HomeMy WebLinkAboutItem 06.iDate: 27 November 2012 RESOLUTION ESTABLISHING THE MAILBOX REPLACEMENT POLICY DURING SNOW AND ICE CONTROL SEASON Proposed Action Staff recommends adoption of the following motion: Move to establish a mailbox replacement policy during snow and ice control season. Passage of this motion supersedes Resolution 99 -290 and establishes a policy for the replacement by staff or reimbursement to the property owner for mailboxes damaged by direct contact with a City snowplow. Overview City snowplows are operated by trained, professional operators responsible for clearing snow and ice from City streets to enable safe use by motorists. Privately owned snowplows also operate within the City and are typically contracted by property owners to clear snow and ice from driveways, parking lots, and private streets, typically associated the homeowners' associations. As a result of the number and types of snowplows operating in the City, mailboxes and support posts are occasionally damaged by direct contract with a plow. Mailboxes and support posts can also be damaged by the snow pushed against them. For those instances where a City snowplow damages a mailbox by direct contact between the plow and mailbox, the City has had in place a policy for replacement of the damaged mailbox. Since the previous resolution establishing a mailbox replacement policy was approved in 1999, costs of materials and styles of mailboxes in Lakeville have changed. This resolution supersedes the previous resolution, 99 -290, and re- establishes the mailbox replacement policy updated to meet current costs and designs. Primary Issues to Consider • What is the need for a mailbox replacement policy? Occasionally, a City snowplow will hit and damage a mailbox. In those instances, the City accepts responsibility for the damage and will either replace the mailbox or reimburse the property owner a specific amount and allow them to replace the mailbox. NOW, THEREFORE, BE IT RESOLVED, that the City Council for the City of Lakeville accepts responsibility for replacement or reimbursement for replacement of mailboxes under the following circumstances: • Only mailboxes actually hit by a City snowplow will be the responsibility of the City to replace or reimburse. • The City will not be responsible for damage to mailboxes or support posts caused by snow or ice coming in contact with the mailbox. • The City will not be responsible for replacement or reimbursement for mailboxes, support posts, or paper delivery boxes that are not constructed, installed, or maintained per specifications. • At the property owner's request, the City will replace and install the mailbox with a standard size non - decorative metal mailbox and replace and install the support posts as necessary with a minimum 4" x 4 ", decay resistant wood support post, or the City will reimburse the property owner $125.00. Charlene Friedges, City Clerk CITY OF LAKEVILLE Mark Bellows, Mayor ATTACHMENT 8 DATE: December 13. 1999 MOTION BY: Mulvihill CITY OF LAKEVILLE RESOLUTION RESOLUTION NO:. 99 - 290 SECONDED BY: Luck MAILBOX REPLACEMENT POLICY DURING SNOW AND ICE CONTROL SEASON WHEREAS, this resolution will replace Lakeville Resolution 92 -17, (Damaged Mailbox Replacement Policy) in its entirety, and WHEREAS, the Lakeville Street Department may inadvertently damage mailboxes and support posts by direct contact with city snowplows, and WHEREAS, the city is accepting responsibility for replacement or reimbursement for replacement of mailboxes per the following policy: • Only mailboxes actually hit, by a snowplow, will be the responsibility of the city to replace or reimburse. . • The city will not be responsible for damage to mailboxes or support posts caused by snow or ice coming in contact with the mailbox. • At the mailbox owners request, the city will. replace the mailbox with a standard size non - decorative metal mailbox and replace the support post as necessary with a minimum 4" x.4 ", decay resistant wood support post, both installed by the city, or • The city will reimburse the mailbox owner $50.00 for the replacement of the mailbox• and post by others. AND WHEREAS, replacement or option reimbursement per policy will satisfy city's responsibility for damage to mailbox. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Lakeville adopts this Resolution establishing a snow and ice season mailbox replacement policy on this 13th day of December , 1999.
