HomeMy WebLinkAboutItem 03Memorandum City of Lakeville Planning Department To: Mayor and City Council From: Daryl Morey, Planning Director Date: April 19, 2013 Subject: April 22, 2012 City Council Work Session - Superamerica Minor Variance Representatives for the Superamerica motor fuel facility located at 16161 Cedar Avenue are requesting approval of a minor variance for a reduced setback from the permanent trail, drainage and utility easement obtained by Dakota County as part of the Cedar Avenue BRT project. The improvements included in this minor variance request are: • Freestanding (monument) sign • Parking lot drive aisle • Underground fuel tanks • Fuel tank vent pipes and protective wall • Light and flag poles Chapter 11 -6 -7 of the Zoning Ordinance outlines the procedure for processing minor variance requests. A minor variance provides an expeditious method of processing variance requests that does not require a public hearing or recommendation from the Planning Commission. The City Council has the option to hold a public hearing if deemed necessary. In 2011, the City Council approved minor variances for Ole Piper Inn and South Twin Cities Church of Christ for a reduced setback for their freestanding signs due to the public action created by the Cedar Avenue BRT project. A public hearing was not required for either of these variance requests, which were approved by the City Council on the consent agenda. The subject property is involved in a condemnation commissioners hearing and the City's granting of the minor variance could have an impact on this case. As such, there is time sensitivity with this variance application and the Superamerica representatives are requesting feedback from the City Council as to whether or not a public hearing will be required. Staff does not feel that a public hearing is necessary in this case in that the above mentioned improvements were in place prior to Dakota County obtaining the additional easement area.
