EASEMENT ASSIGNMENTS AND NO PARKING RESOLUTION
KENWOOD TRAIL (CSAH 50)/185 T11 STREET (CSAH 60) ROUNDABOUT AND
HIGHWAY EXPANSION, CITY PROJECT 09 -07

Proposed Action
Staff recommends adoption of the following motion: Move to approve easement g,ssiclnments
and a resolution establish ing _no parkin.q zones on both sides of Kenwood Trail and 18r Street
in coniunc tio_n._with the CSAH r0 /6o Roundabout and Hicihwav Expansion oroiect.
Passage of this motion establishes parking bans along Kenwood Trail and 3.85"' Street; grants
temporary and permanent easements to the County; and grants the County permission to use
public property for the purpose of constructing the CSAH 5o/6o Roundabout and Highway
Expansion project.
Overview
The County and City are using state aid funds to pay for the project and must comply with
state aid standards. The proposed roadway improvements are not designed to include parking
lanes. As a result, the City is required to restrict all parking along Kenwood Trail and .185
Street. The no parking designation extends along both sides of Kenwood Trail from Jubilee
Way to 188"' Street and along both sides of 3-85 Street from Orchard Trail to Jaeger Path, The
City has issued similar parking restrictions in the past along CSAH 5, CSAH g and CSAH 70.
The County is required to acquire all right -of- way /easement or the right to occupy and use the
right -of- way /easement needed for the construction and maintenance of the project before
construction because the project is federally funded. The attached easements identify the
specific parcels.

® What are the easement assignment details?
The City will temporarily assign to the County, for the period of construction, all
adjacent City - controlled easements/rights -of -way and property necessary to construct
the project. Jurisdiction over City - controlled easements /rights -of -way and property will
be restored to the City upon completion of the project.
The City will grant permanent highway easements to the County over parcels used for
CSAH 5o and CSAH 6o right -of -way (23,366 square feet).
The City will grant temporary easements to the County for the purpose of constructing
the project improvements (Y98,510 square feet).
Upon completion of the project, the County will convey land to the City (13,757 square
feet).
® Can the project continue without the no parking restrictions?
Approval and funding of the project is conditioned on the no parking resolution.

RESOLUTION NO.
RESOLUTION ESTABLISHING NO PARKING ZONES
ON KENWOOD TRAIL AND 185 STREET
WHEREAS, the City Council for the City of Lakeville is authorized in accordance with
city code to designate parking zones within the city, and
WHEREAS, the City of Lakeville and Dakota County have planned the improvements
of Kenwood Trail and 185 Street, and
WHEREAS, the improvement project does not provide adequate width for parking on.
either side of Kenwood Trail or 185 Street, and
WHEREAS, approval of the proposed construction as a state aid project must be
conditioned on the establishment of these no parking restrictions.
NOW, THEREFORE, BE IT RESOLVED, that the City shall ban the parking of motor
vehicles on both sides of Kenwood Trail fi Jubilee Way to 188"' Street and both sides of 185
Street from Orchard Trail to Jaeger Path at all times.

Know all meta by these presents that the undersigned City of Lakeville, a Minnesota municipal
corporation, hereinafter called GRANTOR, for good and valuable consideration the receipt of which is hereby
acknowledged, hereby conveys to the COUNTY OF DAKOTA, a political subdivision of the State of
Minnesota, hereinafter called GRANTEE, its successors and assigns, a permanent easement for highway
purposes, together with the unrestricted right to improve the same, within the following described easement
area in the County of Dakota, State of Minnesota:
A permanent easement for highway purposes, over, under and across
PARCELS 7,15 and 44, as shown on DAKOTA COUNTY ROAD .RIGHT -
OF -WAY MAP NO. 385, according to the map on file and of record in the
Dakota County Recorder's Office.
And the said GRANTOR hereby conveys to the said County of Dakota all structures, trees, 81u - ubs,
grass, aggregate, herbage or other materials now existing on or under said lands or that may be hereafter
planted, grown or deposited thereon.

corporation, hereinafter called GRANTOR, for good and valuable consideration the receipt of which is hereby
acknowledged, hereby conveys to the COUNTY OF DAKOTA, a political subdivision of the State of
Minnesota, hereinafter called GRANTEE, its successors and assigns, a temporary constriction easement for
highway purposes, including the right to construct back or embankment slope thereon in accordance with the
construction plans on file in the office of the Dakota County Highway Department, within the following
described easement area in the County of Dakota, State of Minnesota:
PARCELS 2, 7, 50 and 51, as shown on DAKOTA COUNTY ROAD RIGHT -
OF -WAY MAP NO. 385, according to the reap on file and of record in the
Dakota County Recorder's Office.
And the said GRANTOR(S) Hereby grant(s) the right to the County of Dakota for the term of this
easement to excavate, remove and retain all structures, trees, shrubs, grass, aggregate, herbage or other
materials thereon for use in the construction of said highway, and said materials shall become the property of
the County.
This easement shall be effective for a period of two years from the date of execution.
