RESOLUTION TO AUTHORIZE WSB & ASSOCIATES TO PREPARE A FEASIBILITY
REPORT FOR THE 2014 STREET RECONSTRUCTION PROJECT
Proposed Action
Staff recommends adoption of the following motion: Move to approve a resolution
authorizing WSB & Associates to prepare an engineering feasibility report for the 2014 Street
Reconstruction Project that includes portions of Cedar Highlands First Addition, Cedar
Highlands 5t Addition, Dodd Pointe 1St Addition, Dodd Pointe 2 nd Addition, Dodd Pointe 3rd
Addition, Donnay's Valley Park 3 d, Donnay's Valley Park 5 11 , Donnay's Valley Park 7th, Donnay's
Valley Park 8th, Niakwa Village 2 nd Addition and Sunrise Village.
These street improvements constitute City Improvement Project 14 -02.
Overview
The City's Pavement Management Program rates pavement condition as a guide to long -term
infrastructure management and includes the street reconstruction plan as part of its Capital
Improvement Plan. The streets planned for reconstruction in 2014 show significant surface
distresses and failures in the asphalt; there is also a significant water main break history along
Garcia Way, within Cedar Highlands 1 Addition. The estimated project cost is $9,125,000.
The first neighborhood meeting for the project was conducted on Tuesday, August 13, 2013,
attended by approximately 120 property owners.
Proposed project financing is through bonds issued under Minnesota Statutes, Chapter 429,
for local improvements. A portion of the total project cost will be assessed to the property
owners abutting the identified streets. The engineering feasibility report is required under
Chapter 429 prior to adopting a resolution ordering the improvement.
Primary Issues to Consider
Could some property owners oppose the proposed assessments for the street
reconstruction project and question the need for the proposed improvements? Yes, City
Staff has worked to address all questions and concerns from residents regarding the
timing of and the need for the project.

WHEREAS, the pavement within portions of Cedar Highlands First Addition, Cedar
Highlands 5 11 Addition, Dodd Pointe 1St Addition, Dodd Pointe 2 "d Addition, Dodd
Pointe 3rd Addition, Donnay's Valley Park 3rd, Donnay's Valley Park 5th, Donnay's Valley
Park 7th, Donnay's Valley Park 8t Niakwa Village 2 Addition and Sunrise Village has
reached the end of its lifespan and is programmed to be reconstructed in the City's
2014 -2018 Capital Improvement Plan; and
WHEREAS, the City of Lakeville wishes to finance a portion of the project
through special assessments; and
WHEREAS, a feasibility report is required under MN Stat. Chapter 429 for this
local improvement;
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Lakeville,
that WSB & Associates is hereby authorized to prepare an engineering feasibility
report for the 2014 Street Reconstruction Project, City Improvement Project 14 -02.
ADOPTED this 19th day of August 2013, by the City Council of the City of
Lakeville.

A Neighborhood Meeting was held on Tuesday, August 13, 2013 to discuss the proposed 2014
Street Reconstruction Project, City Project #14 -02. Approximately 120 residents attended the
meeting held in the Lakeville City Hall Council Chambers to discuss the proposed
improvements. The following Staff and WSB & Associates, Inc. representatives were in
attendance:

The following is a summary from the Question and Answer portion of the presentation:
Question #1 (Q1): Are corner lots treated differently for assessments?
Answer #1 (Al): Corner lots are not treated differently under the City's Assessment Policy.
Assessments are unit based for residential properties with no difference due to
property size or footage adjacent to the project.
Q2: Are the temporary mailbox locations permanent?
A2: The locations of the temporary mail boxes will not permanent, and mail delivery to these
temporary locations will only be implemented as needed during construction. Temporary
mailboxes will be needed along streets where complete curb and gutter replacement is

proposed. In areas of spot curb and gutter replacement, mailboxes will only be removed
as necessary to facilitate the curb replacement.
Q3: Will there be "issues" if we have a private contractor working on our home next summer
during the street reconstruction project?
A3: The City's contractor and your private contractor will need to work together to facilitate
work on your private property.
Q4: What does the construction schedule look like? We have a graduation party planned for
next summer.
A4: The project schedule will be better - defined once a contractor is selected for the project, in
late spring, 2014. Another neighborhood meeting will be held prior to starting
construction to address more specific questions regarding schedules, construction access
and general construction concerns. Residents will be mailed the construction
representative contact information, as well as a project phasing map, prior to starting
construction. Residents can also sign up for the City's e -mail listsery to receive updates
about the project. Staff will work with residents to minimize impacts to special events
whenever possible.
Q5: With all of the kids walking to school and people crossing Flagstaff Avenue, what can be
done to improve pedestrian safety?
A5: There are many possible solutions to address concerns like this. The City cannot change
the traffic volumes along public roads, but will look into traffic calming and safety
improvements as part of the feasibility and final design of this project.
Q6: Will the project have the surmountable or barrier -style curb and gutter?
A6: Curb and gutter throughout the project area will be replaced to match the existing curb
types.
Q7: How many years will people be paying the assessments and will this time frame change?
If you sell your property you are still required to pay the assessment?
A7: The assessment period for street reconstruction projects is 20- years. Property owners will
be given the option to pay their assessment prior to December 31, 2014, either partially or
in -full, to avoid interest charges.
Special assessment deferments are available in some situations. Please refer to the City's
website for additional information regarding special assessment deferrals.
Requirements for paying off your assessment differ by mortgage agreement, but typically
mortgage companies do require the remaining assessment be paid off at closing.
Q8: Why wasn't Garcia way done with the rest of the project from last year? Property owners
in this area will now be dealing with construction in the area for three consecutive
summers.
A8: The City has not had the capacity over the last few years to add that area. The City has
aggressively tried to increase the size of the project areas to minimize such

inconveniences, and apologizes to those residents that will experience construction
activity for multiple years.
Q9: Is the City planning on putting new curb and sidewalk in the Dodd Pointe area? Will the
City install sidewalks where there are school bus stops, or widen the sidewalks south of
the townhomes on Flagstaff? These sidewalks aren't usable during winter because they
are too narrow to plow.
A9: Curb and gutter is proposed to be removed and replaced in -kind in this area, but no new
sidewalks are planned to be installed, nor are any existing sidewalks proposed to be
widened as part of the project. However, the City welcomes input from residents
regarding additional sidewalks requests. If neighbors can agree on the placement of a
new sidewalk, the City will review the request and determine if it is feasible to add the
additional sidewalk to the scope of the project.
The City is responsible for plowing sidewalks in front public property (i.e. City parks,
City buildings, etc.), but plowing sidewalks in front of private property is the
responsibility of the property owner. Some sidewalks which are icing over in the winter
will likely be corrected with this project, as the boulevards will be re- graded with the
installation of new curb and gutter.
Q10: Why does Flagstaff Avenue have so many heavy vehicles traveling along it if it's a local
City street, and not a County Road? The issue with the deteriorating Flagstaff Avenue
pavement is the number of large vehicles using the road. Can load restrictions along
Flagstaff Avenue be added to the scope of the project?
A10: Flagstaff Avenue is classified as a major collector in the City's Comprehensive
Transportation Plan, and is intended to keep heavy vehicles off of local streets. Public
streets are designed for public use, and the City has found it difficult to limit or enforce
weight restriction policies.
Qll: For existing concrete driveways, will the City "patch" that portion of the concrete
driveway to the nearest expansion joint? Are the driveways going to be replaced to wider
widths than they exist?
All: With concrete driveways, the City's practice has been to remove and replace the
driveway to the first joint and to replace the driveway to match its current width. Within
the City of Lakeville, driveways can be a maximum of 24 -feet in width, unless a permit is
obtained to construct the driveway to 28 -feet in width. The City plans to patch disturbed
driveways to match their existing widths unless otherwise requested by the property
owner.
Q12: How far into my driveway will the pavement be removed with the street improvements?
Al2: Typically, only the first 3 -to -5 feet of a driveway are disturbed with the curb and gutter
improvements. However, if more extensive improvements are need to correct
grading /drainage issues, or to install additional storm sewer improvements, the maximum
distance that would be disturbed is 14 -feet behind the back of curb, which is the City's
right -of -way limits.

Q13: What does the City do with broken mailboxes or custom mailboxes?
A13: If a mailbox isn't salvageable or the post is deteriorated beyond the point of salvaging, the
City will replace with a standard mailbox and/or mailbox post. If the property owner
decides to purchase a different mailbox while construction is underway adjacent to their
property, the City will work with the property owner to install this new mailbox in
conjunction with the project.
Q14: What if a boulevard tree dies due to root damage associated with the street reconstruction
project a few years down the road?
A14: The contractor warranty period for work completed with the project is 1 -year, but the
City would still like to hear from you even if something like this were to happen outside
of the contractor warranty period. The City does also work with a certified arborist
minimize situations like this.
Q15: Once work on the project begins, is it too late to point out issues /concerns?
A15: Once construction commences, the best points -of- contact will be the on -site construction
representatives, and those representatives can work with property owners to resolve
issues that come up during construction.
Q16: Will the City lower the street for drainage improvements?
A16: It depends on the circumstances in any given area. Typically with street reconstruction
projects, any changes in the vertical elevation of road are made to improve the drainage
conditions in the neighborhood.
Q17: If there trees are within 6 -feet of the existing curb and gutter within the Niakwa Village
area, will they be impacted? How far from the back of curb are trees removed?
A17: The factors that necessitate the removal of any given tree within a street reconstruction
project area are varied: The location of the curb removal in relation to the tree; if the tree
is currently causing damage to the street or curb (i.e. heaving); or if the tree species has
potential to cause damage to the roadway in the future (i.e. silver maples). The City will
be identifying trees to be removed as part of the feasibility report and final design phases
of the project.
Q18: I'm concerned with children on Flagstaff walking to school. Are walking routes planned
for students walking during construction?
A18: The City works to phase construction around the school year and in school areas to
minimize impacts to students. The City also works with the school district to minimize
impacts. Safety is the primary concern for everyone involved with a City construction
project.
Q19: Until the reconstruction work actually commences on the project, can we please work to
make the streets more passable? Fire trucks are bottoming out due to poor roadway
conditions. Also, what happens if a car is damaged due to a pothole?
A19: The City continues to work to address the poor roadway conditions in the project area.
However, with the planned reconstruction for next year, the City will perform minimum
maintenance in this area, mainly patching where there are safety issues and to ensure
snow plows and emergency vehicles maneuver the streets.

Regarding claims for damage resulting from potholes, previous case law has shown that
the City's insurance will not cover this damage.
Q20: When I need to park on the street due to the concrete curb and gutter /driveway curing
time period, how will the City address the traffic and fast speeds of drivers passing
through the neighborhood?
A20: During construction The City will have the roads closed to local or "thru" traffic. Police
patrols are also informed of street reconstruction activity and are aware that issues such
as this will need to be monitored.
Q21: Is there a reason why the final paving from the 2012 project wasn't completed until a few
weeks ago?
A21: There was a significant amount of water main and underground utility work in this area,
and the City wanted to allow that area to go through a freeze /thaw cycle to identify any
problems prior to placing the final lift of pavement.
Q22: When driveways and curbs are removed for construction, is the gap temporarily filled in?
A22: The contractor will provide gravel ramps during construction to provide access.
Q23: How else can residents learn about plans for traffic calming on Flagstaff Avenue? Are the
driver feedback signs currently on Flagstaff Avenue going to become permanent fixtures?
Has the City looked at opportunities to reduce vehicle speeds along Flagstaff Avenue
south of Dodd Boulevard (CSAH 9)?
A23: The City plans to identify traffic calming options with the feasibility report for the
project, but would also like feedback from residents along Flagstaff Avenue about some
of the proposed solutions. The driver feedback signs currently located along Flagstaff
Avenue will be made permanent fixtures with the 2014 Street Reconstruction Project (in
the same general locations).
Speed limits are set by state statue and a speed study would be required by MnDOT in
order to modify any posted speed limits along a local street. A speed study for Flagstaff
Avenue was recently completed, and the current posted speed limits reflect the results of
that study.
Q24: Are we going to put additional catch basins in with the project? If we have a drainage
structure that is "flooding," can that be addressed?
A24: These meetings are a great opportunity to have residents identify areas where we have
drainage issues like this. Yes, it is anticipated that some additional storm sewer facilities
will be constructed with the street improvements. Residents are encouraged to use the
markers attached to the presentation boards at the back of the room to write notes about
site /drainage issues in the neighborhood. If there are existing conditions which are
causing problems, we'd like to have you fill out a comment card and during final design
staff will look at addressing these issues.
