Passage of this motion will incorporate changes to the Zoning Ordinance that address multi - generation housing and new automobile dealership signage. Overview The Planning Commission and Planning Department staff recommends approval of the attached ordinance amending Title 11 of the City Code (the Zoning Ordinance) concerning multi - generation housing and new automobile dealership signage prepared by planning consultant Daniel Licht of TPC. The Zoning Ordinance amendment reflects Planning Commission work session discussions with representatives of Lennar (concerning multi - generation housing) and the Jeff Belzer dealership (concerning automobile dealership signage). The Planning Commission held a public hearing on the proposed Zoning Ordinance amendment at their February 21, 2013 meeting and recommended unanimous approval. There was no public comment. Staff recommends approval of the attached Zoning Ordinance amendment, which includes a modification to the multi - generation housing performance standards as recommended by the Planning Commission at their February 21st meeting. In the process of codifying the Phase 3 Zoning Ordinance amendment, which was approved by the City Council on December 3, 2012 and included the allowance of commercial dynamic display signs, Sterling Codifiers identified a glitch in that Chapter 11- 23 -17G of the Zoning Ordinance prohibits dynamic display signs. This was an oversight on staffs part. The wording included in Section 2 of the proposed Zoning Ordinance amendment corrects the oversight and is in keeping with the spirit and intent of the Zoning Ordinance amendment approved on December 3rd allowing commercial dynamic display signs. ORDINANCE NO. CITY OF LAKEVILLE DAKOTA, COUNTY, MINNESOTA AN ORDINANCE AMENDING TITLE 11 OF THE LAKEVILLE CITY CODE. THE CITY COUNCIL OF THE CITY OF LAKEVILLE, MINNESOTA ORDAINS: Section 1. Section 11 -2 -3 of the Lakeville City Code (Definitions) is hereby amended to revise the definition of a two- family dwelling to read as follows: DWELLING, TWO- FAMILY: A structure having two (2) dwelling units contiguous to each other only by the sharing of one or more common walls (without an interior connection) with each unit having a separate entrance /exit designed exclusively for occupancy by two (2) families living independently of each other. A. Duplex: A two- family dwelling with one unit above the other. B. Twinhome: A two- family dwelling with two (2) units side by side. Section 2. Section 11- 23 -17G of the Lakeville City Code (Prohibited Signs) is hereby amended to read as follows: G. Dynamic display signs, except as may be allowed by this Title and the City Code. Section 3. Section 11 -50 -11 of the Lakeville City Code (RS -1 District) is hereby amended by adding the following provisions: F. Separate living quarters that include kitchen facilities for housing multiple generations as an accessory use within a single family dwelling provided that: 1. The design and construction of the principal building is not a two - family dwelling as defined by this Title. 2. There shall be an interior connection between the main living area and accessory living quarters that is able to be unlocked from each side of the connection and that is not secured by a deadbolt or keyed lockset. 3. The principal building shall be served by single municipal water, sanitary sewer, gas and /or electric utility service lines each with a single meter for the respective utility where applicable. 4. The principal building shall have one (1) heating and air conditioning system. 5. The property shall have one (1) postal address. 6. There shall be three (3) garage stalls having directed exterior access (not in a tandem arrangement) attached to the principal building with a driveway access in front of each stall so as to allow direct vehicle maneuvering to each of the stalls. Section 11 -72 -7M of the Lakeville City Code (C -2 District) is hereby amended by adding the following provisions: 7. Notwithstanding the provisions of Section 11- 23 -19.E of this Title, signs for new passenger vehicle automobile sales uses allowed under this Section shall be subject to the following provisions: a. Freestanding sign(s): One (1) freestanding sign shall be allowed for each manufacturer for which the motor sales use is franchised to conduct new unit sales of one or more brands within the principal use. b. Wall, Canopy, Or Marquee Sign(s): (1) The total area of all wall signs shall not exceed four hundred forty (440) square feet or in the case of a corner lot or through lot the total area of all walls signs shall not exceed five hundred four (504) square feet. (2) Number and area of individual wall signs shall be in accordance with the following: (a) One (1) wall sign not to exceed sixty four (64) square feet on one (1) facade fronting a public street, or in the case of a corner lot or through lot, one (1) additional wall sign not to exceed sixty four (64) square feet may be installed on a facade either fronting a public street or that which is the front entry of the principal building. (b) One (1) additional wall sign not to exceed sixty four (64) square feet shall be allowed for each manufacturer brand for which the motor sales use is franchised to conduct new unit sales within the principal use with such sign to be installed on one (1) facade either fronting a public street or that which is the front entry of the principal building. (c) Additional secondary wall signs shall be allowed on any facade provided that the total area of all secondary wall signs shall not exceed one hundred twenty (120) square feet and the area of any one secondary wall sign shall not exceed sixteen (16) square feet to be located directly above or to the side of an exterior entrance. Zoning Ordinance Amendment Chair Lillehei opened the public hearing to consider an amendment to Title 11 (the Zoning Ordinance) of the Lakeville City Code concerning automobile dealership signage and multi - generation housing. The Recording RSecretary attested that the legal notice had been duly published in accordance witty State Statutes and City Code. Daniel Licht, The Planning Company, presented the Zoning Ordinance amendment. Mr. Licht stated that on December 6, 2012' the Planning Commission met with Lennar representatives at a work session" to review their plans for multi,- generation housing that includes an accessory living area within "a'single family dwelling. On 6 December 2012, the Planning Commission met with representatives of Lennar to review their plans for multiple generation housing that includes an accessory living area within a single family dwelling. On 17 January 2013, the Planning Commission met with representatives of the Jeff Belzer's automobile dealerships to discuss signs required by the manufacturers for the separate new vehicle franchises located within the two principal buildings. The Planning Commission directed City staff to proceed with drafting amendments to the Zoning Ordinance to address these two issues for consideration. Exhibits: A. Draft Zoning Ordinance Amendment B. Example of Multiple Generation House Plans ANALYSIS Multiple Generation Housing. Lennar has adapted an existing single family housing plan to provide opportunity to cohabitate multiple generation families within one dwelling. Within the Lennar product, the additional quarters consists of separate living /dining, bedroom and bathroom areas that are connected to the main living area by a doorway. There is also a direct exterior entrance to the additional quarters. The additional living quarters may also include additional kitchen and /or laundry facilities. From the exterior, the design and construction of the building is undistinguishable from a single family dwelling. From a regulation standpoint the multiple generation house is difficult to define separate from a single family dwelling. However, the integration of the additional quarters within the principal building, especially with allowance of separate kitchen facilities, has potential to be used illegally as a two- family dwelling and thereby creating the potential for compatibility issues within a single family neighborhood. City staff is proposing that the multiple generation house having kitchen facilities be allowed by administrative permit within RS -1, RS -2, RS -3, RS -4, RST -1, RST -2, RM -1 and RM -2 Districts. Approval of an administrative permit would require compliance with performance standards intended to address (and allow enforcement of) the following: ■ The building cannot be modified so as to be classified as a two- family dwelling that are truly separate housing units which would be determined based on a revised definition of two- family dwelling and the following criteria: o Provision of an interior connection between the main living area and accessory living quarters. o A requirement that the interior connection cannot be locked from one side of the connection (a typical bathroom door handle with a lock can be opened from both sides). ■ The property shall have single connections for municipal water, sanitary sewer, gas and electric utilities, a single postal address and a single heating and air conditioning system. ■ There is attached garage parking for three vehicles with direct exterior access with adequate driveway to ensure adequate off - street parking and space for maneuvering within the property. Automobile Sales Uses. At the work session on 17 January 2013, the Planning Commission discussed the requirements of new automobile manufacturers for signs at their franchised dealer locations, which are allowed only in the C -2 District as a conditional use. The consensus of the Planning Commission was that new automobile sales uses have unique signage needs in cases where a single principal building is used for sales of multiple vehicle brands. The Planning Commission also recognized that the City has in the past incorporated signage allowances within the Zoning Ordinances for specific land uses such as motor fuel facilities, convenience food restaurants and grocery stores. City staff has drafted proposed language to be included in Section 11- 72 -7.M of the Zoning Ordinance to establish sign standards specific to new automobile sales uses. The proposed sign standards address the following issues in consideration of the signage plans submitted by Jeff Belzer's: ra One freestanding sign is allowed for each new vehicle manufacturer. Multiple brands made by each manufacturer would need to be identified on a single sign. The area and height of the freestanding sign would be up to 100 square feet and 20 feet tall the same as allowed for other C -2 District uses. Proposed wall sign provisions are based on existing language within the Zoning Ordinance regarding principal buildings having a gross floor area of 45,000sf. or larger (that would apply the Jeff Belzer's dealership): o Limit the total potential area of all wall signs to 440 square feet for interior lots and 504 square feet for corner lots. o One sign up to 64 square feet that would allow the dealer name on one fagade or two facades for a corner /through lot. o One additional sign up to 64 square feet for each new vehicle brand franchise. o Secondary signs up to a total of 120 square feet and 16 square feet for individual signs allowed to address "certified service ", "body shop ", "express lube ", etc. type signs. CONCLUSION A public hearing has been noticed for 21 February 2013 to consider the proposed amendments attached hereto. City staff recommends approval of the proposed Zoning Ordinance amendments making allowance for multiple generation housing and establishment of sign regulations specific to new automobile sales uses within the C -2 District. Others Present: Jeff Belzer, Jr. and Mike Belzer, Belzer Chevrolet/Dodge /Ram /Kia; Todd Bornhauser, Lakeville Area Chamber of Commerce; and Laura Adelmann, Sun ThisWeek newspaper. =* Belzer Auto Dealership Sianaae Jeff Belzer, Jr. presented their request to allow additional wall signs at the Belzer auto dealership located at 21111 Cedar Avenue to meet the branding requirements for their multiple dealerships. The request includes five signs on the east wall of the north (Dodge /Ram /Kia) building facing Cedar Avenue — two Jeff Belzer's signs, one over each of the two showroom entryways, and a Dodge, a Ram, and a Kia brand sign. He stated that they are willing to eliminate the north facing wall sign and possibly the certified used car pylon sign in order to be allowed the additional east facing wall signs. Mr. Morey provided a brief history of the Belzer auto dealership PUD -CUP approved in 1990 that allowed an expansion of the dealership facility and included the allowance of five freestanding signs along with a reduction in the number of site non - conformities. He stated that because PUDCUPs are no longer allowed in the C -2 District, the existing freestanding signs are considered legal, non - conforming. Mr. Morey reviewed options the Planning Commission may consider in response to this request. Planning Commissioners asked if the number of wall signs could be reduced or if the Dodge and Ram wall signs can be placed near each other on the same side of the showroom entry in order to meet Zoning Ordinance requirements for a commercial building greater than 45,000 square feet. Mr. Belzer replied that neither of these options would work due to the branding requirements they have to follow for each of the three manufacturers they have at this location. Planning Commission Work Session Minutes - January 17, 2013 Page 2 The Planning Commission agreed that car dealers are a unique commercial use that have changed over time in terms of franchising /branding and should have specific sign standards, especially in the case of multiple brand (or franchise) dealerships. The Planning Commission selected amending the Zoning Ordinance specific to auto dealerships as the preferred option of those listed in the January 11, 2013 planning report. The suggested the Zoning Ordinance amendment include a maximum number of wall signs as well as both individual wall sign size maximums and a cumulative wall sign maximum. Commercial /Industrial Park Dedication Mr. Licht presented the findings of the appraiser hired by the C/in-n termine the average fair market value of undeveloped commercial, industrffice land included in the January 10, 2013 report from Jason Messner o Messn odd & Brumm. While the appraiser's findings support an increase rk de ation fee for commercial and industrial subdivisions, City staff recommein on of the past practice of requiring lower park dedication fees for comm dustrial subdivisions as an incentive to encourage such developmentsr, City staff recommends an annual review of the commercial and industriedication fees by the City Council as part of the budget process. Mr. Licht reminded the Planning Commission of the resid ial park dedication study and subsequent Subdivision Ordinance amendment c erning residential park dedication requirements that was completed in 201 a also reminded the Planning Commission that the methodology used for deter ing commercial, industrial and residential park dedication must be consistent State Statute. Mr. Licht noted that on a 4 -3 vote at their nuary 16, 2013 meeting, the Parks, Recreation and Natural Resources Co ittee recommended that the commercial and industrial park dedication fees not b hanged in 2013 and an increase in the commercial and industrial park d cation fees be phased in over subsequent years with an initial 5% increase in 2Y4 if justified based on the current market value information and the recom nIffided methodology for determining park dedication fees. The Economic Develo I pAent Commission will review the commercial and industrial park dedication at their J the uary 22, 2013 meeting. The City Council will consider all of the advisory board r mmendations concerning commercial and industrial park dedication at their Febru 25, 2013 work session. The Pla g Commission concurred with staffs recommendation. They agreed that decisi s regarding funding for the development of the park and trail system should be ma by the City Council based upon annual budget considerations and should not be automatic annual increase. CITY OF LAKEVILLE PLANNING COMMISSION WORK SESSION MINUTES December 6, 2012 Chair Lillehei called the work session to order at 6:45 p.m. Members Present: Chair Brooks Lillehei, Vice Chair Bob Boerschel, Bart Davis, Karl Drotning, Gerry Grenz, Linda Maguire, Paul Reuvers, and ex- officio Shawn Fitzhenry. Members Absent: None. Staff Present: Daryl Morey, Planning Director and Allyn Kuennen, Associate Planner. Others Present: Mike Sterns and Joe Jablonski, Lennar. �> Multi- Generational Housing Planning Director Daryl Morey introduced discussion on the topic of multi - generational housing. Joe Jablonski of Lennar made a Power Point presentation on multi - generational housing which included a short video describing their NextGen multi - generational home. Mr. Jablonski stated that Lennar would like to provide their NextGen home as a housing option in Lakeville. The Planning Commission agreed that the multi - generational housing structure should have single gas, electric, and other utility services to the structure and also a single address in order to prevent it from becoming a multiple family dwelling at a future date. Access to the basement for storm shelter purposes was also raised as a concern. Following the discussion, the Planning Commission directed staff to review the current definition of Family in the Zoning Ordinance to determine if it would allow the Next Gen home or a similar multi - generational housing product. If not, the Planning Commission directed staff to work with the City Attorney and the City's planning consultant to modify the definition of Family such that it would allow this type of multi - generational housing but incorporating the criteria discussed at tonight's work session. MUSA Expansion Area A Study :Council ssociate Planner Allyn Kuennen presented hi er 29 report regarding the USA Expansion Area A study. n stated that staff prepared a study for USA Expansion Are , similar to the study prepared in 2005, and the City de ' o open MUSA Expansion Area A for development due to the surplus e land and the reduced absorption rate caused by the downturn in the
