HomeMy WebLinkAboutItem 09January 4, 2013 Item No. Resolution Declaring a Vacancy on the City Council and Initiating the Replacement Process Proposed Action Staff recommends adoption of the following motion: Move to approve a resolution declaring a vacancy and initiating a process to fill the vacancy. Passage of this motion will result in the initiation of the process to fill a vacancy on the City Council due to the election of Council Member Little as Mayor. Overview The Council is required by State Statutes to fill vacancies on the City Council. In the case of this vacancy, less than two years remain in the term and therefore an appointment is allowed to fill the remainder of the term. Following previous practice, the City Council would provide a period of time for people to apply for the appointment through the completion of an application and for the City Council to review the applications and determine whether to interview some or all of the candidates. Staff further recommends that the City Council begin the application process on January 8, 2013, accept applications through January 24 and review the applications at the January 29 Council Work Session. Primary Issues to Consider Who is eligible to be appointed to the City Council? To be eligible for the appointment, a person must be a U.S. citizen, a resident of the city, a qualified city voter, and at least 21 years old. The City Council met in official session approximately 40 times in 2012 including special meetings and work sessions. In addition, substantial time is required to read background material in preparation for Council meetings and to meet with residents. Please indicate any problems you might have in meeting this time commitment. 10. An official conflict of interest occurs when an individual has a personal interest in a decision that he or she has the power to make. A prohibited personal interest may be contractual or non - contractual. It includes decisions in which personal involvement, gain, or financial benefit exists for the decision - maker. Thank you for your interest in serving on the Lakeville City Council. 5 CITY OF LAKEVILLE RESOLUTION NO. 12- RESOLUTION DECLARING A VACANCY ON THE CITY COUNCIL AND INITIATING THE REPLACEMENT PROCESS WHEREAS, Council Member Matt Little has been elected Mayor of the City of Lakeville; and WHEREAS, Council Member Little's term of office as Council Member expires in less than two years; and WHEREAS, The City Council is required by State Statute to fill vacancies on the City Council; and WHEREAS, the City Council wishes to initiate a process of filling the vacancy, NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby declare a vacancy on the City Council; and BE IT FURTHER RESOLVED that the City Council will accept applications from qualified persons on forms supplied through the City Clerk's office beginning on January 8, 2013.
