Subject: Packet Material for the September 5, 2013 Planning Commission Meeting
Agenda Item: Superior Access Solutions Interim Use Permit Extension Request
Representatives of Superior Access Solutions are requesting a second one-year extension to
Interim Use Permit 11-08 approved by the City Council on September 19, 2011. The interim
use permit allowed the construction of a 75 foot tall antenna tower on property located at
21037 Heron Way. A maximum tower height of 50 feet is permitted without an interim use
permit. Superior Access Solutions is requesting another one year extension to allow them
to construct the tower and antenna within the next 12 months. Planning Department staff
approved a one year extension in 2012 as allowed by the Zoning Ordinance. The second
extension request requires Planning Commission review and a recommendation to the City
Council.
In their attached August 28, 2013 letter, Superior Access Solutions explains that the delay
in construction is due to changes to their business plan and they expect to have the
project completed by June 1, 2014.
Planning Department staff recommends a one year extension for the interim use permit to
September 15, 2014.

Superior Access Solutions would like to request an extension for our permit to install a 75 foot tall
antenna our site.
Although our business plan has changed somewhat and we have been extremely busy, we do
feel that the tower will be beneficial in the future with construction by June 1, 2014.

INTERIM USE PERMIT NO. ii -
1. Permit. Subject to the terms and conditions set forth herein, the City of
Lakeville approves an interim use permit for Superior Access Solutions to allow
the construction of an antenna and tower taller than 50 feet in the I-1, Limited
Industrial District on property located at 21037 Huron Way.
2. Pro e . The permit is for the following described property located in the City
of Lakeville, Dakota County, Minnesota:
Lot 5, Block 2, Airlake Development Fourth Addition
3. Conditions. The permit is issued subject to the following conditions:
0.> a) The antenna and tower shall not exceed 75 feet in height.

C a) The interim use permit for the 75 foot tall accessory antenna and tower shall
expire when the antenna and tower is no longer needed for the operations of

() 4. Termination of Permit. The City may revoke the permit following a public
hearing for violation of the terms of the permit.
5. Lapse. If within one year of the issuance of this interim use permit the
antenna and tower has not been constructed, this permit shall lapse.
6. Criminal Penalty. Violation of the terms of this interim use permit is a criminal
misdemeanor.
