Ayes - Davis, Little, Swecker, Anderson Donnelly Farm 4 11 Addition Casey Wollschlager, representing Summergate Development, LLC, requested Council approval of the preliminary and final plat of Donnelly Farm 4 11 Addition, along with an easement vacation and Planned Unit Development (PUD) amendrhe' ffor the re- platting of 42 vacant townhome lots and portions of two common area lots into 24 sixigle family resident al lntc Mr. Morey presented the Donnelly Farm 4' Addition re -plat, which is located within the townhome area of the Donnelly Farm development soiuth of 194`h Street and east of Dodd Boulevard. All existing drainage and utility easements froth the undeveloped townhome lots are proposed to be vacated, and new easements will be established that reflect the proposed re- platted single family lot design. Mr. Morey explained that a PUD amendent is necessary to convert the townhome lots into single family lots. In addition, the PUD amendment allows six of the proposed lots to have slopes greater than 3:1 becat property and the lots where` usable rear yard area for the the development contract pF include a $2,500 escrow for of the grade differential between the All Saints Church townhomes were to be placed, and the need to provide a 191e family homes. This property is not being utilized by the City for any other purpose, and the 44,on is included in the development contract for Donnelly Farm 4 1 li Addition. Member Davis asked about the single family residential district setbacks. Mr. Morey stated the setback standards applied to this development are for the RS -4 district, which allows the smaller single family lots with narrower width and reduced setbacks. Council Member Swecker expressed some concern over the proposed 2:1 slope. Mr. Morey stated the development contract specifies a certain product that is required to stabilize the City Council Meeting Minutes, June 3, 2013 Page 3 slope, and the work must be completed under the supervision of the City's engineering department. Motion was made by Swecker, seconded by Davis to approve Resolution No. 13 -54 approving the preliminary and final plat of Donnelly Farm 4 I Addition; and Resolution No. 13 -55 vacating public drainage and utility easements. Roll call was taken on the motion. Ayes - Little, Swecker, Anderson, Davis 8. Ordinance Amending Title 7 of the City Code Concerning City Parks Mr. Altergott presented a proposed ordinance amending Title 7 oftlie City Code pertaining to city parks. As provided in the ordinance, possession or consumption of alcohoLis prohihited in city parks, with the exception of har_r and winv_, The sale of be a`nA wino k prohibited unless a special event permit is issued by the City. Sales can onlybe made by a person holding the required license, by a licensed caterer or by Lakeville Municipal Liquors. The proposed ordinance also addresses aircraft, uliralight vehicles, parachutes, model rockets and fireworks; and it includes provisions related to noise and amplified noise within and in proximity to the parks. Council Member Anderson suggested that Section shofild include model aircraft. He further suggested that the phrase, "Except with a permit from the City ", be added to Section 4. The City Attorney will amend the ordinance as recommended. Motion was made by?Davis, seconded by Swecker to adopt Ordinance No. 908 amending Title 7 of the Lakeville City Code concerning city parks, as amended. Roll call was taken on the motion.
