SPECIAL COUNCIL MEETING
OCTOBER 14, 2002
Mayor Johnson called the meeting to order in the Council Chambers at 4:07 PM.
Present: Mayor Bob Johnson, Council Members Mulvihill, Luick, and Bellows. Also
present were City Administrator Bob Erickson and Deputy Clerk Judi Hawkins.
Council Member Rieb was absent.
City Administrator Bob Erickson explained that the City Council had called a Special
Council meeting for the purpose of considering holding. an Executive Session. The
meeting will start out as a public venue then Special Legal Counsel James Thomson
of Kennedy and Graven will address the purpose of this Executive Session. If that is
the Council's decision, they would then recess to an Executive Session.
Mr. Thomson addressed the Council and made the following statement:
"As you will recall, 1 met with you a week ago on October 7, 2002 to discuss various
options with respect to the Metropolitan Council's decision on the ElkolNew Market
interceptor. One of those options was the possibility of initiating litigation. You
gave me direction to proceed further with that possibility; I have done so and am
back before you today to discuss that option further. In my opinion, in order to give
. you candid advice with respect to the strategies and tactics and possibility of such a
lawsuit, the need for the public to be involved in that is outweighed by the need of
privacy for me to be able to communicate my thoughts and opinions to you
confidentially. Therefore, it is appropriate if you so choose to meet in a closed
session to discuss this issue."
02.137 .Motion was made by Mulvihill, seconded by Luick, to recess to an Executive Session,
which would be closed to the public.
Roll call was taken on the Motion:
Ayes: Bellows, Johnson, Mulvihill, Luick
Nays: None
The meeting was adjourned to an Executive Session.
