HomeMy WebLinkAbout02-21-13CITY OF LAKEVILLE PLANNING COMMISSION MEETING MINUTES February 21, 2013 Chair Lillehei called the meeting to order at 6:00 p.m. in the Council Chambers at City Hall. The pledge of allegiance to the flag was given. Members Present: Linda Maguire, Bob Boerschel, Chair Brooks Lillehei, Bart Davis, Gerry Grenz, Karl Drotning Members Absent: Paul Reuvers, Ex- officio member Shawn Fitzhenry Others Present: Daryl Morey, Planning Director; Daniel Licht, The Planning Company; and Penny Brevig, Recording Secretary 3. Approval of the Meeting Minutes Commissioner Davis' name appeared in both the Members Present and Members Absent section of the February 7, 2013 Planning Commission meeting minutes. He will be removed from the Members Present. The February 7, 2013 Planning Commission meeting minutes were approved as amended. 4. Announcements Mr. Morey stated that the following items were distributed to the Planning Commission at tonight's meeting: A. Amended February 7, 2013 Planning Commission minutes (removing Commissioner Davis from Members Present). B. Amended draft Zoning Ordinance Amendment. C. E -mail from Commissioner Reuvers congratulating Commissioner Davis on his appointment to the City Council, thanking Commissioner Boerschel for his willingness to serve on the City Council, and comments regarding the multiple generation housing text amendment. Mr. Morey stated that as long as tonight's Zoning Ordinance amendment agenda item does not get tabled, the March 7, 2013 Planning Commission meeting will be cancelled due to a lack of agenda items. The next Planning Commission meeting is scheduled for March 21. Mr. Morey congratulated Commissioner Davis on his appointment as the new City Council member and thanked him for his six years of service on the Planning Commission, including three years as the Chair. Commissioner Davis thanked City staff and the other members of the Planning Commission for all their efforts and support over the past six years. 5. Zoning Ordinance Amendment Chair Lillehei opened the public hearing to consider an amendment to Title 11 (the Zoning Ordinance) of the Lakeville City Code concerning automobile dealership signage and multi - generation housing. The Recording Secretary attested that the legal notice had been duly published in accordance with State Statutes and City Code. Daniel Licht, The Planning Company, presented the Zoning Ordinance amendment. Mr. Licht stated that on December 6, 2012 the Planning Commission met with Lennar representatives at a work session to review their plans for multi - generation housing that includes an accessory living area within a single family dwelling. The Planning Commission also met with Jeff Belzer's automobile dealership representatives at a work session on January 17, 2013 to discuss the signs required by the manufacturers for their separate new vehicle franchises. Mr. Licht indicated that the Planning Commission directed City staff to proceed with drafting amendments to the Zoning Ordinance to address these two issues for consideration. Mr. Licht explained what multi - generation housing consists of and how it is proposed to be regulated. He indicated that City staff is proposing that multi - generation housing be allowed by administrative permit within the RS -1, RS -2, RS -3, RS -4, RST -1, RST -2, RM -1 and RM -2 Districts. Mr. Licht stated that by requiring an administrative permit, it would require compliance with specific performance standards, which are listed in the February 14, 2013 planning report, and include single connections for municipal water, sanitary sewer, gas and electric utilities, a single postal address and a single heating and air conditioning system, along with an interior connection that is able to be unlocked from each side of the connection and that is not secured by a deadbolt or keyed lockset. Mr. Licht pointed out the modified wording recommended by the City Attorney that was distributed to the Planning Commission at tonight's meeting concerning one of the performance standards for multi - generation housing. Mr. Licht stated that regarding the automobile dealership signage, the Planning Commission consensus from the January 17, 2013 work session was that new automobile sales uses have unique signage needs in cases where a single principal building is used for sales of multiple vehicle brands. He indicated that the Planning Commission also recognized that the City has in the past incorporated signage allowances within the Zoning Ordinances for specific land uses such as motor fuel facilities, convenience food restaurants and grocery stores. Planning Commission Meeting Minutes, February 21, 2013 Page 3 Mr. Licht reviewed the proposed sign standards that are listed in the February 14, 2013 planning report. Mr. Licht stated that staff recommends approval of the proposed Zoning Ordinance amendment making allowance for multi - generation housing and establishment of sign regulations specific to new automobile sales uses within the C -2 District, as amended. Chair Lillehei opened the hearing to the public for comment. There were no comments from the audience. Motion was made by Maguire, seconded by Davis to close the public hearing at 6:12 p.m. Ayes: Maguire, Boerschel, Lillehei, Davis, Grenz, Drotning. Nays: 0 Chair Lillehei asked for comments from the Planning Commission. Discussion points were: • There was discussion regarding kitchen facilities, utility meters, and door locks for the internal access within the multi - generation housing unit and how to prevent the multi - generation homes from becoming two - family dwellings. • The Planning Commission felt that multi - generation housing will be a great addition to the City's housing supply. • The Planning Commission discussed the difference between an automobile manufacturer and an automobile brand in relation to the proposed automobile dealership signage standards. • Reiterated that the signage amendment is specifically for automobile dealerships selling new cars. After their discussion, the Planning Commission agreed on the following amendments to the Zoning Ordinance Amendment, under Sections 11- 50 -11, 11 -51- 11, 11- 52 -11, 11- 53 -11, 11- 56 -11, 11- 57 -11, 11- 58 -13, and 11- 59 -13, numbers 2 and 3: 2. There shall be an interior connection between the main living area and accessory living quarters that is able to be unlocked from each side of the connection and that is not secured by a deadbolt or keyed lockset 3. The principal building shall be served by single municipal water, sanitary sewer, gas and /or electric utility service lines with a single meter for each utility where applicable Planning Commission Meeting Minutes, February 21, 2013 Page 4 Motion was made by Davis, seconded by Drotning to recommend to City Council approval of the Zoning Ordinance Amendment concerning automobile dealership signage and multi - generation housing, as amended. Ayes: Boerschel, Lillehei, Davis, Grenz, Drotning, Maguire.
