HomeMy WebLinkAbout04-15-13CITY OF LAKEVILLE CITY COUNCIL MEETING MINUTES April 15, 2013 Mayor Little called the meeting to order at 7:00 p.m. in the Council Chambers at City Hall. Members Present: Mayor Little, Council Members Davis, Anderson and LaBeau Members Absent: Council Member Swecker Staff Present: Steve Mielke, City Administrator; Roger Knutson, City Attorney; Tom Vonhof, Police Chief; Chris Petree, Public Works Director; David Olson, Community & Economic Development Director; Dennis Feller, Finance Director; Brett Altergott, Parks & Recreation Director; Daryl Morey, Planning Director; Charlene Friedges, City Clerk 3. Citizen Comments: None 4. Additional Agenda Information: None 5. Presentations /Introductions Glen Starfield and Colleen LaBeau, Taste of Lakeville Co- chairs, provided information regarding the upcoming Taste of Lakeville event. Brett Altergott asked the City Council to proclaim April 27, 2013 Arbor Day in the City of Lakeville. Council Member Anderson read the proclamation. Council Member LaBeau asked what Lakeville is doing to prevent the possible spread of the emerald ash borer. Mr. Mielke stated this issue will be discussed with the Council as part of the 2014 budget. Mr. Altergott presented the March Parks & Recreation Department monthly report. Chief Vonhof presented the Police Department 2012 Annual Report. 6. Consent Agenda Motion was made by Anderson, seconded by LaBeau to approve the consent agenda items as follows: a. Claims for payment b. Minutes of the April 1, 2013 City Council meeting c. Minutes of the March 25, 2013 Council work session City Council Meeting Minutes, April 15, 2013 Page 2 d. Extension of on -sale liquor license for Teresa's Mexican Restaurant to allow the sale of alcohol and live entertainment in the fenced -in area of the parking lot on May 5, 2013 e. Reschedule the May 13 Council work session to Tuesday, May 28, 2013 f. Autumn Meadows preliminary plat extension g. Resolution No. 13 -33 approving preliminary and final plat of Shady Oak Grove Fourth Addition h. Tree work license for Slibe's Tree Authority i. Joint Powers Agreement with Dakota County for engineering, highway construction and traffic signal revisions at the intersection of 162nd Street (CSAH 46) and Kenrick Avenue j. Resolution No. 13 -34 accepting bids and awarding contract for the partial reroofing of Lakeville Liquors Kenrick k. Resolution No. 13 -35 rescheduling the public hearing on proposes assessments for Improvement Project 13 -02 to May 6, 2013 Roll call was taken on the motion. Ayes - Davis, Little, Anderson, LaBeau 7. Public Hearing to Certify Delinquent Utility Accounts Mayor Little opened the public hearing to certify delinquent utility accounts. The city clerk attested to notices being duly published and mailed. Mr. Feller presented the list of accounts proposed to be certified. The total amount delinquent is $2,975.51. The City also collects a $35 service charge and 18% interest. Therefore, the total amount proposed to be certified is $5,037.31. Mr. Feller explained that there are 25 accounts being certified. These represent only those accounts that have been closed. All other delinquent accounts will be certified in the fall. There were no questions or comments from the audience. Motion was made by LaBeau, seconded by Davis to close the public hearing on the certification of delinquent utility accounts. Roll call was taken on the motion. Ayes - Little, Anderson, LaBeau, Davis Motion was made by LaBeau, seconded by Anderson to approve Resolution No. 13 -36 certifying unpaid water, sanitary sewer and storm sewer charges to the County City Council Meeting Minutes, April 15, 2013 Page 3 Treasurer /Auditor to be collected with other taxes on said property and assessing unpaid street light charges. Roll call was taken on the motion. Ayes - Anderson, LaBeau, Davis, Little 8. MOM Brands Conditional Use Permit Pauline Wiegrefe, representing MOM Brands, requested approval of a conditional use permit to allow multiple principal buildings on one lot. She explained that MOM Brands is planning to relocate its corporate headquarters to Lakeville. MOM Brands purchased the former New Morning Windows property (referred to as the East Building), which is located adjacent to their existing Technical Center (West Building). MOM Brands is in the process of renovating the East Building by converting former warehouse and manufacturing space into two -story office space. They are proposing parking and other site improvements to create a campus atmosphere between the two buildings. By later this summer, after the relocation has been completed, there will be approximately 350 employees at this location. Mr. Olson presented the planning report for the proposed conditional use permit. He stated the zoning ordinance does allow for multiple principal buildings on one parcel with approval of a conditional use permit. He explained how truck traffic will navigate the site. He also pointed out that MOM Brands is proposing additional rain gardens to assist in storm water management. Motion was made by Davis, seconded by Anderson to approve findings of fact and a conditional use permit for MOM Brands to allow multiple principal buildings on one lot of record in the O -P, Office Park, District.
