehicles can enter the site from the north via the private driveway south of 210 Street (CSAH 70) or from the south via the driveway from the interior of the McStop property and the new Kenrick Court cul -de -sac. Drive - through service queuing currently is located on the south side of the building. The plan is to construct a second queuing service lane and drive - through bypass lane to the south. The McDonald's site also accommodates eight semi - truck/trailer and recreational vehicle parking spaces on the east side of the McDonald's property. The site plan for the proposed new trash enclosure proposes to eliminate one of those spaces with the installation of the trash enclosure and barrier concrete curb. The removal of that truck space would include the construction of a new semi - truck/trailer space at the north end of the truck parking aisle by narrowing the existing parking lot island. Staff has reviewed this proposed layout and recommends that the parking lot island not be further narrowed since this would result in trucks parking with their trailers much closer to the north driveway access resulting in the likelihood of restricted visibility at that access. This option would result in one fewer semi - truck/trailer parking space on the McDonald's property. Signs. The building remodel will include the removal of the existing McDonald's sign on the north facade of the building. McDonald's is proposing two golden arch wall signs on the north and west facades as allowed by the Zoning Ordinance for a corner lot. The wall signs will consist of golden arches only as shown on the exterior building elevations plans (Exhibit I). Each sign or combination of contiguous signs shall not exceed 100 square feet in area as allowed by the Zoning Ordinance. Two menu board signs and directional signs are also proposed. A Do Not Enter sign will be located at the southeast corner of the property to prevent vehicles from entering the drive - through bypass lane from the east. No changes are proposed to the existing pylon sign. All signage on the property must meet the requirements of Section 11 -23 of the Zoning Ordinance and a sign permit must be obtained prior to installation. Refuse Storage. Refuse is presently stored in a walled, gated enclosure on the south side of the building adjacent to the drive - through queuing area. The plans propose to construct a freezer addition in that area and relocate the trash enclosure near the southeast corner of the property on the other side of the drive - through queuing lane. The enclosure must be constructed of 4 materials that match the exterior of the building with a screening gate of sturdy, maintenance free material.
