MIDWEST ASPHALT INTERIM USE PERMIT AMENDMENT
SEPTEMBER 16, 2013 CITY COUNCIL MEETING
Proposed Action
Staff recommends adoption of the following motion: Move to table action on the interim use
permit OUP) amendment for Midwest Asphalt Corporation.
Adoption of this motion will allow time for Midwest Asphalt representatives to hold a
neighborhood meeting to discuss the concerns raised by residents since the public hearing.
Overview
The Planning Commission held a public hearing on August 22, 2013 to hear public comment on an
interim use permit amendment from Midwest Asphalt Corporation to extend their gravel mining
operating hours from the approved timeframe of 7:OOAM and 7:OOPM Monday through Saturday to
24 hours a day, seven days a week for certain aspects of their mining operation. The property is
located east of 1 -35 and Kenrick Avenue and north of 195th Street.
The City Council and staff have received numerous a -mails from residents since the August 22nd
public hearing on Midwest Asphalt's IUP amendment application expressing concerns about the
mining operation and proposed extension of operating hours. Staff is recommending that Midwest
Asphalt representatives reach out to concerned residents to listen to and address their concerns.
As such, Midwest Asphalt has scheduled a neighborhood meeting for September 24th at 6:30 PM at
Family of Christ Lutheran Church, 10970 -185 1h Street West. In order to accommodate the
neighborhood meeting and subsequent follow -up on the concerns raised, staff has extended the
deadline for action on the IUP amendment request an additional 60 days, to November 13
Primary Issue to Consider
What is the deadline for City Council action on the interim use permit application? The 60dayaction
deadline is September 14, 2013. The City has extended action an additional 60 days as allowed by State
Statute. The application deadline is now November 13, 2013.
