Consent Agenda Motion was made by Anderson, seconded by Davis to approve the consent agenda items as follows: a. Claims for payment b. Minutes of the May 20, 2013 City Council meeting c. Resolution No. 13 -52 vacating public drainage and utility easements in Stone Borough 2nd Addition d. Donnelly Farm 4" Addition Casey Wollschlager, representing Summergate Development, LLC, requested Council approval of the preliminary and final plat of Donnelly Farm 4t'' Addition, along with an easement vacation and Planned Unit Development (PUD) amendment for the re- platting of 42 vacant townhome lots and portions of two common area lots into 24 single family residential lots. Mr. Morey presented the Donnelly Farm 4t" Addition re -plat, which is located within the townhome area of the Donnelly Farm development south of 194 Street and east of Dodd Boulevard. All existing drainage and utility easements from the undeveloped townhome lots are proposed to be vacated, and new easements will be established that reflect the proposed re- platted single family lot design. Mr. Morey explained that a PUD amendment is necessary to convert the townhome lots into single family lots. In addition, the PUD amendment allows six of the proposed lots to have slopes greater than 3:1 because of the grade differential between the All Saints Church property and the lots where the townhomes were to be placed, and the need to provide a usable rear yard area for the single family homes. Given the stipulations that are included in the development contract pertaining to stabilization of the slopes on those six lots, which include a $2,500 escrow for each lot and City inspections, staff supports approval of the PUD amendment. Mr. Morey also explained that, in order to achieve enough width for an additional single family lot, the developer will purchase a strip of City -owned land (4.63 feet by 110 feet of Outlot B). This property is not being utilized by the City for any other purpose, and the agreed upon price is included in the development contract for Donnelly Farm 4t" Addition. Council Member Davis asked about the single family residential district setbacks. Mr. Morey stated the setback standards applied to this development are for the RS -4 district, which allows the smaller single family lots with narrower width and reduced setbacks. Council Member Swecker expressed some concern over the proposed 2:1 slope. Mr. Morey stated the development contract specifies a certain product that is required to stabilize the City Council Meeting Minutes, June 3, 2013 Page 3 slope, and the work must be completed under the supervision of the City's engineering department. Motion was made by Swecker, seconded by Davis to approve Resolution No. 13 -54 approving the preliminary and final plat of Donnelly Farm 4 1 Addition; and Resolution No. 13 -55 vacating public drainage and utility easements. Roll call was taken on the motion. Ayes - Little, Swecker, Anderson, Davis 8. Ordinance Amending Title 7 of the City Code Concerning City Parks Mr. Altergott presented a proposed ordinance amending Title 7 of the City Code pertaining to city parks. As provided in the ordinance, possession or consumption of alcohol is prohibited in city parks, with the exception of beer and wine. The sale of beer and wine is prohibited unless a special event permit is issued by the City. Sales can only be made by a person holding the required license, by a licensed caterer or by Lakeville Municipal Liquors. The proposed ordinance also addresses aircraft, ultralight vehicles, parachutes, model rockets and fireworks; and it includes provisions related to noise and amplified noise within and in proximity to the parks. Council Member Anderson suggested that Section 4 should include model aircraft. He further suggested that the phrase, "Except with a permit from the City ", be added to Section 4. The City Attorney will amend the ordinance as recommended. Motion was made by Davis, seconded by Swecker to adopt Ordinance No. 908 amending Title 7 of the Lakeville City Code concerning city parks, as amended. Roll call was taken on the motion.
