ORDINANCE AMENDING TITLE 7 OF THE LAKEVILLE CITY CODE CONCERNING
SPECIAL EVENTS
Proposed Action
Staff recommends adoption of the following motion: Move to amend Title 7 of the Lakeville
City Code to define placement of items on the boulevard during special events.
Passage of this motion limits the time, both before and after special events, that items may be
placed on a boulevard.
Overview
During the 2013 Pan -O -Prog summer festival, the City received a significant amount of
feedback on the placement of blankets, tarps, chairs, and other items along the boulevard in
advance of Pan -O -Prog events. These obstructions on the boulevard make it difficult for City
staff to clean up in preparation for events, restrict access along the boulevard, and hinder
access to downtown businesses.
This has been a growing problem for the past number of years with some items being placed
on the boulevard 4 to 5 days in advance of an event. The proposed amendment to the
ordinance restricts placing of items on the boulevard to specific times on Pan -O -Prog event
days.
Staff will work closely with the Pan -O -Prog board, the Downtown Lakeville Business
Association, and property owners to educate those attending events on the changes. Staff
recommends approval of this amendment.
Primary Issues to Consider
Is a change to the ordinance necessary? Yes. Recent Pan -O -Prog events have seen the
placement of items on the boulevard sometimes several days in advance of the event.
This limits the City's ability to prepare streets for events, obstructs and creates a hazard
along the boulevard, and negatively impacts both property owners and businesses.

AN ORDINANCE AMENDING TITLE 7 OF THE
LAKEVILLE CITY CODE CONCERNING
SPECIAL EVENTS
THE CITY COUNCIL OF THE CITY OF LAKEVILLE ORDAINS:
SECTION 1 . Section 7 -3 -7 of the Lakeville City Code is amended to provide:
7 -3 -7: BOULEVARD MAINTENANCE AND USE:
A. The following are prohibited in or on any public boulevard or right of
way without the written approval of the City Engineer: privately
owned structures, shrubs, boulders, landscape material. The following
are permitted in the boulevard area of a right of way: grass, ground
cover, mailboxes, and delivery tubes.
B. The owners or occupants of buildings, grounds or premises shall
maintain the boulevards abutting the same.
C. With the exception of the special events listed below, written approval
is required from the Public Works Director or City Engineer to place
obstructions or items on any public boulevard or right of way for the
twenty -four (24) hours preceding a special event and during the special
event. A "special event" is an event that will take place in a public
street. With respect to the events listed below, obstructions and items
cannot be placed prior to the time listed and must be removed by the
time listed. Furthermore, obstructions and items may not be secured
with any materials that could damage or negatively impact the public
boulevard or right of way.
1. Pan -O -Prog Cruise Night: 9:00 a.m. - 11:59 p.m.
2. Pan -O -Prog Parade: 9:00 a.m. - 11:59 p.m.
SECTION 2 . This ordinance shall be effective immediately upon its passage and
publication.
ADOPTED this 16" day of December 2013 by the City Council of the City of
Lakeville.
