CONVEYANCE OF CITY -OWNED PROPERTY SUMMERLYN 1 ST ADDITION
Proposed Action
Staff recommends adoption of the following motion: Move to approve a resolution for approving the sale
of City -owned property in Summerlyn 1 Addition.
Adoption of this motion will allow the conveyance of 1,076 square feet of City -owned property to US
Home Corporation (DBA Lennar) for the construction of a subdivision monument sign and associated
landscaping for the Summerlyn development.
Overview
U S Home Corporation has submitted an application and plans for an administrative subdivision to
split off 1,076 square feet of Outlot C. Summerlyn 1 Addition and combine it with Outlot D,
Summerlyn 1 Addition to allow the construction of a subdivision monument sign with landscaping to
be located north of 194t Street at Hazel Nut Avenue. The City Council approved the Summerlyn 1St
Addition final plat on April 1, 2013. Outlot C was deeded to the City by Lennar for stormwater
management and wetland preservation purposes. Lennar received a $5,500 per acre credit to the
stormwater area charge for deeding Outlot C to the City. Lennar is reimbursing the City $344.69,
which is the prorated share of the credit for the portion of Outlot C being deeded back to Lennar.
Staff recommends approval of the resolution and Quit Claim Deed to allow the sale of the property.
Planning Department staff will approve the administrative subdivision upon City Council approval of
the resolution.
Primary Issues to Consider
Will the portion of Outlot C being conveyed to Lennar impact the wetland and stormwater pond
located within Outlot C? The area of Outlot C being deeded to Lennar is upland and will not impact the
stormwater pond, the wetland or the wetland buffer.

RESOLUTION
RESOLUTION APPROVING THE SALE OF REAL PROPERTY
AND DISPENSING WITH STATUTORY REQUIREMENTS FOR
REVIEW BY PLANNING COMMISSION OF DISPOSAL OF PROPERTY
WHEREAS, the City is proposing to dispose of certain City property ( "Property ") legally
described in the attached Exhibit "A," between the City of Lakeville and US Home Corporation
( "Buyer "), and;
WHEREAS, Minn. Stat. § 462.356, subd. 2 requires that the Planning Commission review
the City's proposed acquisitions and dispositions of property, and;
WHEREAS, Minn. Stat. § 462.356, subd. 2 provides for an exception from the Planning
Commission review requirement upon 2/3 vote of the City Council dispensing with the
requirement and finding that the acquisition or disposal of the property has no relationship to
the comprehensive municipal plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakeville:
1. The City Council finds that the disposition of the Property has no relationship to the
comprehensive municipal plan.
2. Review by the Planning Commission of the disposal of the Property is hereby
dispensed with, the proposed transaction is hereby approved, and the Mayor and City Clerk are
authorized and directed to execute all documents, and take all appropriate measures to convey
the Property under the terms of the Purchase Agreement.
3. Parcel B shall be combined with Outlot D, Summerlyn 1 st Addition as shown on the
description sketch.
ADOPTED this 3rd day of March, 2014, by a 2/3 vote of the City Council of the City of
Lakeville.

Commencing at the most easterly corner of said Outlot C; thence on an assumed bearing of
South 77 degrees 46 minutes 57 seconds West along the northerly line of said Outlot C; a
distance of 56.15 feet to the point of beginning of the line to be described; thence South 12
degrees 14 minutes 03 seconds East, a distance of 70.52 feet to the southeasterly line of said
