HomeMy WebLinkAboutItem 06.cMay 30, 2013 Item No. JUNE 3, 2013 CITY COUNCIL MEETING STONE BOROUGH 2 "D ADDITION EASEMENT VACATION Proposed Action Staff recommends adoption of the following motion: Move to approve a resolution vacating a public drainage and utility easement in Stone Borough 2" Addition. Adoption of this motion will vacate an existing drainage and utility easement to allow Lot 10, Block 4, Stone Borough Second Addition to be moved 4.88 feet to the north. Overview The Stone Borough development was preliminary platted in 2004 and included detached townhome lots along the southern and eastern perimeter of the plat. The preliminary plat plans included typical detached townhome building footprints on each lot to insure each of the units had a minimum setback or separation of 20 feet between townhomes as required by the Zoning Ordinance. Since 2004 the development has gone through several plat revisions and home styles to keep pace with the changing housing market. The proposed detached townhome on Lot 10, Block 4, Stone Borough Second Addition is the last unit to be constructed in this area of the plat. The proposed townhome must be setback a minimum of 20 feet from the adjacent townhomes previously constructed on Lots 9 and 11. Therefore, to meet the 20 foot setback requirement, Lot 10 must be moved 4.88 feet to the north, which also includes revisions to the existing drainage and utility easements within the surrounding townhome common area (Lot 23) which can be completed via an administrative subdivision. At their May 23, 2013 meeting, the Planning Commission held a public hearing to consider the easement vacation. No residents addressed the Planning Commission during the public hearing. The Planning Commission unanimously recommended approval of the easement vacation. Primary Issues to Consider • None. RESOLUTION VACATING PUBLIC DRAINAGE AND UTILITY EASEMENTS WHEREAS, the Planning Commission has conducted a public hearing, preceded by two (2) weeks published notice, to consider the following described easement vacation, and WHEREAS, the City Council has determined that it is in the public interest to approve the easement vacation. NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council: 1. The drainage and utility easements identified on the attached Exhibit A are hereby vacated. 2. The revision to the drainage and utility easement requires a public hearing, review by the Planning Commission and final consideration by the City Council. Staff has reviewed the submitted plans and the revised location of the townhome lot and the setback between townhome units. The proposed adjustment to Lot 10, Block 4, Stone Borough Second Addition and the proposed detached townhome within revised Lot 10 will meet the minimum standards of the Zoning Ordinance and the 20 foot setback between townhomes. Staff will process the administrative subdivision subject to the Planning Commission and City Council approving the easement vacation. Keyland Homes has also submitted a request to revise the existing drainage and utility easement adjacent to Lot 10, Block 4, Stone Borough 2 " Addition. A 4.88 foot area within Lot 10 along the north side of the parcel must be vacated and a 4.88 foot area adjacent to the south side of Lot 10 must be added to the existing drainage and utility easement to reflect the overall shift of Lot 10 to the north 4.88 feet. The easement vacation requires a public hearing, review by the Planning Commission and final consideration by the City Council.
