B"Y ' is Adoption of this motion will result in continued use of the variety of puppets that Jim Schiffman integrates into the video programs produced by Lakeville Government Television (Lakeville Kids & Government, LFO On -Call, etc.) The Puppet Agreement is an annual agreement that is designed to compensate Jim Schiffman for use of his specific talents as puppeteer and use of his puppets in the video programs produced by Lakeville Government Television. There has been no Increase In the contract amount for five years. This year, the contract amount includes a twenty -five dollars per month increase. City of Lakeville programs that feature puppets continue to be very popular with Lakeville residents and have won numerous national and local awards. The agreement calls for monthly payments of $308, not to exceed of $ 3,800 for the year. Staff recommends the City Council approve this agreement because of the special talents of Jim Schiffman and the variety of puppets available for use in City of Lakeville video programs which have enhanced these programs, generated additional interest by residents, and won many awards. a ,"a p� Susanna Palm Communications Manager Financial Impact: $_3,800 Budgeted: Y Source: Communications. Budget Related Documents (CIP, ERP, etc.): Contract !Votes: $25 per month increase f l THIS LEASE AGREEMENT, dated this 16th day of December, 2013, between the Crry OF LAKEVILLE, a .Minnesota municipal corporation, 20195 Holyoke Avenue, Lakeville, Minnesota 55044 ( "Lakeville ") and JIM SCHIFFMAN, d/b/a SCHIFFELLY PUPPETS ( "Owner'D. LAKEVILLE AND OWNER AGREE FORTH BELOW: 1. Equipmen_t_ and _Rent Subiect to the terms and conditions of this Agreement, Owner leases W Lakeville and Lakeville leases from Owner puppets and props ( "Equipment") for use in the television program "Lakeville Kids & Government" and other City Programs. The City AMU pay owner Three Hundred and Eight Dollars i$3 0 085.00) per month for the use of the puppets and props. The City will also pay owner for the creation of new puppets as follows: small puppet (up to 24 inches) - One Hundred Fifty Dollars ($150.00); large puppet (up to 48 inches) - Three Hundred Fifty Dollars ($350.00). 2. Term. This lease will commence on January 1, 2014 and may be cm— c -elled by either party with 30 days written. notice. 3. Payment Rental charges shall be invoiced as of the first day of each month. Payment shall be made in full within thirty -five (35) days after receipt of the invoice. 4. Maintenance Owner shall be responsible for keeping the Equipment in good wo l rg order and making all necessary adjustments, parts replacements, and repairs. 5. Aarran . Owner warrants that the Equipment is in good working order and fit for its intended purpose. 6. Transportation The Owner shall pay for all costs of shipment of the Equipment. 7. Title. The Equipment shall remain the property of the Owner and may be removed by Owner any time after the termination of this Lease. 8. Notice Any notice or other communication given under this Agreement shall be made in writing and mailed to the City at 20195 Holyoke Avenue, Lakeville, Minnesota 55044, and to Owner at 8680 - 135 Street, Apple Valley, Minnesota 55124, or to such other address as such party shall designate by notice in writing. Such notice or communication shall be deemed delivered when sent prepaid, certified mail, return receipt requested. 9. Governing Law This Lease shall be governed by the laws of the State of Minnesota and constitutes the entire agreement between Lakeville and Owner with respect to the furnishing of the above described Equipment. 10. Waiver. No provision of this Lease shall be deemed waived, amended, or modified Doc. #172223v.1 RNK; 9/32013 by either party unless such waiver, amendment, or modification is in writing, signed by the party against whom the waiver, amendment, or modification is sought to be enforced.
