Olson, Community and Economic Development Director Copy: Adam Kienberger, Economic Development Specialist Chris Petree, Public Works Director Brett Aitergott, Parks and Recreation Director Mike Meyer, Fire Chief Date: May 24, 2013 Subject: Review of the ADA Accessibility Study and City Hall Door Improvements The City's approved 2013 application for Community Development Block Grant (CDBG) funds to the Dakota County CDA included an amendment to use previously allocated CDBG funds to study and fund accessibility improvements to City Buildings under the Americans with Disabilities Act (ADA). The City entered into an agreement with Wold Architects and Engineers to complete the attached draft ADA Compliance Study on five City Buildings including City Hail, Water Treatment Facility, Central Maintenance Facility, Fire Station 4 and the Arts Center. Wold visited each of these sites and reviewed existing interior and exterior conditions to determine points of non - compliance. Points of non - compliance were documented and prioritized as High, Medium, or Low along with an estimated cost for bringing these identified areas into compliance. Joel Dunning of World Architects and Engineers will be present at the Work Session to present the results of the study. It should be noted that while the study identifies points of non - compliance with the ADA, these recommended improvements are not required by the Minnesota Building Code. A copy of the draft study is attached. In addition, Wold prepared plans and specifications for the installation of power- assist doors with electronic entry access at the entrances to City Hall that has been identified as a high priority by staff and City Council. Initially estimated to cost approximately $30,000, Wold received one qualified bid for the project in the amount of $52,293.79 from Pro -Tec Design. Attached is a letter from Wold recommending the City enter into a contract with Pro -Tec Design at this amount based on additional research and communication they have had with other vendors. Since the entire project is being funded by CDBG funds Wold has ensured compliance with federal HUD regulations in soliciting quotes for these improvements. There is sufficient funding available within the CDBG program to allocate the funds necessary to enter into an agreement with Pro -Tec Design for the quoted amount of $52,293.79 Action Requested: Staff is requesting comments and feedback from the Council on the draft version of the Accessibility Study and the proposal from Pro -Tec Design for the City Hall door improvements. Recommendations 21 WQL City of Lakeville ADA Compliance Study Report May 28, 2013 INTRODUCTION Wold Architects & Engineers was hired in March of 2013 by the City of Lakeville to conduct a study at five city facilities to determine compliance with the standards established in the Americans with Disabilities Act (ADA). The city facilities included the City Hall, Fire Station #4, the Central Maintenance Facility, the Water Treatment Facility and the Lakeville Arts Center. Wold's team observed the facilities, by visiting each of the five sites and reviewing conditions, Interior and exterior, to determine points of non - compliance. Points of non - compliance were documented and categorized into the four categories as follows 1. Approach & Entrance: Elements outside of the building such as quantity, size and identification of parking stalls, curb ramps, sidewalks, and building entrances. 2. Access to Goods & Services: Elements on the circulation oath within the building in both public and staff areas, including signage, clear circulation paths, access to doors, operability of doors, and public service counters. 3. Toilets: Quantity, size and availability of toilet rooms meeting the guidelines of the ADA. 4. Additional Access: Public telephones, drinking fountains, kitchen /break areas, locker rooms, showers, and other miscellaneous items not covered previously. Once all of the existing conditions of non - compliance were compiled, Weld's team developed options for remedying the non - conforming conditions in each facility. Issues of non - compliance were reviewed and prioritized by city staff with Weld's assistance. Cost estimates were then developed for each solution. Based upon the observed conditions and Wold's proposed remedies, a preliminary list of recommendations has been developed to resolve the current facility Issues related to non - compliance with the Americans with Disabilities Act and are presented in this report. It is important to note that since the passage of the Americans with Disabilities Act in 1990, guidelines have evolved over time. In all likelihood, either the initial construction or subsequent remodeling of each of the five buildings was designed and built in a manner that met the intent of the Minnesota State Building Code and its adoption of accessibility guidelines of the time. None of the issues presented in this report are required by building code to be remedied on its own. Proposed Correction: Restripe the accessible stalls and aisles in the parking lot. Estimated Cost. $500 Priority: High 2. The access aisles of the two accessible parking spaces on the west side of the building do not connect directly to an accessible route into the building. Proposed Correction: Install an ADA compliant curb ramp directly between the accessible aisle and the sidewalk. Estimated Cost. $2.000 Priority: Low 3. Inaccessible entrances do not have signage directing the public to an accessible entrance. Proposed Correction: Install signage directing the public from the west and north doors to the main entrance. Estimated Cost: $500 Priority: High 4. Exterior doors at each of the three entrance vestibules require more than 8lbs of force to open them. Proposed Correction: Install power assist door openers and security at each of the exterior vestibules. Estimated Cost. $52,000 Priority: High CATEGORY 2 — ACCESS TO GOODS & SERVICES Several items that are mounted higher than 27" and lower than 80" protrude more than 4" into the accessible route within the City Halls corridors including: a. A portable Defibrillation pack near the main entry projects 5 Y2" from the wall. b. The Fire Alarm annunciator panel projects 5" from the wall. c. The boiler shutdown button projects 5" from the wall. Proposed Correction: Either incorporate the item into a recessed niche or construct a bump out below the item to warn visually impaired persons of the danger. The ramped access to the dais level of the council chambers does not provide the required 60" landing at the top of the ramp. Proposed Correction. Reconstruct the ramp in the council chambers to provide an additional 8" of landing at the top of the ramp. Estimated Cost $2,000 Priority: Low 3. Signs designating permanent rooms are required to be mounted on the latch side of the door. This does not occur at Rooms 200, 201, 203, 300, 405, 500 and 804. Proposed Correction: Relocate signs to latch side of door and patch /refinish the wall at former loeatl[`/Il. Estimated Cost: Internal Priority: Low 4. If there is a front approach to the pull side of the door, there is required to be 18" of maneuvering clearance beyond the latch side of the door. This does not occur at Doors 105, Proposed Correction: Install a power assist door opener at Door 105 or remodel to provide required clearances: Estimated Cost: $4000 Priority: Low 5. Several doors are equipped with knob hardware requiring a tight grasp and not meeting ADA requirments, including doors 201, 202, 203, 302, 303, 305, 317B, 405, 406, 702, 704, 801, 803, 901, 902, Inspections Storage, and Finance Vault, Proposed Correction. Replace with lever based hardware. Estimated Cost $6,800 Priority: High 6. Several doors with closers installed exceed the maximum required force of 5 Ibs needed to open the door. Proposed Correction: Re- adjust the closers to reduce the required opening force. Estimated Cost: Internal Priority: 111-711111111111111 Public service counters are required to have a section at least 36" long to be no higher than 36" tall. The public service counters at the lobby receptionist, City Administration, Inspections, Engineering and Parks & Recreation do not comply with this requirement. Proposed Correction. Remodel the public service counters at these locations to provide compliance. The main public toilets near the Council Chambers are not accessible. The following items are including in this statement: a. The drinking fountains prevent the clear path of entry into both the men's and women's toilets. b. There is not 18" on the latch side of the pull approach to the entry doors into both the men's and women's toilets. c. The entry doors cannot be opened with 51bs of force. d. The entry doors close faster than the required 5 seconds. e. The coat hook in each toilet is mounted higher than the maximum of 48 ". f. Lavatory waste pipes are not Insuiateu. g. Toe clearance under lavatories is not kept within 6" of the wall. h. The accessible toilet compartments do not include a 60" clear width. i. Size, location and quantity of grab bars within the accessible toilet compartment do not comply. Proposed Correction: Either remodel the main toilets or provide accurate signage directing the public to the accessible toilets beyond the Community Development offices. Estimated Cost, $600 for signage or $36, 000 for remodeling Priority: High for signage or Low for Remodeling CATEGORY 4 — ADDITIONAL ACCESS 1. The standard drinking fountain near Community Development is mounted too high. Proposed Correction: Adjust the mounting ,height of the drinking fountain down I ". The sink unit has a counter that is 36" high with no front approach (roll under) ability. b. All three microwaves are mounted in upper casework above the 48" maximum height limitation. Proposed Correction: Modify casework to provide a roll under, front approach sink unit with a 34" high counter. Signage marking the location of the two accessible, public parking spaces at the main entry is installed with the bottom of the sign 48" above the ground in lieu of the 60" required. Proposed Correction: Reinstall the existing signage on new posts at the required height. Estimated Cost: Internal Priority: Medium CATEGORY 2— ACCESS TO GOODS & SERVICES 1. interior signs designating permanent rooms have several issues of non - compliance, including: a. At eight locations at the recently remodeled Fire Administration area including the fitness room, conference room and several offices, there is no ADA compliant signage. b. At seven locations, including the existing offices near the entry and several locations in the hallway between the front lobby and the Electrical /Mechanical room, there is ADA compliant signage that is installed at the wrong height. c. The two staff toilets in the northwest corner of the facility do not have ADA compliant signage. Proposed Correction. Install new, uniform, ADA compliant signage throughout the building. Estimated Cost: $3,400 Priority: High 2. If there is a front approach to the pull side of the door, there is required to be 18" of maneuvering clearance beyond the latch side of the door. This does not occur at the door at the east end of Hallway 103 and the door into the Women's Locker room. Proposed Correction. Install a power assist door opener at each location. Estimated Cost: $8,000 Priority: Low 3. The door from the Fitness to Back Hall automatically closes from 90 degrees to 12 degrees faster than the required 5 seconds. Proposed Correction: Re- adjust the closers to slow the closing of the door. Estimated Cost: Internal Priority: High 4. Benches within the men's and women's locker rooms are not between 20" — 24" wide. Proposed Correction: If more than Fire Personnel are allowed to use this, then install a new bench in each locker room which meets the size and height requirements. Public service counters are required to have a section at least 36" long to be no higher than 36" tall. The public service counters at the lobby receptionist are components of the systems furniture and not permanently built in, but do not currently comply with this requirement. Proposed Correction: Replace the furniture panel and transaction counter on one or both reception workstations to meet height requirements. Estimated Cost $1,600 Priority: Medium CATEGORY 3 — TOILET ROOMS 1. The most toilet rooms most likely to be used by the public are the single stall toilets in the northwest corner of the facility. These were formerly private restrooms off of fireman or paramedic sleeping rooms and were therefore allowed to be not compliant with the ADA. There are numerous issues, including the following: a. There is not compliant signage at each restroom entry door directing people to the nearest accessible toilets in the fitness locker rooms. b. There is not a 30" x 48" clear floor space beyond the swing of the door in either restroom c. The lavatory does not have a 27" high (minimum) clear space under for a minimum depth of 8" to allow for knee space for a wheel chair bound person due to the base cabinet that each sink is mounted on. d Soap dispensers are mounted higher than the maximum of 48 ". e. The paper towel dispenser is mounted higher than the maximum of 48 ". f. Lavatory waste pipes are not exposed and therefore not insulated. g. Clearance around the toilet fixture in each bathroom is less than the required 60" width. h. The height of the seat of each toilet is less than the 17 " -19" requirement. i. Grab bars are not installed in either restroom. Proposed Correction: Install ADA compliant signage with Braille and raised contrasting letters (but without the wheelchair symbol of accessibility) at each restroom entry door that directs people to the nearest accessible toilets in the fitness locker rooms. Ensure that the route to those toilets is available, clear of obstructions and meets door opening force requirements cited elsewhere. If it is notpossible to achieve these objectives, then remodel the toilet rooms to fully comply. Estimated Cost: $400 or $20, 000 Priority: High 2. The toilet facilities accessed through the fitness locker rooms have several issues, including the following: a. The signage is compliant, but is mounted too low at each restroom. b. The lavatory does not have a 27" high (minimum) clear space under for a minimum depth of 8" to allow for knee space for a wheel chair bound person due to the base cabinet that each sink is mounted on. c. Grab bars are not installed in either restroom. Proposed Correction: Reinstall signage at the correct height Remove the base cabinet and its lavatory and replace it with a wall hung lavatory. The toilet facilities accessed off of the apparatus bays have several issues, including the following: a. The signage Is compliant, but is mounted too low at each restroom. b. The coat hooks are mounted higher than the maximum of 48 ". c. The paper towel dispenser is mounted higher than the maximum of 48 ". Proposed Correction. Reinstall signage, coat hooks and paper towel dispensers at the correct height. Estimated Cost: Internal Priority: Medium CATEGORY 4 — ADDITIONAL ACCESS 1. The shower stall in both locker room facilities do not meet size, grab bar, bench seating, hand -held shower head or approach requirements for accessibility. Proposed Correction: Remodel each shower facility to meet requirements. Estimated Cost: $14,000 Priority: Low 2. The kitchen area within the fire staff dining room is not compliant. a. The sink unit has a counter that is 36" high with no front approach (roll under) ability. Proposed Correction: Modify casework to provide a roll under, front approach sink unit with a 34" high counter. Mount at least one microwave on the counter so that operable portions are no higher than 48 °. Replace the portion of the sidewalk that serves as the curb ramp landing to have a slope no greater than 1:48. Estimated Cost. $1,600 Priority: Low CATEGORY 2 — ACCESS TO GOODS & SERVICES 1. Re- adjust the closers to slow the closing of the door. Estimated Cost: Internal Priority: High 4. A bench within the men's and women's locker rooms is not between 20" — 24" wide and 48" long. Proposed Correction: Install a new bench in each locker room which meets the size and height requirements. Proposed Correction: Replace the insert on the sign to allow the wheel chair symbol to be the highest graphic with the raised text and then Braille beneath. Estimated Cosh $200 Priority: High 2. The slope within the accessible aisle and parking spaces is 1:24 and exceeds the allowable 1:48 slope. Proposed Correction: Repave a portion of the parking lot to allow the accessible parking stalls and the aisles to have a slope no greater than 1 :48. Estimated Cost: $4,000 Priority: Low 2. If personnel other than able bodied utility workers use these, then install a new bench in each locker room which meets the size and height requirements. The paper towel dispenser is mounted higher than the maximum of 48 ". d. The approach to the shower doesn't meet required clearances. Proposed Correction: Remove existing signage indicating that it is accessible and replace it with ADA compliant signage that directs people to the nearest accessible toilet facility. -Estimated Cost: $200 Priority: High 2. At the lobby public toilets, the 42" side -wall, horizontal grab bars in the accessible stall in the men's and women's public toilets are installed too close to the rear wall. There should be 12" of clearance to the back wall and the grab bar should extend out to 54" from the rear wall. Proposed Correction. Reinstall at the correct location. Estimated Cost: $1,000 Priority: Low 3. At the iubuy public toilets, the 30' rear -wall, horizontal grab bars in the accessible stall in the men's and women's public toilets are installed too close to the side wall. There should be 6" of clearance to the side wall and the grab bar should extend out to 42" from the side wall. Proposed Correction: Reinstall at the correct location. Estimated Cost $1,000 Priority: Low 4. At the lobby public toilets, each accessible toilet seat should be 17 " -19 ", but they are 19 %2 above the floor. Proposed Correction. The drinking fountains outside of the lobby public restrooms do not have the spout positioned at least 15" from the rear wall (12'/2" actual) nor a maximum of 5" from the front edge of the fountain (5 3 /c" actual). Proposed Correction: Replace drinking fountain fixture with ADA compliant, dual height model. Be sure to verify that if reinstalled in the same location the new style of drinking fountain doesn't interfere with access into the public restrooms. First, all issues which can be resolved by internal measures, such as adjusting force and speed of door closers, adjusting installation heights of simple building elements and reinstalling exterior signage such be address as maintenance staff has the time and resources to address them. Second, items of ,nnn- compliance that have been identified as High Pinrit%1 should be addressed by finding appropriately and contracting with vendors to resolve. These items Impact the public and staff's ability to get to a facility, circulate within a facility or receive equal access to equipment or services within the facility. When two corrections are available, it is suggested to implement the lower cost resolution as soon as possible, while planning for the higher cost item at a later date. Finally, it is recommended to provide funding in the Capital Improvement Plan for the Medium and Low Priority__ items. It is not mandatory to address items of non - compliance on their own. However, as ancillary remodeling or upgrade projects are Lmplemented in each facility these items should be included in the budget to resolve. In fact, it is the prerogative of the building official to compel an Owner to spend up to 20% of any remodeling project on upgrades that improve a facility's accessibility. Protection of our work in place is not Pro -Tec Design's responsibility. 3. We will dispose of debris created by our work into Owner - furnished trash bins or container at the site. 4. We do not accept back charges that have not been previously agreed to by us in writing. 5. Late payments will bear interest at the standard prevailing commercial rate. 6. Unless otherwise specified, you will be billed for 30% of the project total immediately after the receipt of an order (ARO). THERE ARE NO WARRANTIES THAT EXTEND BEYOND PRO -TEC DESIGN'S STATED SPECIFICATIONS, AND ALL IMPLIED AND EXPRESS WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE EXCLUDED. 17. The Owner shall purchase and maintain all -risk builders risk insurance upon the full value of the entire work including materials delivered to the job site, which shall include the interests of Pro -Tec Design. 18. This Proposal /Contract, including the provisions printed above and any specifications or other provisions attached hereto, when accepted by you and Pro -Tec Design shall constitute the Contract between us and all prior representations or agreements not incorporated herein are superseded. 20. All work to be done during standard business hours, Monday through Friday unless otherwise noted or at a schedule that Pro -Tec Design believes will provide the most project continuity. 21. Pro-Tee Design will warranty the labor and materials covered under this quotation for one year from the date of substantial completion provided the Owner is current in their payments to Pro -Tec Design, Inc. Accounts that are not current shall not receive warranty work until said accounts are made current. Pro -Tec Design will respond during normal business hours Monday through Friday. Weekends, Holidays and after hours warranty support will be billable at standard overtime rates. Warranty does not include replacement or repair of equipment damaged by; Misuse, Over or Under Voltage, or "Acts of God" such as lightning or other weather related incidents. Warranty only covers the repair or replacement of any parts supplied by Pro -Tec and any labor and travel to and from the site to execute said repairs for one (1) year from the date the Owner has beneficial use of the system. No warranty is extended to not in contract (NIC) equipment. NIC equipment is defined as any equipment not supplied by Pro -Tec or existing equipment that is re -used. The troubleshooting, repair or replacement of NIC equipment will be provided by Pro -Tec at a time and materials basis. 22. Customer agrees that during the term of this contract and for two years following termination, they will not directly or indirectly solicit for hire nor contract for services any employee or contractor who performs services hereunder without Pro -Tec Design's written consent 23. The design and /or intent of the items listed in this system specification is considered intellectual property and owned by Pro -Tec Design and will not be disclosed to any party other than those intended by Pro -Tec Design, except as required by law. Impermissible disclosure of this design /intent will subject the proprietor to Consultant Fees equivalent of the above listed design /build quotation. All materials are guaranteed to be as specified. Any alterations or deviation written or verbal from the above specifications involving extra costs will be executed and will become an extra charge over and beyond the above quotation. 24. This proposal and any documents associated with it supersede any prior verbal or written information provided. 25. Pro -Tec Design is not an insurer of Customer's risks and exposures. Pro -Tec shall not be liable for any failure to perform under this Agreement due to any "Act of God," "Force Majeure," of an other cause beyond Pro -Tec Design's control. Pro -Tec Design shall not be liable for any loss or damage caused in whole or in part from negligence, fault, or wrongful act of Customer or of any third persons or parties. Services provided under this Agreement are for the sole benefit of the Customer and no rights are, or may be, conferred on any other party as a third -party beneficiary, by transfer or assignment, or otherwise.
