RESOLUTION ORDERING THE 2013 STREET RECONSTRUCTION PROJECT AND
AUTHORIZING THE PREPARATION OF PLANS AND SPECIFICATIONS AND
ADVERTISEMENTS FOR BID
Proposed Action
Staff recommends adoption of the following motion: Move to approve a resolution ordering
the 2013 Street Reconstruction Project and authorizing the preparation of plans and
specifications and advertisements for bid for the 2013 Street Reconstruction Project 13 -02.
Overview
At its October 15, 2012 meeting, the Lakeville City Council received a Feasibility Report for the
2013 street improvement project and set a public hearing for November 19, 2012. Notice of
the public hearing was published and a letter was sent to all affected property owners. All
responses from property owners prior to the Public Hearing have been logged and are
attached.
Prior to the public hearing, City Staff along with staff from WSB & Associates will provide a
brief presentation of the project, project costs and assessments.
Following the public hearing and if the City Council elects to proceed with the project, City
staff recommends that the City Council approve the attached resolution ordering the 2013
Street Reconstruction Project and authorizing the preparation of plans and specifications and
advertisements for bid.

WHEREAS, on 15 October 2012, the City Council fixed a date for public hearing on the
2013 Street Reconstruction Project within portions of Donnay's College Park, Donnay's Valley
Park, Donnay's Valley Park 2" Addition, Donnay's Valley Park 6th Addition, Southbluff, Clay's
Acres, Dodd Terrace, and The Meadows, City Improvement Project 13 -02; and
WHEREAS, the required published notices of hearing through a weekly publication were
given, the required mailed notice of the improvement hearing was given to each property owner
in the proposed assessment area at least ten days prior to the hearing, and the hearing was held
on November 19, 2012, at which time all persons desiring to be heard were given an opportunity
to be heard.

NOW, THEREFORE, BE IT RESOLVED, by the Lakeville City Council:
1. The 2013 Street Reconstruction Project is hereby ordered as identified in the
Feasibility Report for Project 13 -02, dated October 15, 2012.
2. WSB & Associates, Inc. is hereby authorized to prepare plans and specifications for
the making of such improvements, and placing advertisements for bids.
APPROVED AND ADOPTED this 19th day of November, 2012.

NOTICE OF HEARING ON IMPROVEMENT
TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN that the City Council of Lakeville will meet at 7:00
p.m. on Monday, November 19, 2012, at the City Council Chambers, 20195 Holyoke
Avenue, Lakeville, Minnesota, to consider the 2013 Street Reconstruction Project within
portions of Donnay's College Park, Donnay's Valley Park, Donnay's Valley Park 2nd
Addition, Donnay's Valley Park 6th Addition, Southbluff, Clay's Acres, Dodd Terrace, and
The Meadows; City Improvement Project 13 -02, pursuant to Minn. Stat. 429.011 to
429.111.
The area proposed to be assessed for the improvements is as follows:
The project will include property in that part of Section 3 Township 114 Range 20
and that part of Section 30 Township 114 Range 20, lying east of Interstate 35 within the
City of Lakeville, Dakota County, Minnesota, and also being in subdivisions: Donnay's
College Park, Donnay's Valley Park, Donnay's Valley Park 2 Addition, Donnay's Valley
Park 6th Addition, Southbluff, Clays' Acres, Dodd Terrace and The Meadows.
The estimated cost of the improvement is $8,508,000. Such persons as desire to
be heard with reference to the proposed improvement will be heard at this meeting.

assessments are calculated on a per unit basis, rather than a front foot basis.
Monica Hell advised that as long as we knew about a residents needs, the field staff
would work with a resident to make sure their accessibility needs are met during
construction.

Comment
Resident had general questions about the Citys assessment policy and potential
assessment amounts. Resident also stated she was in favor of the project, as she
experiences significant drainage Issues due to the lack of curb and gutter in front of her
home.
Resident called inquiring about the extent of utility replacement in the area. Resident
also stated that he was glad to hear concrete curb and gutter is proposed to be
installed as a part of the project, as he thinks its installation is long overdue.
Resident had questions about project financing and the Citys general assessment
poicy.
Resident called Chris Petree regarding proposed Street Improvements and
assessments, stating the neighborhood was assessed in the late 1980's for similar
improvements.
Resident had concems about getting a wheelchair accessible van in and out of his
driveway during construction.
Thank you for having the neighborhood meeting. 1 feel that if you are going to do
anything to improve the streets, etc., you should "go all the way' and do It fully now.
Wetermain, concrete curb and gutter replacement - don't patch. Who knows when you
will get back here and what the costs will be in the future? Good Luck.

Resident was unable to attend the Neighborhood Meeting, and had questions
regarding the scope of the proposed improvements, assessments, deferments, access
during construction and the project timeline.
Resident had general questions about the scope of the work and what was discussed
at the Neighborhood Meeting.
Resident was unable to attend the Neighborhood Meeting, but had talked to residents
about what was discussed and is in support of the project.
Resident is concerned about the potential to narrow 204th Street to 32 -feet in width.
He stated that currently, the plow trucks do not plow to the edge of the existing
roadway, which narrows the driving width of 204th Street to one -way traffic at the
easterly curve in the road. He also stated that when vehicles are parked on both sides
of the street, it is difficult for two cars to pass each other at that same curve location.
He would prefer to see the road remain 36-feet In width adjacent to his property.
Resident had general questions about the project
Resident had questions about the location of his water shut off (currently In his
driveway) and whether that could be relocated with the water main Improvements for
the area.
