Proposed Action
Staff recommends adoption of the following motion: Move to approve: a resolution
approving the Spirit of Brandtien Farm 13th Addition final plat, and 2) a resolution vacating
public drainage and utility easements.
Passage of this motion will allow the re- plat /re- configuration of six single family lots within
the Spirit of Brandtjen Farm planned unit development (SBF PUD).
Overviiew
Tradition Development (a /k/a SBF Development Corp.) representatives are requesting
approval of the Spirit of Brandtjen Farm (SBF)13th Addition final plat, which is a re -plat of six
single family lots and one outlot within the first SBF addition final plat approved in 2005. The
re -plat will reconfigure six lots and one trail connection in SBF to allow house construction
that is better suited to the setbacks and design criteria of the SBF PUD. In conjunction with
the SBF 13th Addition final plat, the developer is requesting the vacation of the boundary
drainage and utility easements within these six lots and one outlot. New boundary drainage
and utility easements are being dedicated for the re- configured lots. The Planning
Commission held a public hearing on the easement vacation at their February 20, 2014
meeting and unanimously recommended approval. There was no public comment.
Primary Issues to Consider
• Why is there no development contract with this final plat? Utility and street construction is
not required with the Spirit of Brandtjen Farm 13 Addition final plat. The streets and utilities
for these six lots were constructed in 2013.

RESOLUTION APPROVING THE FINAL PLAT OF
SPIRIT OF BRANDTJEN FARM 13 ADDITION
WHEREAS, the owner of the plat described as Spirit of Brandtjen Farm 13
Addition has requested final plat approval; and
WHEREAS, the final plat is acceptable to the City.
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council:
1. The final plat of Spirit of Brandtjen Farm 13 Addition is hereby approved
subject to the terms and conditions of the Spirit of Brandtjen Farm Master
Planned Unit Development Stage Plan Agreement dated October 17, 2005.
2. The Mayor and City Clerk are hereby directed to sign the final plat mylars.
3. The City Clerk is directed to file a certified copy of this resolution with the
Dakota County Recorder.

RESOLUTION VACATING PUBLIC DRAINAGE AND UTILITY EASEMENTS
WHEREAS, the Planning Commission has conducted a public hearing, preceded
by two (2) weeks published notice, to consider the following described easement
vacation, and
WHEREAS, the City Council has determined that it is in the public interest to
approve the easement vacation.
NOW, THEREFORE, BE IT RESOLVED by the Lakeville City Council:
1. All the drainage and utility easements in the following: Lots 1, 2, 3, 4, 5, and
6, Block 13, and Outlot PP, all in SPIRIT OF BRANDTJEN FARM, according
to the recorded plat thereof, Dakota County, Minnesota.
2. The City Clerk is directed to file a certified copy of this resolution with the
Dakota County Recorder.

Eagleview Drive and north of 170 Street.
Jacob Fick from Tradition Development presented an overview of their request.
Planning Director Daryl Morey presented the planning report. Mr. Morey stated that
in conjunction with the final plat application of Spirit of Brandtjen Farm 13 Addition,

Mr. Morey stated that Planning Department staff recommends approval of the Spirit

BACKGROUND
Tradition Development representatives have submitted a final plat application for Spirit of
Brandtjen Farm 13th Addition, which re -plats six single family lots from Spirit of Brandtjen
Farm (SBF). This re -plat will adjust lot lines so the lots will be better suited to the setbacks and
design criteria of the SBF PUD. In conjunction with the final plat, Tradition Development is
requesting the vacation of the boundary drainage and utility easements for each of the six
lots being re- platted. The Spirit of Brandtjen Farm 13th Addition final plat is located north and
west of Eagleview Drive (see Exhibit A).

APPLICATION ANALYSIS
Consistency with the Preliminary Plat. The six single family lots in the SBF 13th Addition
re -plat are consistent with the lot design approved with the SBF preliminary plat. The street
serving the six single family lots (East Lake Drive) has already been constructed and is not
being modified by the proposed re -plat.
Lots. There is no minimum lot area required by the SBF PUD District. Rather, lots are
regulated based on minimum width requirements, setbacks and design standards established
by the SBF PUD Booklet dated June 20, 2005. As shown on Exhibit F, Lot 1, Block 1 and Lots
1 -3, Block 2 are designated as cottage lots and Lots 2 and 3, Block 1 are designated as
traditional lots.
Setbacks. The proposed single family lots in SBF 13t Addition are subject to the setback
requirements for cottage lots (Lot 1, Block 1 and Lots 1 -3, Block 2) and traditional lots (Lots 2
and 3, Block 1) and as set forth in Section 7 of the SBF PUD Booklet.
Streets. The six single family lots in SBF 13th Addition front a looped segment of East Lake
Drive that is a 24 foot wide, one -way street with on- street parking on one side and five foot
concrete sidewalks on both sides. A 48 foot right -of -way was dedicated for East Lake Drive
with the SBF final plat consistent with the design standards set forth is Section 6 of the SBF
PUD Booklet.
Grading, Drainage, Erosion Control and Utilities. Engineering Department staff has
reviewed the SBF 13th Addition final plat and easement vacation and recommend approval in
their attached memo dated February 11, 2014.
Easement Vacation. The SBF 13th Addition final plat includes the vacation of the existing
boundary drainage and utility easements within the six single family lots being re- platted.
New boundary drainage and utility easements are shown for each of the six single family lots
included with the SBF 13t Addition final plat.
RECOMMENDATION
Planning Department staff recommends approval of the Spirit of Brandtjen Farm 13th
Addition final plat and easement vacation subject to the following stipulations:
1. The recommendations listed in the February 11, 2014 engineering report.
2. The lots in SBF 13 Addition must meet the setback and design standards established
by the approved SBF PUD Booklet dated June 20, 2005.

SBF Development Corporation has submitted a final plat named Spirit of Brandtjen Farm 13th
Addition. The proposed subdivision is a re -plat of Lots 1 to 6 of Block 13 and Outlot PP of the
original Spirit of Brandtjen Farm plat. No additional lots are proposed with this final plat. The
plat is requested to adjust lot sizes in order to make them more compatible with current
house styles being offered within the Spirit of Brandtjen Farm development. The plat is
located directly north and east of East Lake Drive.
The proposed plat consists of six (6) single family residential lots within two (2) blocks.
Utilities and streets were previously constructed in 2013, which included minor re- grading of
side yard swales necessary for the reconfigured lots.

SITE CONDITIONS
The area included within the Spirit of Brandtjen Farm 13 Addition was previously graded in
2013 with final street and utility construction. The utility and street layout followed the
original Spirit of Brandtjen Farm plat.
PARKS. TRAILS AND SIDEWALKS
No new park dedication, trails, or sidewalk are required with Spirit of Brandtjen Farm 13
Addition. The developer is required to meet all the park, sidewalk, and trail requirements
listed in the Spirit of Brandtjen Farm Development Agreement.
U TILITIE S
SANITARY SEWER:
No new sanitary sewer is required for Spirit of Brandtjen Farm 13th Addition. The sanitary sewer
through the development and sanitary sewer services were installed in 2013 with the Spirit of
Brandtjen Farm plat.
WATERMAIN:
No new watermain is required for Spirit of Brandtjen Farm 13' Addition. The watermain and
water services were installed with the Spirit of Brandtjen Farm 13th Addition plat. Some of the
water service curb stops may be located within proposed driveway surfaces. The developer
must ensure that a meter cover is installed over all the curb stops that fall within driveway
areas.
DRAINAGE AND GRADING
The rough site grading was completed with the Spirit of Brandtjen Farm plat. The stormwater
basins and infiltration areas have been constructed. The developer must submit a soils report
for the revised building locations to verify that the building pads are prepared for building
construction.
STORM SEWER
The storm sewer was installed with the Spirit of Brandtjen Farm plat, and the storm sewer area
charge has been paid.
FEMA FLOODPLAIN ANALYSIS
The Spirit of Brandtjen Farm 13th Addition is shown on the Flood Insurance Rate Map (FIRM) as
Zone X by the Federal Emergency Management Agency (FEMA). Based on this designation,

there are no areas in the plat located within a Special Flood Hazard Area (SFHA), as
determined by FEMA.
WETLANDS
There are no wetlands within Spirit of Brandtjen Farm 13th Addition.
TREE PRESERVATION
There are no significant trees within the Spirit of Brandtjen Farm 13th Addition.
EROSION CONTROL
As stated previously, the site has been graded. The developer must maintain the erosion
control per the Spirit of Brandtjen Farm Development Agreement and approved plans, and
the builder must install and maintain erosion control as required by the individual building
permits.
EASEMENT VACATION
The shifting of the lots requires that the original drainage and utility easements placed along
the property lines must be vacated. With this re -plat, public drainage and utility easements
will be placed around the perimeter of the revised lots.
SECURITIES
A security is being held by the City for the improvements installed by the developer with the
Spirit of Brandtjen Farm plat. A security is also being held by the City for the installation of the
lot corner monuments. As the total number of lots has not changed, no additional security is
required with this development.
CASH FEES
There are no cash fees due with this development; the proposed plat is moving lot lines only.
RECOMMENDATION
Engineering recommends approval of the Spirit of Brandtjen Farm 13th Addition final plat and
easement vacation subject to the comments contained in this report. Approval is also subject
to the comments of the City Administrator, Planning Director and City Attorney.
