Subject: Ordinance Amending Chapter7 of the City Code
During this year's Pan-O -Prog, the City received a significant amount of feedback on the
placement of blankets, tarps, chairs, etc. in the boulevard/ROW in advance of Pan-O -Prog
events. This has been a growing problem for the past number years, with some items being
placed 4 -5 days in advance of an event.
City staff has worked with the Pan-O -Prog Board, Downtown Lakeville Business Association
(DLBA) and City Attorney to add draft language, item C, to our City Code. Both the Pan-O-
Prog Board and the DLBA support the amendments below.
7 -3 -7: BOULEVARD MAINTENANCE AND USE:

A. The following are prohibited in or on any public boulevard or right of way without the written
approval of the City Engineer: privately owned structures, shrubs, boulders, landscape
material. The following are permitted in the boulevard area of a right of way:grass, ground cover,
mailboxes, and delivery tubes.
B. The owners or occupants of buildings, grounds or premises shall maintain the boulevards
abutting the same.
C. With the exception of the special events listed below, written approval is required from the
Public Works Director or City Engineer to place obstructions or items on any public boulevard or
right of way for the twenty -four (24) hours preceding a special event and during the special
event. A "special event" is an event that will take place in a public street. With respect to the
events listed below, obstructions and items cannot be placed prior to the time listed and must be
removed by the time listed. Furthermore, obstructions and items may not be secured with any
materials that could damage or negatively impact the public boulevard or right of way.
1. Pan -O -Prog Cruise Night: 9:00 a.m. — 11:59 p.m.
2. Pan-O -Prog Parade: 9:00 a.m. — 11:59 p.m.
Items in place before 9:00 a.m. and after 11:59 p.m. will be removed by City crews.
City staff believes that this ordinance amendment will allow the City and property owners to
more safely and effectively maintain/clean -up the boulevard area during Pan -O -Prog.
Furthermore, using a variety of methods, staff will work closely with Pan -O -Prog, DLBA,
property owners and Pan -O -Prog attendees to educate them of these changes.
City staff seeks direction from the City Council on this ordinance amendment.
