HomeMy WebLinkAboutItem 06.oDecember 13, 2012 Item No. ORDINANCE AMENDING TITLE 2, CHAPTER 1 OF THE CITY CODE DECEMBER 17, 2012 CITY COUNCIL MEETING Proposed Action Staff recommends adoption of the following motion: Move to approve an ordinance amending Title 2, Chapter 1 of the City Code concerning the Planning Commission election of officers. Passage of this motion will shift the Planning Commission election of officers to coincide with the recently revised timeframe for the City Council appointment of advisory committee members from December to March. Overview Planning Department staff is recommending approval of the attached ordinance amending Section 2 -1 -4.A of the City Code to shift the election of the Planning Commission Chair and Vice Chair from their first regular meeting of the year to the first regular meeting following City Council appointment of Planning Commission members. In 2012 the City Council shifted their annual appointment of advisory committee members from December to March in order to avoid advertising for committee vacancies over the Christmas and New Year's holidays. Because the Planning Commission is the only advisory committee regulated under City Code, which is a State Statute requirement, the timeframe for their election of officers requires an amendment to the City Code in order to reflect the City Council's new timeframe for appointing advisory committee members. CITY OF LAKEVILLE DAKOTA COUNTY, MINNESOTA AN ORDINANCE AMENDING TITLE 2, CHAPTER 1 OF THE LAKEVILLE CITY CODE (THE PLANNING COMMISSION) CONCERNING ELECTION OF OFFICERS THE CITY COUNCIL OF THE CITY OF LAKEVILLE ORDAINS: Section 1. Section 2 -1 -4.A of the Lakeville City Code is hereby amended to read as follows: 1. At the first regular meeting of the year following City Council appointment of Planning Commission members, the Planning Commission shall elect a chairperson whose election must receive the confirmation of the City Council. No Planning Commission member shall serve more than three (3) consecutive years as chairperson. 2. At the first regular meeting of the year following City Council appointment of Planning Commission members, the Planning Commission shall elect a vice chairperson from those of its members and may create such other offices as it may determine. Terms of all elected offices shall be for one (1) year, with eligibility for reelection. Section 2. This Ordinance shall be effective immediately upon its passage and publication according to law.
