AMENDMENT TO TITLE 7 OF THE LAKEVILLE CITY CODE CONCERNING PARKS
Proposed Action
Staff recommends adoption of the following motion: Move to approve amendment to Title 7
of the Lakeville City Code concerning parks.
Overview
City staff was asked to review section 7 -1 -4 -5 of the Lakeville City Code due to classif=ication of
current facilities and alcohol use within the parks system. Since staff was suggesting changes
to the aforementioned section of the City Code, staff thought it would be appropriate to
review outdated language and propose updates to other areas of Title 7 as well. The City
Attorney compiled the proposed ordinance amendments with assistance from staff.
The Parks, Recreation & Natural Resources Committee reviewed the changes to the current
City ordinance and recommended approval of the changes at their May 22, 2013 meeting
with the addition of model rockets and language concerning noise in proximity to the park.
Primary Issues to Consider
• This section of the City Code has not been reviewed since the early 1990's and
brings the City Code into compliance with current park policy
• The proposed ordinance changes address current needs in the parks

7. Ordinance amending Title 7 of the Lakeville City code concerning City parks
Staff reviewed proposed changes.
Motion made by Hayes, seconded by Bovitz to recommend approval of
ordinance as presented by City staff with the addition of prohibiting model rockets
and the addition of amplified noise in proximity to the park.
Ayes: unanimous
8. Other business
• Two presentations on June 5 Parks Meeting agenda: SWPPP and Wellhead
Protection and South Creek/Lake Marion Greenway.
• Goodwin noticed that Orchard Lake Beach sand is rocky and lawn has
crabgrass. Staff will check and update committee members.
• Heritage Center fundraiser Summer Splash will be held Saturday, July 27.
• Council will be updated on the Visioning Plan shortly. Findings will be
presented to committees and the public late summer via presentations or open
house.
9. Announcements
The next Parks, Recreation & Natural Resources meeting is scheduled for June 5.

AN ORDINANCE AMENDING TITLE 7 OF THE
LAKEVILLE CITY CODE CONCERNING CITY PARKS
THE CITY COUNCIL OF THE CITY OF LAKEVILLE, MINNESOTA ORDAINS:
SECTION 1 . Section 7 -1 -1 of the Lakeville City Code is amended by amending the
following definitions:
CITY PARK: Those geographical areas within the City .., der- the eefAfel of the

devices; has a maximum fuel capacity of 5 U.S. gallons.
2. Has a top speed of 63 mph calibrated airspeed at full power in level flight; has a
power -off stall speed of 28 mph.

SECTION 2 . Section 7 -1 -4 -5 A of the Lakeville City Code is amended to provide as
follows:

wine.
SECTION 3 . Section 7 -1 -4 -5 of the Lakeville City Code is amended by adding_ Formatted: No underline

subsection C to provide as follows:
C. The sale of beer and wine in a City Park is prohibited unless a special event
permit is issued by the City authorizing the sale in the City Park and the sale is by
a person holding the required license issued under Title 3 of the City Code, or a
licensed caterer, or the Lakeville Municipal Liquor Store.
SECTION 4 . Title 7 of the Lakeville City Code is amended by adding Section 7 -1-4 -8
to provide as follows:
AIRCRAFT ULTRALIGHT VEHICLES, PARACHUTES MODEL
ROCKETS No person may possess, land or take off in an aircraft or ultralight

in a City park.
SECTION 5 . Title 7 of the Lakeville City Code is amended by adding Section 7 -1-4 -9
to provide as follows:
FIREWORKS PROHIBITED: Except Mth a permit from the City, no person
shall within any park set off any fireworks or anything containing gun powder or
other combustible or explosive material.
SECTION 6 . Title 7 of the Lakeville City Code is amended by adding Section 7- 1 -4 -10
to provide as follows:
A. — GENERAL PROHIBITION.: No person in a park shall make any noise
that unreasonably annoys or disturbs the comfort or peace, of any person
within or outside a park or interfere with programmed or scheduled
activities within a park.
B._ AMPLIFIED NOISE. No person in a park shall use or operate or
permit the use or operation of any radio, musical instrument, tape player,
compact disc player, or other amplification devise for the production or
reproduction of sound so as to unreasonably disturb the peace, quiet, of

any person within or outside a park or that interferes enjoyment of
property outside the park.

SECTION 7 . This ordinance shall be effective immediately upon its passage and
publication.
