ORDINANCE ADOPTING FEES
AND SUMMARY PUBLICATION OF ORDINANCE
Proposed Action
Staff recommends adoption of the following motion: Move to approve the Ordinance Adopting
Fees and summary publication of Ordinance.
Approval of the Ordinance will result in the approval of charges for Water Connection Charges,
Park Dedication Fees and the cost recovery program for Code Enforcement.
Overview
At its November 19 meeting, the City Council reviewed the Water Connection Fee Analysis and
concurred with the recommendation to increase fees in order to finance infrastructure
improvements as identified in Comprehensive Water Plan Update and the Water Treatment
Facility Expansion Study.
At its November 25 meeting, the City Council reviewed the Cost Recovery Process and concurred
with the recommendation to add a cost recovery fee for inspection services related to property
maintenance and code enforcement. The Council also received a recommendation to lower the
park dedication fees for residential properties.
State law requires the establishment of fees to process land use applications must be established
by ordinance after a public hearing is conducted.

Park Dedication Fees
The Parks, Recreation and Natural Resources Committee recommended reduction in the
Residential Park Dedication Fees as a result of decreases in the Dakota County Assessors
estimated market value for vacant residential properties. There are no proposed changes in
fees for commercial and industrial properties.
Based upon the analysis and methodology outlined in The Planning Company report dated
June 2012, park dedication fees in lieu of land should be reduced to reflect the changes in
market conditions between 2012 and 2014. The Parks, Recreation and Natural Resources
Committee recommended Council approval of the reduction. For a more comprehensive
discussion of the fee change, refer to the Memorandum from Parks and Recreation Director
Brett Altergott dated November 1, 2013. The proposed fees are as follows:

Connection Charges - Water Connection Fees
Water connection charges are proposed to increase to $4,000 (currently $3,900) for residential
and $2,000 (currently $1,950) for non - residential effective April 1, 2014 based on the
Comprehensive Water Plan Update and the Lakeville Water Treatment Plant Facility
Expansion Study. Refer to the Water Connection Fee Analysis dated November 2013 for a
detailed discussion. State law requires a public hearing prior to adoption of the fee.
Proposed "NEW" Fee
Planning - Cost Recovery Fee
The City Council, at its November 25 work session, discussed various options of recovering at
least a portion of the costs related to code enforcement. Staff recommended and Council
concurred, to implement a $70 per visit "Cost Recovery Fee' for those property owners or
owners who do not comply with the initial notification of a code violation.
No change in fees - clarification only
Extension - Interim Use Permit and Variance
Occasionally, a planning applicant will request an extension on their Interim Use Permit or
Variance. There are no fees recommended with the extension process, however, staff
recommends including in the fee schedule to provide clarification.

Parks & Recreation
The City Council, at its June 4, 2012 meeting, approved an amendment to the City Ordinance
related to Park Dedication Fees. The ordinance changed (a) the land dedication percentages
for residential land uses and (b) the cash contribution requirements for residential properties.
The basis of changes was delineated in a Park Dedication analysis dated May 15, 2012
prepared by Dan Licht, President, and The Planning Company.
The Park Dedication Fees cash contributions for residential properties recommended in the
2012 report and subsequently approved by the City Council were based on changes in the
estimated market values as determined by the Dakota County Assessor's Office. According to
the Dakota County Assessors Fair Market Value for Taxes Payable 2014, there is a 2%
reduction in residential values when compared to 2012. A list of the parcels and changes in
valuation are attached.
Based upon the analysis and methodology outlined in The Planning Company report, park
dedication fees in lieu of land should be reduced to reflect the changes in market conditions
between 2012 and 2014. The following exhibit illustrates the current fee and proposed fee
for a single family lot, townhome and multi - family complex:

Park Dedication Fee Review Process
The Park Dedication Fees for residential properties will be reviewed in the fall of each year.
The fees will to be based on the changes in estimated market values as established by the
Dakota County Assessor. It is our expectation that Park Dedication fees will increase in 2015
consistent with the improving market conditions.
Commercial and Industrial property values vary based on number of factors including but
not limited to prevailing economic conditions, location, size and zoning. As such staff
recommends park dedications fees for commercial and industrial properties be established
on an appraisal consistent with that used to establish the current fees. Staff recommends
undertaking an appraisal at such time as there appears to be changes in market conditions
and /or improvement in commercial - industrial activity.
Recommendation
City Council approval of a 2% reduction in park dedication fees in lieu of land effective
January 1, 2014 as follows:

I. Introduction
The City finances its water infrastructure system such as wells, towers, water
treatment facility and water mains from water connection charges collected at the
time building permits are issued. Water connection revenues and infrastructure
construction costs are accounted for in the Water Trunk Fund.
Water system operation costs are financed with water use fees collected with
quarterly utility bills. The water system infrastructure construction financing with
water connection charges enables Lakeville to have one of the lowest water user rates
in the twin cities metro area.
In August 2013, the consulting engineering firms of Short Elliott Hendrickson
prepared a Comprehensive Water Plan Update and Black and Veatch prepared the
Lakeville Water Treatment Plant Facility Expansion Study.
The purpose of the studies was to provide a long term plan to address the water
system improvement needs for a growing population. The studies also serve as a
basis for a financial plan.
Since the initial presentation of the studies, residential growth has accelerated. City
staff has therefore recommended advancing the construction schedules of certain
projects in coordination with pending residential development and road improvement
projects.
The Water Connection Fee Analysis contained herein, therefore, is based on the
revised water improvement construction plan; the revisions are as shown in Exhibit
A— Water Infrastructure System Changes.
II. Assumption
Infrastructure Improvement Costs. The Comprehensive Water Plan Update and
the Lakeville Water Treatment Facility Expansion Study were based on 2013 water
construction costs. Construction improvement costs are, however, subject to
inflationary pressures.
Leading economists are predicting inflation in the range of 2.3% - 2.5% for
Consumer Price Index and the Producer Price Index respectively for the coming year.
For the purpose of this analysis an inflation rate of 2.5% was assumed. The
projected project costs adjusted for inflation are shown in Exhibit B — Water System
Capital Improvements.
Community Growth. Lakeville has been one of the leading growth communities
for more than two decades. The recession and post - recession era of the last six years
resulted in a dramatic reduction in new construction and community growth.
However, economic conditions are improving and single family construction activity
is at pre- recession levels. Commercial and industrial development remains relatively
static.
There are a number of current economic conditions which appear to indicate a
continuation of steady residential growth for the foreseeable future. The economic
indicators include but not limited to relatively low mortgage interest rates, declining
foreclosures, increased number of existing home sales and increasing home values.
The Water Connection Fee Analysis is therefore premised on an assumed
construction of 365 -400 single family dwelling units per year during the next ten
years and each year thereafter until 2040.

Commercial and industrial remains relatively static for the purposes of this analysis.
III. Capital Improvement Plan
The Comprehensive Water Plan Update and the Lakeville Water Treatment Facility
Expansion Study were premised on an assumed 2% increase in growth per year. As
such, more than 92% of water improvement projects will be completed in the next 10
years with the remaining 8% completed within seven years thereafter.
The capital improvement plans were based on prevailing construction costs.
Inflationary factors were not taken into account. In order to develop a long -term
financial plan and water connection charge rate structure, inflationary factors (2.5 %)
were taken into consideration.
IV. Debt Financing
Existing debt. The City currently has $2.865 million of General Obligation Water
Revenue Refunding bonds outstanding. The final payment is February 1, 2016.
Proposed debt financing. The Comprehensive Water Plan Update and
Lakeville Water Treatment Facility Expansion Study are premised on the assumption
that the infrastructure will be completed approximately 10 -20 years before the city is
fully developed. Issuance of debt is recommended in order to provide for orderly
development and economic growth. The debt structure is assumed to be amortized
over a 20 year period in equal annual payments.

residents. Call features will be utilized to take advantage of potential interest rate
reductions and/or reduce exposure to financial risks such as recessions.

standing policy that residents and business pay their respective share of infrastructure
construction at the time building permits are issued. System maintenance is financed
with utility fees.
The water connection fee structure is delineated in City Ordinance 7 -5 -3 -1 as shown
in Exhibit C — Ordinance 7- 5 -3 -1. Water connection charges are currently $3,900
per unit for residential and $1,950 per unit for commercial, industrial and
institutional. The rates have not changed since 2008.
The Analysis therefore reflects an annual increase in the water connection fee of 2.5%
commensurate with inflation.

towers and other revenues as shown below.

VII. Financial Projections
The long term financial projections were developed based on the Comprehensive
Water Plan Update and the Lakeville Water Treatment Facility Expansion Study
adjusted for inflation. The estimated revenues discussed previously will be pledged
to financing infrastructure construction and debt payments.

VIII. Cash Reserves
The revenues derived from water connection fees are pledged to the repayment of the
debt. If water connection revenues are not sufficient to meet debt payments, the City
pledges water use revenues to the payment of the debt.
Although water use fees are a viable debt payment alternative, the revenue plan and
long financial projections should be structured in such a manner as to minimize the
risk of such occurrences.
If growth assumptions are accurate, the Water Trunk Fund will maintain a fund
balance that is equal to approximately 1.2 to 2.3 times the estimated annual
connection charge revenues. However, if building permits drop to recession era
levels, the fund will have sufficient cash to accommodate debt payments for
approximately 2 to 5 years.
If building permit activity dropped to recession era levels for a sustained period of
time, the City Council may need to consider alternative revenue options such as
increased water use fees, appropriating water operating fund balance, deferring
construction projects and /or restructuring debt.
IX. Recommendation
City Council approval of water connection rates as shown below:

Furthermore, the water connection fees should be reviewed every two years. The
review process should take into consideration estimated project cost adjustments as a
result of construction indexes and/or changes to the Comprehensive Water Plans.
Community growth may also impact the City's financial position and hence water
connection rate structure.

7- 5 -3 -1: CITY CONNECTION CHARGES:
A. Before connecting to the city water or sewer system, city sewer and water connection
charges based on the number of units shall be paid. If, after the initial connection
charges are paid, additional building permits or new sewer and water connections
are made, the charges shall be recalculated and any additional charges shall be
paid. The city connection charge per unit and area charge shall be established by
city council resolution.
B. The number of units shall be computed as follows:
1. The following types of residential housing each comprise one unit per dwelling unit:
a. Single- family houses: A single - dwelling unit.
b. Townhouses: A multi - dwelling with potential for laundry facilities included in
each unit.
c. Duplex units, apartments and condominiums: A multi - dwelling with potential for
laundry facilities included in each unit.
2. Apartments and condominiums shall each comprise eighty percent (80 %) of a unit
if there is no plumbing for laundry facilities within each dwelling unit.
3. Mobile homes shall each comprise one hundred percent (100 %) of a unit.
4. Other buildings and structures shall be assigned one water unit for each five
hundred forty eight (548) gallons per day of water usage and one sewer unit for
each two hundred seventy four (274) gallons per day of sewage flow which it is
estimated they will discharge. Commercial and industrial building units shall be
assigned a minimum of one unit. The most recent "Standard Criteria" published by
the metropolitan waste control commission will be used as a guideline for
determining the number of units for various commercial, industrial, and institutional
facilities.
5. Multi- dwelling public housing units and multi - dwelling housing units subsidized
under any government program for low and moderate income housing shall be
counted as seventy five percent (75 %) of the unit equivalent for that type of housing
if there is no garbage disposal and dishwasher. The seventy five percent (75 %)
rate applies to the townhouse's rate when laundry facilities or hookups are included
in each unit or the eighty percent (80 %) apartment rate if laundry hookups are not
included in each unit.
C. The city connection charges shall be paid to the city before a building permit or
sewer or water connection permit is issued. The city council may approve the
assessment of city connection charges on new or enlarged multiple residential,
commercial, or industrial buildings when the number of residential equivalent units is
ten (10) or more. The council may assess the city connection charges on any
dwelling or building when the installation of the city utility system is made after the
construction of the dwelling or building. The rate of interest shall be set by the city
council.
D. In addition to the city connection charge, the user shall also pay the sewer availability
charge as determined by the metropolitan waste control commission. The
metropolitan waste control commission sewer availability charge shall be applied to
the city before a building permit, or permit for sewer and water connections is
issued.
E. City water connection charges shall be deposited in the water trunk fund and city
sanitary sewer connection charges and sanitary sewer area charges shall be
deposited in the sanitary sewer trunk fund. (Ord. 796, sec. 1, 12 -19 -2005, eff. 1 -1-

Subject: Code and Nuisance Enforcement Options and Workload and Cost Recovery Options
Staff has continued to investigate options regarding alternatives for the enforcement and resolution
of code and nuisance violations. These options include continuing the current process, establishment
of an administrative citation process or modifying the current process to allow the recovery of staff
time and overhead costs. In addition, it is important to recognize the current workload and staffing
levels within the departments responsible for code enforcement activities when evaluating the
appropriate code enforcement process. The Planning, Inspections and Police Departments currently
address an average of 240 code or nuisance complaints annually resulting in approximately 648 hours
a year dedicated to code enforcement activities.
Current Process
After the City becomes aware of a potential code violation an initial inspection is completed, and if a
violation has been found, a written notice is sent to the property owner and they are given 10 - 14
days to remedy the violation. After the 10 - 14 day deadline a follow up inspection is conducted to
determine if the violation has been addressed. If the violation has not been addressed, a second
written notice is sent to the property owner and they are given 7 days to address the issue. If the
violation has not been addressed by the end of the 7 day period, and the violator has not made other
arrangements with staff, a criminal citation is issued and the violation is processed through the district
court system.
When the property owner does not address the code violation after several notices by the City, a
criminal citation and possible court ordered penalties is the only option that remains to bring the
property into compliance with City ordinances. Unfortunately, there are certain negative
consequences for both the City and the accused, which includes the delay of a prompt resolution, the
label as a "criminal' for violations of administrative regulations, inefficient use of the court system and
costs associated with lost staff time and attorney fees. The time and overhead costs expended during
the enforcement process is financed through the general fund tax dollars.
Administrative Citation Process
Staff discussed with the City Council, at previous work sessions, the establishment of an administrative
citation process as an alternative way to enforce some City ordinances. As discussed, an
administrative citation process is considered a non - criminal ticket issued to individuals who are not in
compliance with City ordinances. An administrative citation differs from a criminal citation in that an
administrative citation is not punishable byjail and does not appear on an individual's criminal record
and are processed entirely by the City and do not involve court proceedings. The establishment of an
administrative citation program would include preparing the appropriate standards and processes
that follow state statute and adoption of new City ordinances by the City Council. Some of the costs
associated with the processing and administration of an administration citation process could be
subsidized from the collection of fines.
It should also be noted there is still some debate as to whether statutory cities, such as Lakeville, have
the legal authority to create an administrative citation process. It is anticipated the State Legislature
will address and clarify this issue in the 2014 Legislative Session.
Cost Recovery Process
Another option for the City Council to consider is to charge a "cost recovery fee" for inspection
services, as opposed to imposing a civil penalty or an administrative citation. Under current law, the
City can charge and assess the costs of services related to property maintenance and code
enforcement such as when the city mows lawns that are in violation of the ordinance. State Statute
429.021(8) specifically allows for the assessment of costs associated with nuisance abatements.
Therefore, the tall grass and weed complaint process could be modified as shown on the attached
flow chart to include other code violations such as noise complaints, junk or illegally parked vehicles,
sign violations, property maintenance issues, etc. The process would follow our standard procedures
including, investigation of the complaint, inspection of the site and mailed notices. Cost recovery
charges would begin accruing with the second inspection and continuing with the third inspection
and into the citation stage for non - compliance situations. After due process has been completed, the
City sends the owner an invoice, and if left unpaid the City assesses the cost via State Statute 429. The
amount of the inspection fee would not be punitive, but would rather be intended to recover the
actual cost to the City for the inspection, letter writing, and file- documentation related to the case and
other related costs.
The proposed per inspection fee would be approximately $70.00 based on a typical violation scenario
requiring a minimum of one hour of staff time to prepare notices and conduct inspections. The
following table identifies the annual potential for the recovery of costs based on inspection data
collected from the Planning and Inspections Departments from 2009 to 2013. The Police Department
numbers are estimated:

B. Construction Plan Review

C. Wetland Conservation Act Administration (platting or non - platting action)
Permit to fill a wetland as allowed by the Wetland Conservation Act.......

Services performed by City Personnel in administering the Wetland Conservation Act will be
billed at 2.5 times the actual payroll hourly rate. A minimum escrow of $250.00 will be required
(if not collected through Planning and Zoning actions) for: Wetland delineation /delineation
review, replacement plan review, mailings and administration, construction inspection and
annual monitoring until successful establishment of mitigation area.
In addition to the above fees, a deposit will be required to fund special studies such as
environmental assessment worksheets, transportation, drainage, noise impacts, indirect source
permits, etc. The amount of deposit to be based on the site, complexity, diversity and location of
the project.
