CITY COUNCIL MEETING MINUTES
March 18, 2013
Mayor Little called the meeting to order at 7:02 p.m. in the Council Chambers at City Hall.

5. Presentations /Introductions
Brett Altergott presented the Parks & Recreation January/February monthly report.
Chief Vonhof presented the February Police Department monthly report.
Chief Vonhof introduced Police Officer Sara Brockman. Mayor Little administered the oath
of office.
Kevin McCarney requested the City Council proclaim May 2, 2013 National Day of Prayer
in Lakeville. Council Member Swecker read the proclamation.
6. Consent Agenda
Motion was made by Anderson, seconded by Swecker to approve the consent agenda items
as follows:
a. Claims for payment
b. Minutes of the March 4, 2013 City Council meeting
c. Minutes of the February 25 and March 11 Council work sessions
d. Agreement with Daniel and Lisa Turbes for flood insurance reimbursement

7. Schedule Public Assessment Hearing for Improvement Project 13 -02
The Public Works Director and consulting engineer, Monica Heil, provided a brief
overview of Improvement Project 13 -02. Bids for the project were opened on March 8` and
assessments were calculated. The City's share of the cost for street and storm sewer
improvements will be financed with the issuance of General Obligation Improvement
Bonds. The water main improvements will be financed from the Water Operating Fund. A
portion of the sanitary sewer improvements will be funded using inflow and infiltration
mitigation grant dollars received from the Metropolitan Council Environmental Services.
Ms. Heil explained that the estimated project cost as listed in the feasibility report was $8.5
million. Based on the low bid prices received, the total cost for this project is expected to be
$7.419 million. This represents a 12.8% reduction in the overall project cost. Ms. Heil
outlined the proposed assessments based on the bid results, broken down by each
geographic location (Valley Park, 204 Street, Isle Avenue cul -de -sac and Clay's Acres). A
public assessment hearing will be held at the April 15 City Council meeting. Mr. Petree
explained that a second neighborhood meeting has been scheduled with each neighborhood
group to address any concerns the residents may have prior to the assessment hearing.
Motion was made by LaBeau, seconded by Swecker to approve Resolution No. 13 -23 calling
a public hearing on proposed assessments for City Improvement Project 13 -02.

8. Second Amendment to Contract for Private Development with ImageTrend L.L.C.
Mr. Olson presented a proposed amendment to the Contract for Private Development with
ImageTrend L.L.C. He explained that the City Council approved a Contract for Private
Development with ImageTrend in 2009 that authorized the sale to ImageTrend of a City -
owned 3.39 acre lot adjacent to their existing building in the Fairfield Business Campus. He
explained the terms of that contract, which required ImageTrend to pay one third of the
purchase price. The remaining two thirds would be forgiven if certain expansion
improvements occurred. The first phase expansion was required to be completed by the
end of 2011. Mr. Olson reported that the company has completed its first phase expansion
of 27,000 square feet and has created 46 new jobs, which is more than double the number
required under the contract. ImageTrend has the capacity to add an additional 100
employees in their existing building over the next three years. As a result, the company will
not need additional office space until the end of 2015 and, thus, is requesting an amendment
to the current Contract for Private Development to extend the completion date from
November 30, 2013 to December 31, 2015.
ImageTrend President Mike McBrady provided a detailed overview of the history and
growth of his company, as well as the nature of his business and the ImageTrend culture.
The company currently employs 146 people.
Mr. Olson explained that the City's interests in the property are secured by a mortgage and a
promissory note, as provided in the Contract for Private Development dated August 3, 2009.
Motion was made by LaBeau, seconded by Anderson to approve the Second Amendment to
the Contract for Private Development with ImageTrend Development, L.L.C.
