Mayor Johnson called the meeting to order at 7:00 p.rn. The pledge of allegiance to
the flag was given.
Father Tiffany of All Saints Parish offered a blessing for the new year.
The Honorable Thomas Poch, District Court Judge, administered the oath of office to
Mayor Bob Johnson and Council Members Mark Bellows and Wendy Wulff.
Roll call was taken. Present: Council Members Bellows, Luick, Rieb, Wulff and
Mayor Johnson.

MINUTES
The minutes of the December 16, 2002 City Council meeting and the November 25,
2002 Council work session were .approved as presented.

Mallory MacGibbon, President of Lakeville DECA, requested Council consideration
of a proclamation for Free Enterprise Week, January 6-10, 2003.. Scott Slepicka and
Joanna Soricelli, students from the Marketing and Sales Class at Lakeville High
School, highlighted some of the events scheduled during. Free Enterprise Week.
Council Member Wulff read the proclamation.

CONSENT AGENDA
03.1 Motion was made by Rieb, seconded by Luick to approve the consent agenda items as
follows:
a. Claims for payment.
b. Receive minutes of the December 18, 2002 Parks, Recreation & Natural
Resources Committee meeting.
c. Resolution No. 03-01 establishing rules and rental fees for the use of City
shelters/buildings.
d. Agreement with Minnesota Department of Public Safety, Office of Drug
Policy & Violence Prevention.
e. Resolution No. 03-02 accepting donations to the DARE Program.
f. Resolution No. 03-03 accepting donation from Mothers Against Drunk
Driving to the Police Department.
g. Labor Agreement between the City of Lakeville, MN, and Law Enforcement
Labor. Services, Inc., Union Local No. 128 (patrol officers).

ITEM 8
Lieutenant Richard Schwartz presented a proposed ordinance amending Title 3,
Chapter 13 of the Lakeville City Code concerning peddlers, solicitors and transient
merchants. He highlighted some of the proposed changes, which are being
recommended as a result of problems encountered by the Police Department in
administering the existing ordinance. The proposed ordinance also meets
constitutional requirements and reflects recent court decisions. He explained that the
definition section of the ordinance has been modified. Peddlers and transient
merchants are required to be licensed, while solicitors must register with the City.
The Police Department will issue the license and registration. A process for
revocation is also delineated, which grants the Police Chief or the Chief's designee
the right to revoke a license or registration. Previously, that action was to be taken by
the City Council, which was not always timely. The ordinance also requires that all
peddlers, solicitors and transient merchants must wear or display on their outermost
clothing the certificate of registration or licensure provided by the City.
Mayor Johnson asked what a resident should do if a peddler, solicitor or transient
• .merchant comes to the door and does not have the required identification. Lieutenant
Schwartz stated residents should call the Police Department with a description of the
person and the direction in which the person is traveling.
Lieutenant Schwartz pointed out. that non-profit groups, such as girl scouts, are
exempt from license/registration requirements. Individuals traveling through
neighborhoods selling ice cream to children in the summer are now required to
register with the Police Department. Persons selling farm or garden products are
exempt from license requirements; however, they must comply with the City's zoning
ordinance.
Council Member Wulff suggested that a Messages article would be helpful to inform
residents of the new ordinance requirements for peddlers, solicitors and transient
merchants.
The City Attorney stated that a summary ordinance has been prepared for publication.
03.2 Motion was made by Bellows, seconded by Luick to adopt Ordinance No. 724 and
Summary of Ordinance No. 724, an ordinance amending Title 13, Chapter 3 of the
Lakeville City Code concerning peddlers, solicitors and transient merchants.

03.3 Motion was made by Luick, seconded by Wulff to designate Thisweek
Newspapers/Dakota County Tribune as the official (legal) newspaper for 2003; and
authorize weekly publication of the Messages page in Thisweek-Life & Times for the
year 2003.

03.4 Motion was made by Bellows, seconded by Rieb to appoint Council Member David
Luick as Acting Mayor for 2003.
