Overview
Notice of Special Assessment letters were mailed on November 6, 2012 to the property owners
who were in violation of City Ordinance 4 -1 -3 (Weed /Grass Ordinance) and Property
Maintenance Code (PMC 301.3). During the past year, the Building Inspections Department
authorized the contractual mowing of grass, removal of weeds, and property maintenance on
properties where the property owners had failed to correct the violations.
The total amount proposed to be assessed to the parcels is S10,962.18, including 18% interest
through 2013. Staff has not received any written objections from the owners of the properties
being assessed for weed /grass removal and property maintenance code violations.

RESOLUTION ADOPTING ASSESSMENT
OF WEED/GRASS REMOVAL AND PROPERTY MAINTENANCE CODE VIOLATIONS
WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met,
heard and passed upon all objections to the proposed special assessment of weed /grass removal and
property maintenance code violations.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakeville, Minnesota:
1. Such proposed Assessment No. 1290 in the amount of $10,962.18 is hereby accepted and
shall constitute the special assessment against the land named therein, and each tract of land therein
included is hereby found to be benefited by the proposed improvement in the amount of the assessment
levied against it. The Special Assessment was calculated as follows:
Contract Grass /Weed Cutting $ 8,457.42
Legal Notice Publication 45.15
Special Assessment Administrative Fee 735.00
Dakota County Special Assessment Fee 80.43
Interest 1,770.29
Total Proposed. Special Assessment $10,962.18
2. Such assessments shall be considered payable and collected with the taxes payable in 2013
and shall bear interest at the rate of 18% per annum from the date of the adoption of this assessment
resolution to December 31, 2013.
3. The owner of the property so assessed may, at any time prior to certification of the assessment
to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date
of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid
within 30 days from the adoption of this resolution. The owner may, at any time following certification,
pay to the City Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to
December 3 L of the year in which such payment is made.
4. The City Clerk shall forthwith transmit a certified duplicate of this assessment to the County
Auditor to be extended on the property tax lists of the County, and such assessments shall be collected
and paid over in the same manner as other municipal taxes. The affected parcels are as follows:

ON PROPOSED ASSESSMENTS
TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN that the
City Council will moot at 7:00 p.m. or
December 3. 2012, at the City Council
Chambers. 20190 Holyoke Avenue,
Lakeville. Minnesota, to pass upon the.
proposed assessment for the costa

tenance Code 301.3 Violations. The
areas to be assessed are within the
City of Lakeville.
The total amount to be specially

or oral objections will be considered at
the City Council meeting. No appeal
may be taken as to the amount of the
assessment unless a signed written .

An owner may appeal an assess-
ment to District Court pursuant to
Minnesota Statutes 429,081, by serv-
ing notice of the appeal upon the
Mayor or City Cleric of the City within
